"1r:..789 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS 19.60.060 AND 19.60.070 OF THE SAN BERNARDINO MUNICIPAL CODE TO 3 PROVIDE FOR ABATEMENT BY REMOVAL OR CLEANING OF AREA FOR SIGNS OBSCURED BY WEEDS, LITTER OR DEBRIS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 5 ORDAIN AS FOLLOWS: 6 SECTION 1. Section 19.60.060 of the San Bernardino Municipal 7 Code is amended to read: 8 "19.60.060 Maintenance. 9 All signs shall be maintained in a safe condition and in good 10 repair, and the area around each sign shall be kept free of weeds, 11 debris and litter. Any sign structures that are permitted to ]2 deteriorate to such a condition that the paint or lettering or 13 plastic parts commence to crack, peel or weather, or signs or 14 structures which become bent or damaged, shall be repaired and ]5 restored to their original condition, or shall be completely 16 removed, and any sign or structure which is overgrown with weeds 17 or which is partially or wholly obscured by weeds, debris or ]8 litter shall have all such weeds, debris .and litter removed." 19 SECTION 2. Section 19.60.070 of the San Bernardino Municipal 20 Code is amended to read: 21 "19.60.070 Abandoned signs. 22 Any sign which is not used for a period of one hundred eighty 23 days shall be considered abandoned, and any wood sign which is 24 partially or wholly obscured by the growth of dry vegetation or 25 weeds or by the presence of debris or litter, shall be deemed a 26 public nuisance. Each such sign shall be removed by the property 27 owner within ten days after notice from the Superintendent of 28 Building and Safety, which notice shall provide an opportunity to MC-289 . -- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 - be heard before the Superintendent on the abandonment or nuisance decision. The appeal shall be granted or the decision modified if facts or circumstances disprove an abandonment or the existence of a public nuisance as defined elsewhere in this Code. Any sign not removed within ten days after such notice may be summarily abated by the Superintendent of Building and Safety if no appeal has been taken from the Superintendent's decision or if the appeal has been denied or modified. Costs of such abatement may be assessed against the property, using the procedures established in Sections 8.27.100 through 8.27.140, inclusive, which are hereby made applicable, except that the Superintendent of Building and Safety shall act instead of the Public Services Superintendent in making the assessment."
