ORDINANCE NO. t1C-484
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
12.20 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE THAT PUBLIC
3 CONTRACTS SHALL BE GOVERNED BY THE PUBLIC CONTRACT CODE RATHER
THAN THE GOVERNMENT CODE, AND INCREASING THE EXPENDITURE FROM
4 FOUR THOUSAND DOLLARS TO FIVE THOUSAND DOLLARS FOR A PUBLIC
PROJECT WHICH MUST BE CONTRACTED FOR AND LET TO THE LOWEST
5 RESPONSIBLE BIDDER AFTER NOTICE.
6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

8 SECTION 1. Chapter 12.20 of the San Bernardino Municipal
9 Code is amended to read:
10 "Chapter 12.20
11 PUBLIC PROJECTS
12 12.20.010 Adoption of State statutes.
13 Public Contract Code Sections 20161, 20163, 20164, 20166 and
14 20168 of the State are adopted as laws governing the City, and
15 such sections shall take effect and be in force within the City
16 except as set forth in this chapter; provided, that any public
17 project shall be exempted under this chapter if the Mayor and
18 Common Councilor the Board of Water Commissioners determine that
19 the work on such public project can be performed by day labor or
20 City forces.
21 12.20.020 Applicable definitions.
22 As used in Public Contract Code Section 20161, the phrase
23 'public project' shall not mean the repair or maintenance of
24 public projects. The phrase 'repair or maintenance' as used in
25 this chapter is defined to mean only those items constituting
26 rehabilitation to original condition, or, as applied to streets:
27 A. The reworking of the existing street surface by the
28 application of one and one-half inch or less overlay, except that

1 twenty-five percent of the project may be of a greater thickness
2 to provide a leveling course;
3 B. The repair or replacement of existing signs, signals,
4 safety devices, guard rails, seal coats, culverts, curbs,
5 gutters, sidewalks, driveways and similar items.
6 12.20.030 Bids; expenditure requiring; notice
7 When the expenditure required for a public project exceeds
8 five thousand dollars, it shall be contracted for and let to
9 the lowest responsible bidder after notice."
10 I HEREBY CERTIFY that the foregoing ordinance was duly
11 adopted by the Mayor and Common Council of the City of San
12 Bernardino at a
