ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
19,82 OF THE SAN BERNARDINO MUNICIPAL CODE CONCERNING THE
ENFORCEMENT OF ZONING AND BUILDING VIOLATIONS TO EMPOl'l'ER THE
SUPERINTENDENT OF THE BUILDING AND SAFETY DEPARTMENT, SENIOR
BtlILDING INSPECTOR AND SENIOR PLUMBING INSPECTOR TO ISSUE
CITATIONS PURSUANT TO PENAL CODE SECTION 836.5.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:

SECTION 1. Section 19.82.040 of the San Bernardino
8 Municipal Code is amended to read:

"19.82.040 Notice procedure.
11 Code Compliance Specialist, Senior Building Inspector and Senior
The Superintendent of the Department of Building and Safety,
12 Plumbing Inspector of the City shall enforce this title and any
13 other ordinance or provision of this Code, including any uniform
14 code adopted by this Code, regulating the use, design, construc-
tion or condition of buildings or land in the City and may arrest

and issue notices to appear pursuant to Section 836.5 i'lnd
Chapter 5C of Part 2 Title 3 (Section R53.6, et seq.) of the
Penal Code of the State. Additionally, the Chief Engineer of the
Fire Department and his or her designated subordinates in the
Fire Department shall enforce the provisions of this title and
are authorized to perform any act, including the preparation and
issuance of written notices to appear for violations hereof,
under and pursuant to Section 836.5 and Chapter 5C of Part 2
Title 3 (Section 853.6 et seq.) of the Penal Code of the State."
