2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
3.04.070 OF THE SAN BERNARDINO MUNICIPAL CODE TO ELIMINATE THE
3 REQUIREMENT OF A SECOND PUBLICATION OF BIDS AND TO AUTHORIZE THE
PURCHASING AGENT TO ESTABLISH AND MAINTAIN A LIST OF SUPPLIERS
4 AND TO MAIL REQUEST FOR BIDS TO ENTITIES WHOSE NAMES ARE
CONTAINED THEREON.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:
7 SECTION 1. Section 3.04.070 Subsections Band D of the San
8 Bernardino Municipal Code are amended to read:
9 "B. Notice. Publication and Mailing. Notice inviting bids
10 shall be published at least ten days before the opening of bids
11 in a newspaper of general circulation printed and published in
12 the City.
13 The purchasing agent may establish and maintain a list of
14 prospective bidders. The prospective bidders shall be listed on
15 said list according to the service or product provided as
16 ind icated by the prospec ti ve bidder. It shall not be the
17 responsibility of the purchasing agent to ensure that the list
18 contains current information with respect to the address, service
19 or product of the prospective bidder. The purchasing agent is
20 authorized to mail invitations to bid directly to appropriate
21 prospective bidders appearing cn said list and to other
22 prospective bidders.
23 D. Bid Opening Procedure. Sealed bids shall be submitted
24 to the purchasing agent and shall be identified as bids on the
25 envelope. Bids shall be opened in public at the time and place
26 stated in the public notices. A record of the bids received
27 shall be available for public inspection after bids have been
28 opened, indicating the amounts bid by the various bidders and the

1 basis for awarding the contract or purchase order if other than
2 to the lowest bidder. Such list shall be available for
3 thirty days after the award has been made. "
4 I HEREBY CERTIFY that the foregoing ordinance was duly
5 adopted by the Mayor and Common Council of the City of San
6 Bernardino at an adjourned reaular
