MC-508 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 18.40.160 OF THE SAN BERNARDINO MUNICIPAL CODE TO PERMIT THE FIRE 3 CHIEF TO EXEMPT THE DEVELOPMENT STANDARDS FOR SECONDARY ACCESS. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Section 18.40.160 of the San Bernardino Municipal 7 Code is amended to read: 8 "18.40.160 provision for ingress and egress. 9 A. Definitions. 10 1. For purposes of this section, a 'standard access or 11 route' is a route which is dedicated to the public, has a minimum 12 paved width of twenty-four feet, and conforms to all requirements 13 for construction contained in this chapter. 14 2. For purposes of this section, a 'nonstandard access 15 or route' is a route which is not constructed in full conformance 16 with the requirements for a standard route set forth in paragraph 17 1 above. 18 B. Requirement. A tentative map, final map, tentative 19 parcel map, or parcel map shall provide for at least two different 20 standard routes for ingress and egress. The purpose of these 21 routes is to permit accessibility of fire fighting and other 22 public equipment and to permit orderly evacuation in the event of 23 flood, fire or other emergency. Prior to recordation of the final 24 ap, adequate security shall be provided to ensure construction of 25 the required improvements before any certificate of occupancy is 26 issued. 27 C. Exemption from requirements. Upon a specific finding 28 hat the public health, safety, and welfare in the event of flood, Me-508' .' , . , 1 fire or other emergency do not require both of such routes, under 2 the circumstances of that particular application, the Fire Chief 3 may approve any such map with only one standard access under the 4 following circumstances: 5 1. The property is outside the high fire hazard area; 6 and 7 2. Based on appropriate traffic analysis, secondary 8 access is not required for traffic circulation purposes; or 9 3. An existing street provides only one standard route 10 for ingress and egress, not more than two thousand feet of street 11 extension is required, and the parcel map creates not more than 12 two residential lots, one of which the applicant represents will 13 be occupied as his or her primary place of residence; 14 4. Where property is inside the high fire hazard area, 15 the Fire Chief may approve such map with one standard access and 16 one nonstandard access where he finds that the nonstandard access 17 a. is traversible by firefighting and other 18 emergency equipment; 19 b. is adequate to accommodate the orderly evacuation 20 of all residences it is designed to serve; 21 22 c. is not subject to dangerous flooding; and d. where the nonstandard access is not dedicated to 23 the City, that an easement has been granted by another 24 overnmental agency for ingress and egress; or 25 e. where the nonstandard route is not dedicated to 26 the City, that there is an approved plan for use and maintenance 27 f the nonstandard route until such time as it is upgraded to a 28 tandard route, or an alternate standard route is provided; and -2- , Me-50B " .. J 1 f. that based on appropriate traffic analysis, 2 secondary access is not required for traffic circulation 3 purposes. 4 D. Procedures for exemption. 5 1. The Fire Chief may prescribe the form and content 6 of applications for an exemption from the development standards 7 for secondary access. As a part of the application process, the 8 Fire Chief may request comments from any City, County or state 9 agencies which he deems appropriate. 10 2. The Fire Chief may mail notice of the application 11 for exemption to all persons including businesses, corporations, 12 or other public or private entities shown on the latest equalized 13 assessment roll as owning real property within five hundred feet 14 of the SUbject property. Interested parties may submit written 15 comments to the Fire Chief by a date to be specified in the 16 notice. 17 E. Appeal. 18 1. The decision of the Fire Chief may be appealed to 19 the Fire Commission. An application for appeal, stating the 20 grounds upon which it is based, shall be submitted to the City 21 Clerk within ten days of the date of the Fire Chief's decision. 22 2.
