2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SUBSECTION
B OF SECTION 13.08.055 OF THE SAN BERNARDINO MUNICIPAL CODE TO
3 EXEMPT FROM PAYMENT OF CONNECTION FEES THOSE DWELLINGS CONSTRUCTED
ON LOTS FOR WHICH SUCH FEES WERE COLLECTED AT THE TIME OF
4 COnSTRUCTION OF A PREVIOUS mvELLING, AND PRO RATING FEES FOR
ADDITIONAL BEDROO/1S.

6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Subsection B of Section 13.08.055 of the San
9 Bernardino Municipal Code is amended to read:

"B. The fees prescribed in Section 13.08.050 shall not be
11 charged for the reconstruction of any dwelling demolished at the
12 election of the owner or as a public nuisance or destroyed by
13 flood, fire, other than fire intentionally set by the applicant,
14 or other disaster. This exemption shall apply only if the
15 applicant provides proof satisfactory to the Superintendent of
16 Building and Safety that such connection fees were collected by
17 the City at the time of construction of the dwelling to be
18 replaced. If the reconstructed dwelling includes a greater number
19 of bedrooms than the destroyed dwelling, the fees imposed in
20 Section 13.08.050 shall be charged only as to the number of
21 additional bedrooms in the reconstructed dwelling as set forth by
22 resolution."
