MC-551 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 18.40.160 SUBSECTION C OF THE SAN BERNARDINO MUNICIPAL CODE 3 REGARDING EXEMPTION FROM THE TWO STANDARD ACCESS ROUTE REQUIREMENT FOR SUBDIVISIONS WITHIN THE HIGH FIRE HAZARD AREA, 4 PROCEDURES FOR EXEMPTION INVESTIGATION AND OTHER REQUIREMENTS THEREFOR, REPEALING SUBSECTION E OF SECTION 18.40.160, AND 5 DECLARING THE URGENCY THEREOF. 6 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 7 8 SECTION 1. Section 18.40.160 Subsection C of the San 9 Bernardino Municipal Code is amended by adding paragraphs 3 and 4 10 to read as follows: 11 "3. Property within the high fire hazard area. Where the 12 subject property is located within the high fire hazard area, the 13 Mayor and Common Council, upon recommendation of the Planning 14 Commission, may approve a tentative map, final map, tentative 15 parcel map, or parcel map, with one standard and one non-standard 16 access route where it is found that with respect to the non- 17 standard access route: 18 a. The public health, safety and welfare do not 19 require that the secondary access be a standard route; 20 B. That such route shall be designed and maintained 21 to support the imposed load of fire apparatus and shall have a 22 surface sufficient to provide all-weather driving capabilities; 23 c. That such route is at least two lanes in width to 24 accommodate emergency vehicles; 25 d. A city-approved traffic analysis has been 26 completed which documents that a second standard access is not 27 needed for general traffic circulation. 28 ~~- I . . 1 4. General conditions for a non-standard access route. 2 a. Investigation and Planning Commission 3 recommendation. The Fire Chief shall conduct an investiga- 4 tion and make a recommendation to the Planning Commission as to 5 whether any non-standard secondary access shall be paved. The 6 Planning Commission shall make its recommendation based thereon 7 to the Mayor and Common Council which shall make the final 8 determination as to whether the non-standard access route shall 9 be paved. 10 b. Requirement of dedication and perpetual 11 maintenance. Any non-standard access route shall be over a 12 dedicated right-of-way or irrevocable easement; such route may be 13 over an easement granted to any public entity when such easement 14 permits provision for the perpetual maintenance of the access 15 routes in the manner approved by the City at the time of its 16 approval of the final map, tentative parcel map, or parcel map. 17 c. Improvement of access route upon further 18 development. At such time as further development occurs which 19 would provide an access route to a subdivision over a route 20 previously approved by the Mayor and Common Council pursuant to 21 the provisions of this section, that route shall be dedicated and 22 fully improved to a standard width for a street of its type, with 23 curbs, gutters, sidewalks and such other street improvements as 24 may be required under this code or any other ordinances or 25 policy." 26 SECTION 2. The ordinance is an urgency measure which shall take effect and become operative upon its adoption and approval. The facts constituting such urgency are that there has been an increase in building activity in the foothill areas. Fire hazard is greatest in the foothill areas. This ordinance is necessary to ensure proper design prior to subdivision approval for the protection of future residents from fire hazard and flood hazard.
