O'UJINANCF: OF THE CITY OF SAN B/<:RNARDIIW ADDING .)UB~ECTION C
TO SECTION 19.70.020 OF THE SAN BERNARDINO MUNICIPAL CODE
PERTAINING TO FILING WITH Tm: PLANNING DEPARTt1ENT A SECURITY FOR
COMPLETION OF CONDITIONS IMPOSED BY THE PLANNING DEPARTMENT.
THE MAYOR AND Cml~10N COUNCIL OF THE CITY OF SAN J3ERNAEDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 19.70.020 of the San Bernardino
Muni~iDal Code in amended hy adding thereto subsection C to read:
"C. A certificate of occupancy may be issued by the Chief
Building Inspector subject to such reasonable and lawful terms
and conditions as the Planning Department or Planning Commission
may prescribe subject to review by the Mayor and Common Council,
if desired by the property owner; provided, that before such
certifi-::ate of occupancy is issued, the applicant shal] deposit
with the Planning Department, or vJith 11 responsible bank or tnwt
company at the option of the City, time ~ertificates of deposit
in the name of the City, or a Dower of attorney and assignment
and delivery to the City of a time certificate of deposit a
deposit of money or negotiable honds or an approved instrument of
credit from a financial institution plerlgin~ that the necess2ry
funds n.re on deposit <3nd glla.ranteed for payment, as secur:l_ty to
8uarantee the faith:F1.\J performance 2nd completion of the terms
and ~ondit:Lons, in an amount at least equal to the estimated cost
necessary to cover such faithful performance, but in no case less
than the sum of one thousand dollars. Said funds shall be
returned or released to the depositor I~ithin ten days follol"ing
the date upon which full compliance with aU terms and conditions
is establi.shed~ The llse of this securlty deposit mechanism shalJ
not he justj.fication for imposition of any Bllditional terms or
