ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN
BERNARDINO MUNICIPAL CODE SECTIONS 19.04.080, 19.24.020,
19.26.020, 19.28.020, 19.32.020, 19.36.020, 19.38.020, AND
19.40.020, PERTAINING TO NUISANCES TO CLARIFY THE DEFINITION OF
AUTOMOBILE SERVICE STATION, AND TO ESTABLISH THAT AUTOMOBILE
SERVICE STATIONS SPECIFICALLY FALL WITHIN THE PROVISIONS OF
CHAPTER 8.33 PERTAINING TO PUBLIC NUISANCES IF USE IS
DISCONTINUED AND NOT REESTABLISHED WITHIN ONE HUNDRED EIGHTY
DAYS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 19.04.080 of the San Bernardino
10 Municipal Code is amended to read:
11
"19.0L~.080 Automobile service station.
12 'Automobile service station' means an area which provides
13 for the servicing or fueling of motor vehicles, including tube
14 and tire repairs, battery charging, storage of merchandise and
15 supplies related to the servicing of motor vehicles, sale of
16 gasoline and other fuel and lubricants, motor vehicle washing
17 Cnot including automatic car wash) and grease racks, but
18 excluding motor vehicle repairs, body and fender works, engine
19 overhauling and other similar activities."

21 Bernardino Municipal Code to read:
SECTION 2. Subparagraph 19.24.020 C 1 c is added to the San

Bernardino Municipal Code to read:
"c. The provisions of Chapter 8.33 shall apply to each
automobile service station site."
SECTION 5. Subsection 19.32.020 H is added to the San
Bernardino Municipal Code to read:
"H. The provisions of Chapter 8.33 shall apply to each
automobile service station site."
SECTION 6. Paragraph 19.36.020 E 3 is added to the San
Bernardino Municipal Code to read:
"3. The provisions of Chapter 8.33 shall apply to each
automobile service station site."
SECTION 7. Subparagraph 19.38.020 0 8 c is added to the San
Bernardino Municipal Code to read:
"c. The provisions of Chapter 8.33 shall apply to each
automobile service station site."
SECTION 8. Paragraph 19.40.020 C 3 is added to the San
Bernardino Municipal Code to read:
"3. The provisions of Chapter 8.33 shall apply to each
automobile service station site."
SECTION 9. Subsection 8.33.010 P is added to the San
Bernardino Municipal Code to read:
"P. Automobile service stations, and the buildings and
premises thereof, that have been vacant or abandoned for a period
in excess of one hundred and eighty consecutive days without
being reestablished and which have been maintained in such a
condition as to become so defective, unsightly, or in such a
condition of deterioration or disrepair that the same cause
appreciable diminution of the property values of surrounding

properties, or are materially and economically detrimental to the

neighboring properties and improvements."

I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San

Bernardino at a
regular
meeting thereof, held

on the
