ORDINANCE OF THE CITY 0: SAN BERNARDINO AMENDING SECTION
9.90.010 OF THE SAN BERNARDINO MUNICIPAL CODE TO ADD CHAPTER 9.49
TO THE LIST OF PORTIONS OF THE MUNICIPAL CODE TO BE ENFORCED BY
I SECURITY GUARD PERSONNEL.
I THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
.1 DO ORDAIN AS FOLLOWS:

SECTION 1. Section 9.90.010 of the San Bernardino Municipal
7 Code is amended to read:

"9.90.010 Arrest - Citation.
9
A. Security guard personnel, who shall be off-duty or
10 retired police officers or reserve police officers, employed by
11 the Redevelopment Agency of the City of San Bernardino pursuant
12 to an agreement between said Agency and the City, relating to a
13 security guard program, are authorized and empowered to arrest
14 and issue notices to appear for violations of the provisions of
15 Chapters 5.40, 8.15, 9.48, 9.49, and 12.44, and Section 9.12.030
16 as to incidents arising in the Central City Mall and public areas
17 in, adjacent to, or immediately surrounding said Mall, pursuant
18 to Section 836.5 and Chapters 5C and 5D of Part 2, Title 3
19 (Sections 853.6, et seq.) of the California Penal Code.

B.
Police Assistants are authorized and empowered to issue
21 notices to appear for violations of any provision of this Code.

C. The Planning Director, Principal Planners, Senior
23 Planners, Associate Planners, Assistant planners and Planning
24 Aides are authorized and empowered to issue notices to appear
25 for violations of Titles 18 and 19 of this Code and for
26 violations of Chapters 8.15, 8.18, 8.21, 8.24, 8.27, 8.33, 8.36,
27 10.16, and 15.52 of the San Bernardino Municipal Code."
