MC-454 2 ORDINANCE OF THE CITY OF SAN BERNARDINO REZONING A CERTAIN PARCEL OF LAND, AMENDING THE LAND USE ZONING MAP, WHICH IS INCORPORATED BY REFERENCE IN SECTION 19.06.020 OF THE SAN BERNARDINO MUNICIPAL CODE (PETITION NO. 84-31, LOCATED ON THE EAST SIDE OF ALLEN STREET, APPROXIMATELY 171 FEET SOUTH OF THE CENTERLINE OF FOURTH STREET), ADOPTING THE NEGATIVE DECLARATION FO ENVIRONMENTAL REVIEW, AND DECLARING THE URGENCY THEREOF. 3 4 5 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 7 8 SECTION 1. Pursuant to Chapter 19.06 of the San Bernardino 9 Municipal Code, the fOllowing described parcel of real property, 10 located on the east side of Allen Street, approximately 171 feet 11 south of the centerline of Fourth Street, is rezoned from "0" 12 Open District to R-3-l200 Multiple-Family Residential District: 13 All that real property situated in the City of San Bernardino, County of San Bernardino, State of California, described as follows: 14 15 Parcel No.2, Parcel Map No. 7140, as per plat recorded in Book 69 of Parcel Maps, pages 1 and 2, in the City of San Bernardino, County of San Bernardino, State of California. 16 17 (PETITION NO. 84-31.) 18 19 SECTION 2. The zoning map, which is incorporated by 20 reference in Section 19.06.020 of the San Bernardino Municipal 21 Code, is amended to reflect the change of zone set forth in this 22 ordinance. 23 SECTION 3. The negative declaration for environmental 24 review, as adopted by the Environmental Review Committee, attached 25 hereto, marked Exhibit "A", and incorporated herein by reference, 26 is hereby approved and adopted. 27 SECTION 4. Urgency. This ordinance is an urgency measure, 28 which shall take effect and become operative upon its adoption and MC-454 ~ iapproval. 2 The facts constituting such urgency are that the zone change J is necessary to permit the construction of a project within the 4 5 6 jeopardized if construction of the project is not commenced 7 immediately. Moreover, a similar change of zone ordinance for the , lisubject property, No. MC-445, was recently adopted and later ~repealed due to a misunderstanding concerning a grant of density jl !bonus.
