ORDINANCE NO. MC-492
2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
14.08.075 TO THE SAN BERNARDINO MUNICIPAL CODE TO MAKE THE
3 FAILURE TO REMOVE AN UNAUTHORIZED CONNECTION OR ATTACHMENT TO A
DULY LICENSED CABLE TELEVISION SYSTEM AFTER WRITTEN NOTICE AN
4 INFRACTION.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

7 SECTION 1. Section 14.08.075 is added to the San Bernardino
8 Municipal Code to read:
9 "14.08.075 Unauthorized connection or attachment to cable
10 television system.
11 A. It is unlawful for an owner or occupant of any premises
12 to fail to remove or cause to be removed, any unauthorized
13 connection, whether physically, electrically, or inductively, or
14 attachment of any unauthorized device or devices to any cable,
15 wire, or other component of a franchised or otherwise duly
16 licensed cable television system servicing such premises after
17 service of written notice of such unauthorized connection or
18 attachment upon such owner or occupant.
19 B. Such written notice shall be served by mail or in person
20 by the affected franchised and duly licensed cable television
21 system upon the owner or occupant. It shall require the owner
22 or occupant to remove or cause the removal of any unauthorized
23 connection or attachment to a cable television system servicing
24 such premises within ten (10) days from the date of service of
25 such notice. The notice shall be addressed to the owner or
26 occupant of the premises where the unauthorized connection or
27 attachment to the cable television system exists. The notice
28 shall specify that a failure to comply with the notice is an

1 infraction. Service of the notice by certified mail shall be
2 deemed complete upon deposit in a public receptacle for United
3 States mail."
4 I HEREBY CERTIFY that the foregoing ordinance was duly
5 adopted by the Mayor and Common Counc i1 of the City of San
6 Bernardino at an adiourned TPq111t=lr meeting thereof,
7 held on the 21st day of January , 1986, by the
8 following vote, to wit:
