2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
2.02.100 AND AHENDING SECTIONS 5.04.175 AND 12.56.030 OF THE
3 SAN BERNARDINO MUNICIPAL CODE TO PERHIT ADHINISTRATIVE
ISSUANCE OF PERHITS FOR PARADES, CIRCUSES, RODEOS, AND CARNIVALS
4 AND OTHER EXHIBITIONS UNDER CERTAIN CIRCUMSTANCES.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 2.02.100 is added to the San Bernardino
8 Municipal Code to read:
9 "2.02.100 Administrative Issuance of Permits.
10 The City Administrator may, upon application and upon
11 finding of good cause so to do, issue a permit for the conductinc
12 of a parade, or the holding of a circus, carnival, rodeo or
13 other exhibition, or for any other event or activity for which
14 approval from the Mayor and Common Council is othenvise required
15 under the provisions of this Code. Before issuing any such
16 permit, license or other permission to proceed, the City
17 Administrator shall obtain the recommendations of all depart-
18 ments affected by the proposed activity, and consider the
19 recommendations of such departments. The City Administrator
20 shall also require prior to the granting of any such permit,
21 license or permission, that advance payment be made of all
22 fees, charges and costs to be incurred or expected to be incurrec
23 by the City as a result of such activity. No such permit,
24 license or permission shall be granted to any entity through
25 this administrative procedure without full payment in advance
26 of all costs expected to be incurred by the City, plus any fees
27 or charges otherwise due and payable. Upon issuance of any
28 such permit, license or permission, the City Administrator shall

1 report such issuance to the Mayor and Common Council, which,
2 upon review, may revoke any license for any activity or event
3 which is continuing or may continue as of the date of such
4 review by the Mayor and Common Council."
5 SECTION 2. Section 5.04.175, Subsection F of the San
6 Bernardino Municipal Code is amended to read:
7 "F. provisions of Section 2.02.100 of this Code for
8 administrative issuance of a permit shall also apply."
9 SECTION 3. Section 5.04.175 of the San Bernardino
10 Municipal Code is amended by adding Subsection G:
11 "G. The revenue provisions of this section, but not the
12 regulatory provisions thereof, shall apply to activities
13 conducted during the annual citrus fair held under the auspices
14 of the National Orange Show on its show ':jrounds."
15 SECTION 4. Section 12.56.030 of the San Bernardino
16 Municipal Code is amended to read:
17 "12.56.030 Permit - Issuance.
18 A. The Common Council shall grant the permit unless there is
19 presented to the Common Council at the time of the consideration
20 substantial and convincing evidence of a clear and present
21 danger that the granting of the permit will result in the
22 obstruction of the orderly movement of traffic or the peace-
23 able passage or presence of persons, to, over or upon the
24 public highways and other public places, or disorder or unlawful
25 conduct, or unlawful injury of persons, or destruction of life
26 or property, or tend ing to incite crime, or an invasion of the
27 rights of privacy, or threatening the overthrow of the lawfully
28 established government by force, in which case the permit may

be denied.

B. The provisions of Section 2.02.100 of this Code for
administrative issuance of permits shall also apply."
