MC-296 ---------- 2 ORDINANCE OF TilE CITY OF SAN BERNARDINO AMENDING SECTION 3.52.030 OF THE SAN BERNARDINO tlUNICIPAL CODE TO INCREASE TilE 3 UNIFORM TRANSIENT OCCUPANCY TAX FROM SIX PERCENT TO EIGHT PERCENT, REPEALING ORDINANCE NO. MC-288, AND DECLARING THE URGENCY THEREOF. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 5 ORDAIN AS FOLLOWS: 6 SECTION 1. Section 3.52.030 of the San Bernardino Municipal 7 Code is amended to read: 8 "3.52.030 Tax imposed. 9 For the privilege of occupancy in any hotel, each transient 10 is subject to and shall pay a tax in the amount of eight percent 11 of the rent charged by the operator. The tax constitutes a debt 12 owed by the transient to the City which is extinguished only by 13 payment to the operator or to the City. The transient shall pay 14 the tax to the operator of the hotel at the time the rent is paid. 15 If the rent is paid in installments, a proportionate share of the 16 tax shall be paid with each installment. The unpaid tax shall be 17 due when the transient ceases to occupy space in the hotel. If 18 for any reason the tax is not paid to the operator of the hotel, 19 such tax shall be paid directly to the City Clerk." 20 SECTION 2. Ordinance No. MC-288, adopted July 5, 1983 and 21 approved July 7, 1983, increasing the Uniform Transient Occupancy 22 Tax from six percent to ten percent is repealed. 23 SECTION 3. Urgency. This ordinance is adopted as an urgency 24 measure relating to taxation and shall take effect and become 25 operative on August 1, 1983. The facts constituting such urgency 26 are that an increase in the rate of the Uniform Transient 27 Occupancy tax to eight percent is necessary in order to provide 28 sufficient revenue to balance the 1983-1984 fiscal budget of the MC-296 23 24 25 26 27 28 . . .. . . . ".. 1 City of San Bernardino which was approved on July 1, 1983, and so 2 that adequate revenue can be collected to meet the financial 3 obligations and indebtedness of the City and its various 4 departments which are being incurred. 5 I HEREBY CERTIFY that the foregoing ordinance was duly 6 adopted by the Mayor and Common Council of the City of San 7 Bernardino at a regular meeting thereof, held on 8 the 1st day of August , 1983, by the following vote, 9 to wit: 10 AYES: Council Members Castaneda, Reilly, Marks, 11 Quiel, Frazier, Strickler 12 NAYS: Council Member Hernandez 13 ABSENT: None 14 ~t1/~ / City Clerk 15 16 The foregoing ordinance is 4,d day 17 of au.
