2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
12.28.060 OF THE SAN BERNARDINO MUNICIPAL CODE AUTHORIZING USE OF
3 PATTERNED CONCRETE IN SIDEWALK AND PARKWAY CONSTRUCTION, AND
PROHIBITING THE USE OF QUARRY TILE OR CERAMIC TILE IN SUCH
4 FACILITIES.

5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 12.28.060 of the San Bernardino Municipal
8 Code is amended to read:

"12.28.060 Permit required.
10 No person, firm or corporation shall grade, prepare,
11 subgrade, pave, lay sewer or drain pipe, construct curbs, gutters,
12 driveways, sidewalks, manholes, catch basins, retaining walls,
13 traffic signals, street lighting systems, or similar structures i
14 any street, alley or way, which street, alley or way is dedicated
15 or proposed to be dedicated for public use, within the City,
16 without first obtaining a written permit from the City to do so.
17 No such permit shall be issued for use of quarry tile or ceramic
18 tile for such improvements, but permission may be granted for use
19 of patterned concrete in such sidewalks, street medians and
20 parkways. The Director of pUblic Works/City Engineer may
21 establish a standard color for patterned concrete to be placed in
22 sidewalks, street medians and parkways on public developments, bu
23 the developer shall have the right to choose the color if the
24 improvements are being made by a private developer."
