ORDINANCE NO. MC-55G
2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
3.44.065 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
3 CLARIFICATION OF THE IMPOSITION OF THE UTILITY SERVICE USERS TAX:
AND DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:
6 SECTION 1. Section 3.44.065 is hereby added to the San
7 Bernardino Municipal Code to read as follows:
8 "3.44.065 Application of city users tax.
9 The eight percent users tax imposed on telephone
10 communication services pursuant to Section 3.44.030, on CATV
1] service pursuant to Section 3.44.040, on electrical service
]2 pursuant to Section 3.44.050, and on gas service pursuant to
13 Section 3.44.060 shall be imposed only upon charges made for
14 consumer services. The eight percent users tax shall not be
15 levied upon any state or federal tax, fee or surcharge which is
16 separate from the users service charges. This section is intended
17 to clarify existing law; it does not propose any change in the
18 amount or method of calculation of the utility users tax."
19 SECTION 2. urgency. This ordinance is an urgency measure
20 which shall take effect and become operative upon its adoption and
2] approval. The facts constituting such urgency are that the City
22 desires to prevent the possibility of users paying service users
23 tax on nonservice utility charges. Such payments by individuals
24 could be substantial and represent a detriment to the health,
25 safety and welfare of the citizens of the City of San Bernardino.
26 I HEREBY CERTIFY that the foregoing ordinance was duly
27 adopted by the Mayor and Common Council of the City of San
28 Bernardino at a
