ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
3.64.100 SUBSECTION C AND SECTION 5.04.075 OF THE SAN BERNARDINO
MUNICIPAL CODE TO PROVIDE ADDITIONAL PENALTIES FOR LATE PAYMENT OF
DOWNTOWN PARKING TAX AND BUSINESS LICENSES, INCLUDING NEW
LICENSES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 3.64.100 Subsection C of the San
8 Bernardino Municipal Code is amended to read:
9
"C. For failure to pay the tax on or before the start of
10 business, or for failure to pay the tax before the applicable
11 delinquent date, there is imposed a penalty of fifty percent of
12 the tax. An additional penalty of fifty percent of the tax shall
13 be imposed on the last day of the third consecutive month of
14 delinquency. Such penalties shall be added to the tax due."

SECTION 2. Section 5.04.075 of the San Bernardino Municipal
16 Code is amended to read:

"5.04.075 Penalties for delinquencies.
A. The times of delinquency and penalties assessed therefor
19 for all licenses covered by this title shall be determined by the
20 provisions of this section.

B. Payments for the respective licenses as set forth in this
22
23
title which are not made on or before, or which are received in
the City Clerk's office after, the following applicable delinquent
24
dates, or which bear a postmark after said dates, shall be deemed
25
delinquent and therefore subject to the following penalty
26
assessments:

1. Monthly licenses: the tenth day of every month for
28 which the license is due;

2. Quarterly licenses: the last day of the first month
2 of the quarter for which such license is due: January 31st, April
3 30th, July 31st and October 30th;

3. Semi-annual or annual license: the last day of the
5 first month in which such license is due by its terms.

C. For failure to obtain a license on or before the start of
7 business, or for failure to pay a license tax on or before the
8 delinquency date, there is imposed a penalty of fifty percent of
9 the license tax. An additional penalty of fifty percent of the
10 license tax shall be imposed on the last day of the third
11 consecutive month of delinquency. Such penalty shall be added to
12 the license tax and other penalties due."
