ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
3.18 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
3 ENTERPRISE ZONE TO INCLUDE MULTI-FAMILY HOUSING WITHIN PROVISIONS
FOR INFILL HOUSING, TO EXEMPT CERTAIN CONSTRUCTION FROM CULTURAL
4 DEVELOPMENT CONSTRUCTION FEES, AND TO CLARIFY INDUSTRIAL AREA
REBATE PROVISIONS TO COMPLY WITH COUNCIL INTENT.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
6 DO ORDAIN AS FOLLOWS:

SECTION 1. Section 3.18.030, paragraph F of the San
8
Bernardino Municipal Code is amended to read as follows:

nF.
'In-fill housing' as used in this Chapter is single
10
family home construction or multi-family housing construction not
11
exceeding four dwelling units per lot, built on vacant lots in
12
neighborhoods existing at the time of adoption of this Chapter,
13
or built on lots where existing structures are demolished or
14
removed for the construction of single family homes or multi-
15
family housing. This shall apply as to multi-family housing only
16
for multi-family housing which would otherwise qualify as in-fill
17
housing sites under the policies of the City of San Bernardino
18
and which are located within the boundaries of priority areas
19
numbered 1, 2, 3, 4, and 5, as established by the City of San
20
Bernardino. n

SECTION 2. Section 3.18.050 of the San Bernardino
22
Municipal Code is amended to read as follows:

"For any qualifying new or expanding business which locates
24
or expands in the Enterprise Zone within the first four years of
25
the life of the Enterprise Zone, City shall exempt on a one-time
26
basis from certain fees to qualifying new or expanding businesses
27
located within the Commercial Area of the Enterprise Zone, upon

SECTION 3. The introductory paragraph of Section 3.18.060
of the San Bernardino Municipal Code is amended'to read as

follows:

"During the first year of operation of any qualifying new
industrial business that locates within the industrial area of
9
the Enterprise Zone during the first four years of the life of
10
the Enterprise Zone, City shall rebate the following:"
11

I HEREBY CERTIFY that the foregoing ordinance was duly
13 adopted by the Mayor and Common Council of the City of San
