2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
15.16.060 OF THE SAN BERNARDINO MUNICIPAL CODE GRANTING POLICE
3 POWERS TO CERTAIN MEMBERS OF THE FIRE DEPARTMENT
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO DO ORDAIN AS FOLLOWS:

SECTION 1. Section 15 16.060 of the San Bernardino Municipal Code is amended to
read as follows:
"15.16.060 Police Powers
Section 103.2.1.2 of the Uniform Fire Code is amended to read as follows:
103.2.1.2. The Fire Chief, each member of an arson investigating
unit whose primary duty is the detection and apprehension of persons who
have violated any fire law or committed insurance fraud, and each member
of the Fire Department whose primary duty is the enforcement of laws
relating to fire prevention or fire suppression, are designated as peace

officers as defined in Section 830.37 of the Penal Code while performing

their duties under this code.
It is the duty of, and the following persons are hereby authorized
to enforce the provisions ofthis code and make arrests and issue citations
as authorized by law'
I Fire Chief, Deputy Chief, Fire Marshal, Battalion Chiefs, Full-
Time and Part-Time Fire Investigators, Fire Suppression Personnel and
Fire Prevention Officers.
2. Such other officers or employees of the City of San Bernardino
as may be recommended by the Fire Chief and approved by the Mayor and
Common Council.
When requested to do so by the Fire Chief, the Chief of Police is
authorized to assign such available police officers as necessary to assist
the fire department in enforcing the provisions of this code."
