MC-684 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN BERNARDINO MUNICIPAL CODE SECTIONS 9.12.010, 9.12.030 SUBSECTION 3 BAND 9.12.040 SUBSECTION A AND REPEALING SAN BERNARDINO MUNICIPAL CODE SECTION 9.12.020. 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 5 DO ORDAIN AS FOLLOWS: 6 SECTION 1. 9.12.010 of the San Bernardino Municipal Code 7 is amended to read as follows: 8 "9.12.010 Interference with City business. Every person, 9 except officers or employees of any governmental agency on 10 official business, who willfully interferes with the good order, 11 lawful conduct or administration of any municipal program or 12 activity of the City, or with any City official in the 13 performance of his or her duty, with the intent to disrupt, 14 obstruct or to inflict damage to property or bodily injury upon 15 any person, is guilty of a misdemeanor or an infraction which, 16 upon conviction thereof, is punishable in accordance with the 17 provisions of Section 1.12.010 of this Code." 18 SECTION 2. 9.12.030 Subsection B is amended to read as 19 follows: 20 "B. Any person who has been directed to leave a City 21 building or facility pursuant to subsection A above and who 22 thereafter fails to immediately leave such building or facility 23 or who willfully and knowingly re-enters such building or 24 facility within seventy-two hours after being directed to leave, 25 is guilty of a misdemeanor or an infraction which, upon 26 conviction thereof, is punishable in accordance with the 27 provisions of Section 1.12.010 of this Code." 28 JFW:br November 1, 1989 1 MC-"684 , , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 'i SECTION 3. 9.12.040 Subsection A is amended to read as fOllows: "A. Any person, other than an authorized public officer or employee acting within the course and scope of his or her employment, who enters or remains in any municipal building or facility with the knowledge that such building or facility is closed to the public and, who does not have the present consent of an official of the City for his or her presence in the building or facility, is guilty of a misdemeanor or an infraction, which, upon conviction thereof, is punishable in accordance with the provision of Section 1.12.010 of this Code." SECTION 4. San Bernardino Municipal Code Section 9.12.020 is hereby repealed.
