AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 2.41 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE MAIN STREET ADVISORY BOARD OF SAN BERNARDINO DOWNTOWN MAIN STREET, INC. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Chapter 2.41 is added to read as follows: "Chapter 2.41 MAIN STREET ADVISORY BOARD 2.41.010 Members - Appointment. A. The Main Street Advisory Board of San Bernardino Downtown Main Street, Inc. (the "Main Street Advisory Board") shall consist of nine (9) members who shall serve at the pleasure of the Mayor and Common Council. Except with respect to the provisions of Chapter 2.17.040 which generally restricts membership on various City of San Bernardino boards, bureaus and commissions to San Bernardino registered voters who are and remain a resident within the ward of the Council member during the term of the appointment, Main Street Advisory Board Members shall be appointed and serve pursuant to all other provisions of Chapter 2.17. B. Main Street Advisory Board Members shall not be required to maintain voter registration or ward residency requirements as otherwise contained in section 2.17.040. Main Street Advisory Board Members shall be property owners, business owners, employees or other individuals demonstrating an interest in supporting the goals and objectives of the San Bernardino -1- Me-8S? 1 Downtown Main street, Inc., within the boundaries as may be 2 established from time-to-time within the Downtown area of the 3 city of San Bernardino. 4 2.41.020 Duties 5 The Main Street Advisory Board shall have such duties 6 as are delegated to it by the Bylaws of San Bernardino Downtown 7 Main Street, Inc., and any amendments thereto and any other 8 resolution or other official action of the Mayor and Common 9 council delegating such other duties, functions and 10 responsibilities as deemed appropriate by the Mayor and Common 11 Council. The Main Street Advisory Board shall exercise such 12 powers and functions as may be delegated from time-to-time 13 pursuant to resolution of said Corporation for the conducting of 14 specified business affairs of the Corporation. Said specified 15 business affairs may include the following: 16 The Main Street Advisory Board shall be responsible for 17 recommending operating policies and procedures to mitigate 18 traffic and parking within the Downtown area. Recommendations 19 may include an estimate of proposed expenditures required for 20 meeting costs of security, operation, maintenance, repair and 21 improvement of parking places. 22 The Main Street Advisory Board may provide information 23 and recommendation regarding, the orderly development of the 24 Downtown area; encouraging economic viability; encouraging the 25 proper mix of residential and commercial uses for properties; 26 generation of property tax revenues and sales tax revenues; and 27 eliminating the migration of businesses from the Downtown area. 28 / / / -2- Me-8S? 1 Accordingly, the Mayor and Common Council find that for 2 the purposes of persons who are members of the Main street 3 Advisory Board, the property owners, the businesses, occupations 4 and professions in the Downtown area are tantamount to and 5 constitute the public generally within the meaning of 6 section 87103 of the Government Code. 7 2.41. 030 Term 8 Appointed Main Street Advisory Board Members shall 9 serve until either the Council member or Mayor who nominated such 10 member or members cease to hold that position or until any such 11 member is replaced by action of the Mayor and Common Council, 12 whichever shall occur first all as further provided in 13 section 2.17.03." 14 III 15 III 16 III 17 III 18 III 19 III 20 III 21 III 22 III 23 III 24 III 25 III 26 III 27 III 28 III -3- MC-B57 1 AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 2. 41 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE MAIN STREET 2 ADVISORY BOARD OF SAN BERNARDINO DOWNTOWN MAIN STREET, INC. 3 I HEREBY CERTIFY that the foregoing ordinance was duly 4 adopted by the Mayor and Common Council of the city of 5 San Bernardino at a regular 6 thereof, held on the 21st meeting day of December 7 199~, by the following vote, to wit: 8 Council Members: AYES NAYS ABSTAIN ABSENT 9 ESTRADA 10 REILLY 11 HERNANDEZ 12 MAUDSLEY x x x x 13 MINOR x 14 POPE-LUDLAM x 15 MILLER 16 17 18 19 x ~l~ The foregoing ordinance is d3/.2.d day of /ht"-"-Hvh?r.Z , 19~3.. hereby this 20 21 22 -- ~ , Mayor Bernardino Approved as to form 23 and legal content: 24 JAMES F.
