ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
5.12.020 AND 5.12.070 OF THE SAN BERNARDINO MUNICIPAL CODE TO
CLARIFY DINE AND DANCE LICENSE REQUIREMENTS FOR OWNERS, MANAGERS,
OR OPERATORS WHO DO NOT OPERATE, CONDUCT OR CARRY ON A PUBLIC
DANCE AT LEAST ONE NIGHT IN EACH MONTH, AND TO AUTHORIZE
SIMPLIFIED APPLICATION PROCESS FOR SAME, AT DISCRETION OF THE
CHIEF OF POLICE.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 5.12.020 of the San Bernardino Municipal
9 Code is amended to read:
"5.12.020 License - Required.
It is unlawful for any person, firm, corporation or
12 association of persons, to operate, conduct or carryon any act
13 of entertainment, public dance hall, public dance, dancing club,
14 dine and dance club or night club, as the same are defined in
15 Section 5.12.010 without first obtaining a license to do so as
16 provided in this chapter."

SECTION 2. Section 5.12.070 subsection B of the San
18 Bernardino Municipal Code is amended to read:

"B. Every person, firm, corporation, or association of
20 persons operating, conducting, or carrying on a public dance
21 where the owner, manager or operator does not operate, conduct or
22 carryon a public dance at least one night in each month, shall
23 pay a license fee of forty dollars for each night. At the
24 discretion of the Chief of Police, the simplified application
25 process provided for in Section 5.l2.l20A may be utilized by such
26 persons, firms, corporations or associations."
27 I HEREBY CERTIFY that the foregoing ordinance was duly
28 adopted by the Mayor and Common Council of the City of San
