(URGENCY)
AN URGENCY ORDINANCE OF THE MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO, CALIFORNIA,
ESTABLISHING THE CITY OF SAN BERNARDINO INDUSTRIAL
DEVELOPMENT AUTHORITY
WHEREAS, the California Industrial Development Financing
Act, Government Code Section 91500, et seq. (the "Act"), provides
for the creation of industrial development authorities; and
WHEREAS,
the Act provides the exclusive authority for
public agencies within the State of California for the undertaking,
carrying out and completion of qualifying industrial projects as
more fully described in Government Code Section 91503; and
WHEREAS, there is a high level of unemployment among the
citizens of the City of San Bernardino, California (the "City"), and
the means of financing industrial development projects as set forth
in Government Code Section 91500, et seq.,
including, but not
limi ted
to,
the
establishment
of
an
industrial
development
authority, will assist in reducing unemployment in the City; and
WHEREAS, it is the desire of the Mayor and Common Council
of the City (the "Council") to establish an industrial development
authority, pursuant to Government Code Section 91520, by declaring
that there is a need for an industrial development authority to
function within the City; and

WHEREAS, for the foregoing reasons, the establishment of an
industrial development authority in the City 1S necessary for the
immediate preservation of the public peace, health and safety; and
WHEREAS, said industrial development authority will serve a
public purpose by providing for certain financings pursuant to the
Act in order to encourage industrial development within certain
areas of the City.
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO, CALIFORNIA, ORDAIN AS FOLLOWS:
Section 1.
The Council hereby finds and declares that
there 1S a need for an industrial development authority to be
created and to function within the City pursuant to the Act.
Section 2. The Council hereby establishes the City of
San Bernardino Industrial Development Authority (the "Authority"), a
public, corporate instrumentality of the State of California, which
shall be authorized to transact business and exercise its powers as
provided in the Act.
Sect ion 3. The Counci I hereby appoints the members of
the Community Development Commission of the City of San Bernardino
(the "Commission") to serve as members of the Board of Directors of
the Authority.

Section 4. The Staff of the Redevelopment Agency of the
Ci ty of San Bernardino (the "Agency") sha 11 serve and function as
the Staff of the Authority.
Section 5. The Council hereby authorizes and directs
the Authority to approve by resolution any and all other actions and
matters necessary for the Authority to transact business and
exercise its powers.
Section 6. The City Clerk is hereby authorized and
directed to cause a copy of this Ordinance to be transmitted to the
Authority for appropriate action by the Authority.
Section 7. This Ordinance shall take effect upon
adoption as an Urgency Ordinance. The facts constituting the
urgency for the adoption of this Ordinance are that there is a high
level of unemployment in the City, that the establishment of the
Authority is necessary to provide a means for making available
financing assistance for industrial development in order to
alleviate said unemployment, and that there are applications
pending for financing assistance pursuant to Government Code
Section 91500, et ~., which require the immediate establishment of
the Authority.

I HEREBY CERTIFY that the foregoing ordinance was duly
adopted

San Bernardino at an adjourned regular
meeting thereof,
held on the
