2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
2.40.070 TO THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE THAT
3 VARIOUS FEES AND CHARGES MAY BE DEFERRED BY CITY UPON RECEIPT OF
PROMISSORY NOTE FROM REDEVELOPMENT AGENCY.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:

SECTION 1. Section 2.40.070 of the San Bernardino Municipal
7 Code is added to read:

"2.40.070 Deferral of fees.
9 At the request of the Community Development Commission, the
10 City may defer its various building permit and inspection fees,
II park development and recreation fund fees, planned local drainage
12 facilities fund fees, subdivision improvement plan checking fees,
13 grading improvement plan checking fees, public works construction
14 fees, grading permit fees, preliminary and final map filing fees,
15 electrical energy fees, and other fees and charges by the Planning
16 Department and various other City departments, except the sewer
17 capacity fee specified by Section 13.08.050 Subsection B. In the
18 event the Mayor and Common Council approve such a deferral, the
19 Redevelopment Agency shall issue its promissory note payable to
20 the City for the amount of all such fees deferred, specifying in
21 such note the time or times at which each of such deferred fees
22 shall be paid by the Redevelopment Agency to the City.
23 Notwithstanding any other provision of the San Bernardino
24 Municipal Code, any City official shall accept the promissory note
25 of the Redevelopment Agency in lieu of cash payment for such fees,
26 as to any development for which deferral of fees has been approved
27 by the Mayor and Common Council."
