MC-628 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 3.26 TO THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH A TRAFFIC SYSTEMS FUND AND TO IMPOSE A TRAFFIC SYSTEMS FEE. SECTION 1. RECITALS. WHEREAS, because of new development and the change in use of existing development, there exists a need in the City of San Bernardino for additional traffic control devices, traffic related improvements and upgrades of the existing transportation system, and WHEREAS, the new systems and improvements to meet such needs are set forth in the Five Year Capital Improvement Plan, the Regional Transportation Improvement Program (RTIP), and the State Transportation Improvement Program (STIP), and, WHEREAS, the Public Works Department has completed a study supporting the need for such additional transportation systems, traffic control devices and traffic system improvements and determining the cost thereof, and WHEREAS, this need is created by: growth throughout the City, increases in vehicle loading of the existing systems, and a public demand for safer, more effective transportation networks, NOW, THEREFORE, the Mayor and Common Council do ordain as follows: SECTION 2. Chapter 3.26 is added to the San Bernardino Municipal Code to read as follows: 3.26.010. All public streets and highways under jurisdiction of the City of San Bernardino and all traffic control devices thereon are hereby declared to be a single transportation network. The Traffic Systems Fund is a fund for payment of the actual or estimated cos.cs of the design, upgrading or improvement of the traffic network. 3.26.030 Traffic Systems Fee A. There is hereby imposed a Traffic Systems Fee on all new development and any substantial improvement, which results in a net increase in the number of vehicle trips generated by a development as determined by a traffic study or by average trip estimates as published in the "Trip Generation", An Information Report (Current Edition) of the Institute of Transportation Engineers and accepted by the Director of Public Works/City Engineer. The amount of said fee shall be as established by Resolution of the Mayor and Common Council; however, in no event shall such fee exceed the pro-rata share of such development for the cost of any traffic system improvements to which such fee shall be applied. All Traffic Systems Fees collected shall be deposited in the Traffic Systems Fund. B. Capture rates or reductions in the number of trips 2 shall not be applied towards a reduction in the Traffic Systems 3 Fee to be paid. 4 3.26.040 Disposition of Funds 5 A. These monies shall thereafter be accounted for as required by California Government Code Section 66001 subsections (c) ld) and Ie).
