ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
19.82.010 AND 19.82.040 OF THE SAN BERNARDINO MUNICIPAL CODE
AUTHORIZING DESIGNATED PLANNING DEPARTMENT PERSONNEL TO ENFORCE
CERTAIN PROVISIONS OF THE SAN BERNARDINO MUNICIPAL CODE.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 19.82.010 of the San Bernardino
Municipal Code is amended to read:
"19.82.010 Enforcement.
It shall be the duty of the Code Compliance Specialist, the
Superintendent of the Department of Building and Safety, the
Chief Engineer of the Fire Department, and the Planning Director,
and all subordinates designated by any of them, to enforce the
provisions of this title and other provisions of this Code."
SECTION 2. Section 19.82.040 of the San Bernardino
Municipal Code is amended to read:
"19.82.040 Notice Procedure.
The City's Superintendent of the Department of Building and
Safety, Code Compliance Specialist, Senior Building Inspector, and
the Senior Plumbing Inspector, shall enforce this title and any
other ordinance or provisions of this Code, including any uniform
code adopted by this Code which regulates the use, design,
construction or condition of buildings, structures or land in the
City and may arrest or issue notices to appear pursuant to
Section 836.5 and Chapter 5C of Part 2 Title 3 (Sections 853.6,
et seq.) of the Penal Code of the State for any such violation
or violations. Additionally, the Chief Engineer of the Fire
Department and his or her designated subordinates in the Fire
Department shall enforce the provisions of this title and are

authorized to perform any act, including the preparation and
issuance of written notices to appear for violations hereof,
under and pursuant to Section 836.5 and Chapter 5c of Part 2
Title 3 (Sections 853.6 et seq.) of the Penal Code of the State.
Also, the Planning Director, Principal Planners, Senior Planners,
Associate Planners, Assistant Planners and Planning Aides shall
enforce this title, Title 18, Chapters 8.15, 8.18, 8.21, 8.24,
8.27, 8.33, 8.36, 10.16 and 15.52 of the San Bernardino Municipal
Code."

adopted by the Mayor and Common Council of the City of San
Bernardino at a regular meeting thereof,
