ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
12.90.040 OF THE SAN BERNARDINO MUNICIPAL CODE BY PROVIDING THAT
THE MAYOR AND COMMON COUNCIL MAY PROCEED IN ASSESSMENT DISTRICT
I'MATTERS WITHOUT NOTICE AND HEARING WHEN CONSIDERING PASSAGE OF THE
,RESOLUTION OF INTENTION, WHEN OWNERS OF LOTS OR LAND HAVE
1'luNANIMOUSLY AGREED AND HAVE MET ALL REQUIREMENTS; AND BY PROVIDING
fTHAT THE MAP BE RECORDED WITHIN FIVE DAYS AFTER ADOPTION OF THE
IRESOLUTION OF INTENTION.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 12.90.040 Subsection C of the San
IBernardino Municipal Code is amended by adding Paragraph 5 to read

II "5. The Mayor and Common Council may proceed without notice
I'and hearing if, when considering passage of the resolution of
intention, it is determined by at least a four-fifths affirmative

rote thereof (as determined in Subsection Dj that all of the
pwners of lots or land liable to be assessed or their bona fide
~gents, have signed and filed a petition requesting the formation
f the district, indicate that they have no objections to the

roposed work or work and acquisition, and agree as to the extent

f the district to be assessed and waive notice and hearing."

SECTION 2. Section 12.90.040 Subsection C of the San
22 ernardino Municipal Code is amended by adding Paragraph 6 to read
23 s follows:

"6. If the Mayor and Common Council are proceeding pursuant
25 0 Section 12.90.040 Subsection C, Paragraph 5, the Map required
26 0 be recorded pursuant to Section 12.90.040 Subsection C,
27 aragraph 4, shall be recorded within five days after adoption of
28 he resolution of intention."
