MC-570 ORDINANCE OF THE CITY OF SAN BERNARDINO CONCERNING THE 2 CONSOLIDATION OF THE PRIMARY MUNICIPAL ELECTION AND THE SPECIAL ELECTIONS OF SAID CITY AND DECLARING THE URGENCY 3 THEREOF. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 SECTION 1. Special Election. 8 9 10 11 12 13 14 15 16 17 A. A Special Election has been called in the Third and Fourth Wards of the City of San Bernardino for the election of two members of the Common Council from the Third and Fourth Wards for unexpired (short) terms ending on the day before the first Monday in June, 1987 and 1989 respectively and consolidated with the Primary Municipal Election of the City of San Bernardino, to be held on March 3, 1987. B. Said Primary Municipal Election shall be held pursuant to Charter Section 14 for the nomination of candidates to four-year terms for the following offices: l. Member of the Common Council from the Third Ward 18 ( full term) 19 2. Member of the Common Council from the Fifth Ward 20 (full term) 21 3. Member of the Common Council from the Sixth Ward 22 (full term) 23 4. Member of the Common Council from the Seventh Ward 24 (full term) 25 5. A City Attorney, City Clerk and City Treasurer 26 (full terms) 27 28 12/3/86 1 MC-S70 , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 C. said consolidated Special Elections shall be held for the election of a member of the Common Council as follows: 1. Member of the Common Council from the Third Ward (short term). The person receiving the highest number of votes at said election shall be declared elected to fill this vacancy in the Third Ward. 2. Member of the Common Council from the Fourth Ward (short term). The person receiving the highest number of votes at said election shall be declared elected to fill this vacancy in the Fourth Ward. D. In the election for the Third Ward, each candidate shall circulate and file nomination papers for both the unexpired term ending May 31, 1987, and for the full term commencing on June 1, 1987 and ending on the day before the first Monday in June, 1991. Such candidate shall file nomination papers for both the unexpired term and the full term and shall not be permitted to file solely for one term. Both filings shall occur on or before noon on December 24, 1986. Elections Code Section 22840.5 shall not apply to the consolidated primary and special elections because it is determined that no incumbent is eligible to be elected; nor shall Section 22840.5 apply to the municipal general election in the Third Ward. Candidates filing in both elections must file separate sets of nomination papers for each term. E. In the Fourth Ward, the unexpired term ends on the day before the first Monday in June, 1989. The election for 12/3/86 2 MC-5?O 1 2 3 4 5 6 the next full term in the Fourth Ward will be held in the regularly scheduled spring election on the first Tuesday after the first Monday in March of 1989. SECTION 2. Implementation. A. The city Clerk is hereby instructed and authorized to procure, prepare and distribute all necessary ballots and election supplies for said election. 7 B. That said consolidated election is hereby called and 8 9 10 1] will be held in accordance with and under and pursuant to the Charter of said City, and in accordance with the provisions of Elections Code of the State of California, except as herein specifically provided; and that the time provisions and ]2 procedures for filing and nominations shall be the same as ]3 those specified by the Mayor and Common Council for the ]4 Primary Municipal Election. ]5 C. That the Special Election as called in Section 1 ]6 hereof is hereby ordered consolidated with the Primary ]7 Election, and said elections shall be held in all respects as ]8 if there were only one election and the precincts, polling 19 places and precinct board members shall be the same as 20 provided in the California Elections Code. 2] 22 SECTION 3. Urqencv.
