ORDINANCE NO. HC-619
ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTIONS
9.84.020 and 9.84.030 TO THE SAN BERNARDINO MUNICIPAL CODE TO
REQUIRE A MINIMUM TWO-DAY JAIL SENTENCE FOR THE UNLAWFUL
DISCHARGE OF A FIREARM AND DEFINING THE TERM FIREARM.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1. Section 9.84.020 is added to the San Bernardino
Municipal Code and reads as follows:
"9.84.020 Violation - Penalty.
Any person violating any provision of this chapter is
10 guilty of a misdemeanor which, upon conviction thereof, is
11 punishable in accordance with the provisions of Section 1.12.010
12 of the Code except that any person violating any provision of
13 this chapter using a firearm upon conviction thereof shall be
14 punished by confinement in the county jail for at least two days
15 in addition to any fine imposed. If probation is granted upon
16 the conviction of any person using a firearm, a term of probation
17 shall be a minimum of two days' confinement in the county jail in
18 addition to any fine imposed."
19 SECTION 2. Section 9.84.030 is added to the San Bernardino
20 Municipal Code and reads as follows:

"9.84.030 Firearm - Defined.
22 As used in this chapter, the word firearm shall include any
23 device designed to be used as a weapon, from which is expelled a
24 projectile by the force of any explosion, or other form of
25 combustion, and shall include any rocket, rocket-propelled
26 projectile, launcher, or similar device containing any explosive
27 or incendiary material whether or not such device is designed for
