AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER
8.68 TO THE SAN BERNARDINO MUNICIPAL CODE REQUIRING RETAILERS TO
KEEP CERTAIN AEROSOL CONTAINERS AND CERTAIN MARKER PENS
INACCESSIBLE TO THE PUBLIC
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
SECTION 1.
Chapter 8.68 is hereby added to the San
Bernardino Municipal Code to read as follows:
"8.68.010 Inaccessibility to Public
"Every person who owns, conducts,
operates or manages a retail
commercial establishment selling
aerosol containers, or marker
pens with tips exceeding four
millimeters in width, containing
anything other than a solution
which can be removed with water
after it dries, shall store or
cause such aerosol containers or
marker pens to be stored in an
area
viewable
not
by,
but
accessible to the public in the
regular
of
business
course
without
assistance,
employee
pending legal sale or disposition
of such marker pens or aerosol
containers.
