MC-453 ORDINANCE OF THE CITY OF SAN BERNARDINO REZONING A CERTAIN PARCEL OF LAND, AMENDING THE LAND USE ZONING MAP, WHICH IS INCORPORATED BY REFERENCE IN SECTION 19.06.020 OF THE SAN BERNARDINO MUNICIPAL CODE (PETITION NO. 84-29, AN IRREGULARLY- SHAPED PARCEL OF LAND CONSISTING OF APPROXIMATELY 2.36 ACRES HAVING A FRONTAGE OF APPROXIMATELY 329 FEET ON THE SOUTH SIDE OF COURT STREET AND A FRONTAGE OF 428 FEET ON THE NORTH SIDE OF THIRD STREET AND BEING LOCATED APPROXIMATELY 241 FEET EAST OF THE CENTERLINE OF SIERRA WAY), ADOPTING THE NEGATIVE DECLARATION FOR ENVIRONMENTAL REVIEW, AND DECLARING THE URGENCY THEREOF. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Pursuant to Chapter 19.06 of the San Bernardino Municipal Code, the following described parcel of real property, an irregularly-shaped parcel of land consisting of approximately 2.36 acres having a frontage of approximately 329 feet on the south side of Court Street and a frontage of 428 feet on the north side of Third Street and being located approximately 241 feet east of the Centerline of Sierra Way, is rezoned from .0. Open Space District to R-3-1200 Multiple-Family Residential District: i I I I i I ! i i II II :1 'i SECTION 2. 'I II , reference in Section 19.06.020 of the San Bernardino Municipal All that real property situated in the City Bernardino, County of San Bernardino, State California, described as follows: of San of Parcel No. 4 and Parcel No. 5 of Parcel Map No. 7140, as per plat recorded in Book 69 of Parcel Maps, Pages land 2, in the City of San Bernardino, County of San Bernardino, State of California. (PETITION NO. 84-29.) The zoning map, which is incorporated by MC-453 ~ ,- 1 ~ hereto, marked Exhibit "A", and incorporated herein by reference, 2 is hereby approved and adopted. 3 SECTION 4. Urgency. This ordinance is an urgency measure, 4 which shall take effect and become operative upon its adoption and 5 approval. 6 The facts constituting such urgency are that the zone change 7 is necessary to permit the construction of a project within the 8 area being rezoned. Financing of the project is provided by the 9 San Bernardino Redevelopment Agency and such financing is 10 jeopardized if construction of the project is not commenced II immediately. Moreover, a similar change of zone ordinance for the I 12 subject property, No. MC-444, was recently adopted and later 13 repealed due to a misunderstanding concerning a grant of density 14 bonus. Thus, there has been published notice and objections were 15 not filed to the change of zone and further delays would be 16 harmful to the general welfare.
