ORDINANCE NO. MC-546
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN
BERNARDINO MUNICIPAL CODE SECTION 15.57.040 SUBSECTION B RELATING
3 TO CULTURAL DEVELOPMENT CONSTRUCTION FEES AND FIXING A DATE UPON
WHICH DEVELOPMENT PERMITS WILL BE SUBJECT TO SUCH FEES AND
4 DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
6 ORDAIN AS FOLLOWS:
7 SECTION 1. San Bernardino Municipal Code Section 15.57.040
8 Subsection B is amended to read as follows:
9 "B. Notwithstanding the foregoing provisions, the fee shall
10 not be imposed and charged for any permit for which an application
11 together with two sets of complete plans and specifications as
12 required by Sections 301 and 302 of the Uniform Building Code are
13 filed with the City prior to October 9, 1986, provided that the
14 applicant has paid all estimated plan check fees prior to that
15 date and such plans are approved within one hundred eighty days of
16 filing with the City."
17 SECTION 2. This ordinance is an urgency measure, which shall
18 take effect and become operative upon its adoption and approval.
19 The facts constituting such urgency are that the present
20 ordinance's effective date is september 8, 1986, and there are
21 projects already in the development process which will be unfairly
22 burdened with this assessment fee. In order to fairly implement
23 this measure the effective date should be October 9, 1986.
24 I HEREBY CERTIFY that the foregoing ordinance was duly
25 adopted by the Mayor and Common Council of the City of San
