Me-38B 2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 6.38 TO THE SAN BERNARDINO MUNICIPAL CODE PERTAINING TO POLICE DOGS TO 3 MAKE IT UNLAWFUL TO TEASE, HARASS, AGITATE, PROVOKE, BEAT, KICK, STRIKE, INJURE OR OTHERWISE INTERFERE WITH POLICE DOGS WHEN A DOG 4 IS BEING USED IN OFFICIAL CAPACITY, AND DECLARING THE URGENCY THEREOF. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 6 DO ORDAIN AS FOLLOWS: 7 SECTION 1. Chapter 6.38 is added to the San Bernardino 8 Municipal Code to read: 9 "Chapter 6.38 10 POLICE DOGS 11 6.38.010 Interference with police dogs. 12 It is unlawful for any person, in a manner not otherwise 13 prohibited by California Penal Code Section 597, to tease, 14 harass, agitate, provoke, beat, kick, strike, injure, or in any 15 way interfere with any dog being used by any police officer in 16 the performance of his or her official duties." 17 6.38.020 Penalty - Infraction. 18 Any person violating any of the provisions of this chapter 19 is guilty of an infraction, which upon conviction thereof is 20 punishable by a fine not to exceed $50.00." 21 SECTION 2. This ordinance is an urgency measure, which 22 shall take effect and become operative upon its adoption and 23 approval. 24 The facts constituting such urgency are that the Police 25 Department is currently using one police dog to aid police 26 officers in the performance of duties, and is anticipating 27 obtaining another dog for such purposes in the near future. 28 Adoption of the ordinance effective immediately is considered : MC-3&1 ~ i 1 I 2 I I 3 4 5 6 7 8 9 10 II 11 I ]2 I 13 14 ]5 ]6 ]7 ]8 ]9 20 21 22 23 24 25 26 27 28 "" necessary for the immediate preservation of the public peace, hea1ty or safety.
