MC-400 ORDINANCE OF THE CITY OF SAN BERNARDINO ESTABLISHING A MORATORIUM ON EFFECTIVE DATE OF INCREASED PARKING REQUIREMENTS IMPOSED BY ORDINANCE NO. MC-381 AS TO CERTAIN BUILDINGS, AND REINSTATING FORMER PROVISIONS AS TO THOSE BUILDINGS, EFFECTIVE IMMEDIATELY, AND DECLARING THE URGENCY THEREOF. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Notwithstanding the provisions of Sections 19.56.200, 19.56.210, 19.56.220, 19.56.240, and 19.56.330, the increased parking requirements imposed by those sections of the San Bernardino Municipal Code shall not apply to proposed build- ings to be located in the Parking District, for which construction plans evidencing a building with more than 100,000 square feet of floor space have been filed for plan checking prior to January 1, 1985, and the increased parking requirements imposed by those sections shall continue to be inapplicable to such buildings so long as the construction proposed is actively being pursued. This exemption shall become void upon the passage of any 3D-day period during which construc- tion is not being actively pursued, or, if the building is under construction without being completed within three years from the commencement of construction, unless the Mayor and Common Council make an express finding of good cause for delay and agree to continue the exemption thereafter by resolution. Upon the occurrence of such unexcused delay, the exemption is void and the standards established by Ordinance No. MC-381 shall be thereafter effective as to such buildings. SECTION 2. The provisions of Section 19.56.200 of the San Bernardino Municipal Code, as they existed prior to the . Provisions of Sections 19.56.220 and 19.56.330 as they existed prior to the changes effected by Ordinance No. MC-381 will also apply to the buildings exempted from the increased parking requirements imposed by Ordinance No. MC-381, during the period of such exemption. SECTION 3. This ordinance shall apply only to buildings for which construction plans for a building with more than 100,000 square feet of floor space have been filed for plan checking with the City of San Bernardino on or before January 1, 1985, and shall apply to those buildings only so long as construction actively continues, as specified hereinabove. SECTION 4. This ordinance shall take effect immediately upon adoption as an urgency ordinance. The facts constituting urgency are that at least one major construction project in the downtown area cannot proceed with such increased parking requirements, that this project has been delayed on numerous occasions and further delays endanger the project's feasibility, that this project is considered vital for the development of the Central City area, and the increased job opportunities to be available through these construction activities and through opening of additional businesses in such building will help the City of San Bernardino overcome the critical unemployment situation which has afflicted the City of San Bernardino.
