AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
15.28.190 OF TITLE 15 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING
TO PLACARDS USED TO DENOTE CONDITIONS RELATING TO CONTINUED
OCCUPANCY OF BUILDINGS AFTER A DISASTER.
WHEREAS, the City of San Bernardino is located on and to the southeast of the
intersection of the San Andreas and San Jacinto earthquake faults, and
WHEREAS, said faults have the potential of rupturing and producing significant
earthquakes which may result in structural damage to buildings within the City, and
WHEREAS, the city is subject to other natural and manmade disasters including and not
limited to fire, flooding, wind storms, mud slides, subsidence, and civil unrest, and
WHEREAS, the California Emergency Services Act (Govt Code 8550 et seq) provides
the basic authorities to the City to conduct emergency operations in the event of a disaster, and
WHEREAS, in order to protect life and property in the event of disasters, the State of
California and the City of San Bernardino have developed Emergency Plans, and
WHEREAS, said Emergency Plans establish procedures for post-disaster safety
evaluations of buildings in order to identify damaged structures. Said procedures provide for
the posting of placards as a means of alerting building occupants and the public of the hazards
associated with the damaged buildings, and preventing further injury or death,
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS

Municipal Code to read as follows.
"15.28.190 Post-disaster Safety Assessment Placards
A. Intent
This section establishes standard placards to be used to indicate the condition of
a structure for continued occupancy after any natural or manmade disaster The
chapter further authorizes the Planning and Building Services Department, as well
as authorized representatives or designees of that department, to post the
appropriate placard at each entry point to a building or structure upon completion
of a safety assessment.
B. Application of Provisions
The provisions of this section are applicable, following each natural or manmade disaster,
to all buildings and structures of all occupancies regulated by the City

C. Defmitions
I Safety Assessment - A visual, non-destructive examination of a building 0
structure for the purpose of determining the condition for continued occupanc
following a natural or manmade disaster
D.
Placards
I The following are verbal descriptions of the official jurisdiction placard
to be used to designate the condition for continued occupancy of building
or structures. Copies of sample placards are attached.
(a)
INSPECTED - Lawful Occupancy Permitted is to be posted 0
any building or structure wherein no apparent structural hazard ha
been found. This placard is not intended to mean that there is n
damage to the building or structure.
(b)
RESTRICTED USE is to be posted on each building or structur
that has been damaged wherein the damage has resulted in som
form of restriction to the continued occupancy The evaluator wh
posts this placard will note in general terms the type of damag
encountered and will clearly and concisely note the restrictions 0
continued occupancy

(c) UNSAFE - Do Not Enter or Occupy is to be posted on eac
building or structure that has been damaged such that continu
occupancy poses a threat to life safety Buildings or structure
posted with this placard shall not be entered under an
circumstance except as authorized in writing by the department tha
posted the building. Safety assessment teams shall be authoriz
to enter these buildings at any time. This placard will note i
general terms the type of damage encountered.
Each placard shall include the ordinance number, the name of th
department, its address and phone number, and a statement regarding th
manner in which an appeal may be filed.

Once it has been attached to a building or structure, a placard shall not b
removed, altered, or covered until done so by an authorized representativ
of the department or upon written notification from the department.

4 Any person removing such placard without the express written consent 0
the City of San Bernardino Building Official is guilty of a misdemeanor
which upon conviction thereof is punishable in accordance with th
provisions of Section I 12.010 of the San Bernardino Municipal Code.
E.
Notification
The Building Official shall, as soon as practicable but no later than 30 days fro
the date of posting, mail a notice to the owner of each building posted a
Restricted Use or Unsafe. Such notice shall be mailed to the owner(s) of recor
of the property as ascertained from the latest assessment roll of the Count
Assessor The notice shall include the following information: (I) A statemen
indicating that the structure has suffered disaster related damage which constitute
a hazard to its occupants, the public, or adjacent property, (2) that the buildin
has been posted with placards in accordance with this section, (3) the restriction
placed on the use or occupancy of the building, (4) a brief description of th
damage, (5) that the damage must be repaired and the hazards eliminated prio
to re-occupancy, and (6) that an appeal may be filed in accordance with th
procedures contained in Chapter 15.28 of this code.
F.
Abatements
If a damaged structure becomes a public nuisance due to abandonment or th
failure to repair damage which poses a hazard to the occupants, the public, 0
adjacent property, the building official may initiate abatement proceedings i
accordance with Chapters 8.30 and 15.28 of this code.
