THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
4 ORDAIN AS FOLLOWS:
5 SECTION 1. Municipal Code Chapter 13.16 is hereby repealed in its entirety.
6 SECTION 2. Municipal Code 9 13.32.050(A)(22)(A) is amended to read as follows:
7 "A. 'Private dwelling unit' means single family residential, duplex residential and

triplex residential premises."
9 SECTION 3. Municipal Code 9 13.32.180 is amended to read as follows:
10 "1332.180 Charges -- Payment of base charges.
II "All premises which are served by a connection to the public sewer and/or wastewater
12 treatment facilities of the City, tlI' and all premises, exceptfor single flUtlily residences,
13 whiebare situated on real property adjoining an existing public sewer and not connected
14 thereto, shall be charged, and the user thereof shall pay base charges as described in this
15 section.

"A. Private dwelling units shall be charged a fixed monthly fee for
17 each individual dwelling unit. Such fee shall be established by resolution. The
18 fee shall be adequate to realize from the private residential users so charged an
19 amount sufficient to cover the share of costs of the sewerage facilities attributable
20 to this class of users. The costs shall include all costs of financing, maintaining
21 and operating the system and developing the necessary reserve funds to ensure
22 operation of the system.

"B.
Commercial residential units, nondomestic users, and all other users
24 except private dwelling units shall be charged on the basis of total water consumption for
25 the comparable water billing period. The rate for such charges shall be established
26 by resolution. The fees shall be adequate to realize from the class of users so
27 charged an amount sufficient to cover the share of costs of the sewerage facilities
28 attributable to this class of users. The costs shall include all costs of financing,

3 maintaining and operating the system and developing the necessary reserve funds to
4 ensure future operation of the system. Industrial premises discharging nondomestic
5 wastewater shall be billed on the basis of the amount of wastewater flow specified in the
6 permit or determined by actual flow measurement. It is recognized that the amount of
7 wastewater generated by a given premises is normally less than the water consumed by
8 that premises.

"C.
The charges provided for in this chapter are based on the
10 assumption that the percentage of wastewater produced from water consumed is
II approximately the same for all users included in a given billing category. Ifthe
12 Board determines that for a particular user or group of users the above assumption
13 is not correct and if the percentage of wastewater produced from water consumed
14 is significantly different from the percentage under the existing billing concept,
15 the Board may modify the existing billing concept to invoke an equitable charge
16 to the user. The rate for such amended charges shall be established by resolution.
17 To support such amended charges, the user may be required to install facilities as
18 set forth in Section 13.32.130 of this chapter.

"D. The board shall establish a rate of charges for a user when the user's
20 wastewater is derived, either in part or in full from a source other than the City's potable
21 water supply. A source of supply includes, but is not limited to, any material which is
22 transported onto the user's premises."
23 SECTION 4. Subsection (F) is added to Municipal Code S 13.32.220 as follows:

"P.
The charges established by and pursuant to this chapter shall not be
25 imposed where a building, structure, trailer or park space or other occupancy
26 specified iftby Resolution Ne. 11593 of the City is being newly constructed or
27 placed on vacant property and served by City water until such time as the
28 building, structure or park space is first occupied. Thereafter, charges shall be

3 imposed on a regular basis in accordance with the terms and conditions of this
4 chapter and resolutions adopted pursuant thereto and shall be placed on the billing
5 for water following the date of initial occupancy."
6 SECTION 5. Subsection (G) is added to Municipal Code S 13.32.220 as follows:

"G. The owner of any rental property shall promptly advise the City
8 Water Department of the date of the first occupancy of the premises."
9 I HEREBY CERTIFY that the foregoing ordinance was duly adopted by the Mayor and
10 Common Council of the City of San Bernardino at a regular meeting thereof, held on the 21 s
11 day of Auguf\1l.995, by the following vote, to wit:
