NOTICE IS HEREBY GIVEN that Council Members Jack
Reilly, Ralph Hernandez, Steve Marks, and Jack Strickler
have called a Special Meeting of the Common Council for
1:00 p.m., Thursday, July 10, 1986. Said Council meeting
will be held in the Redevelopment Agency Board Room, Third
Floor of Ci ty Hall, 300 North 'D I "Street, San Bernard i no,
California.
The purpose of the meeting is to discuss and/or ap-
prove a resolution to adopt an overlay zone imposing arch-
itectural development standards for the vicinity of 40th
Street and Sierra Way.

The Special Meeting of the Mayor and Common Council
of the City of San Bernardino was called to order by Mayor
Wilcox on Thursday, July 10, 1986, at 1:15 p.m., in the
Redevelopment Agency Board Room, Third Floor of City Hall,
300 North "D" Street, San Bernardino.
ROLL CALL
Roll Call was taken by Deputy City Clerk Martinez
with the following being present.; Mayor Wilcox; Council
Members Estrada, Reilly, Marks, Strickler; City Attorney
Prince, Deputy City Clerk Martinez; City Administrator
Schweitzer. Absent: Council Membe-rs Hernandez, Quiel,
Frazier.
OVERLAY ZONE IMPOSING ARCHITECTURAL DEVELOPMENT
STANDARDS FOR PROPERTY LOCATED IN THE VICINITY
OF 40TH AND SIERRA WAY
Mayor Wilcox stated that the purpose of the meeting
is to consider adopting a resolution regarding an overlay
zone for the property in the vicinity of the northwest
corner of Fortieth Street and Sierra Way.
For the past year, Council Members have been working
with Paul Max and Associates and Sierra Gateway to bring
economic vitality back to the old Market Basket Center.
Sierra Gateway is prepared to spend approximately
$6,000,000 to refurbish the shopping center which has been
in decline over the past few years because of the loss of
Market Basket and other economic dislocations in the area.
The investment, in behalf of Sierra Gateway and the neigh-
borhood in the community, is contingent upon the acquisi-
tion of a major tenant (Lucky Market). In order to ac-
complish this, an arrangement has been worked out whereby
the shopping center area to be refurbished would come
under enhanced architectural development standards.
Discussion was held concerning adopting the resolu-
tion enacting the architectural development standards
rather than showing the intent and making changes
to that affect in the resolution.
City Attorney Prince answered questions and recom-
mended that the second line of the title of the resolution
read: "...San Bernardino adopting and implementing after

appropriate notice and hearing an overlay zone", and Sec-
tion One, lines 16-18, Page One: "...The Mayor and Conunon
Council adopts and shall implement after appropriate
notice and hearing an overlay zone", and Page Five, line
3: "...feet of the building designated as Building E~ F,
and G on Exhibit B".
A question arose whether the Council could adopt and
implement the overlay zone and if in the future some
ordinances needed to be modified, could this be done as
a separate motion.
A discussion ensued in that in order to make it clear
the Council is behind this project and standards, the
resolution should reflect that the Mayor and Council are
adopting and directing the implementation of an overlay
zone.
City Attorney Prince recommended that Council ini-
tiate the overlay zone by motion.
A lengthy discussion was held concerning the notice
of hearing.
Council Member Marks asked the City Attorney if the
Mayor and Council has the legal right to go ahead and
adopt an overlay zone.

City Attorney Prince read the title of the resolution
with the following changes on line two: "...San Bernar-
dino adopting an overlay zone plan imposing architectural
development standards for the vicinity of Fortieth Street
and Sierra Way", and Section One, lines 16-18: .... .The
Mayor and Common Council adopts an overlay zone plan
imposing architectural development standards for the
vicinity of Fortieth Street and Sierra Way, etc.....
Council Member Marks made a motion, seconded by
Council Member Strickler and unanimously carried, that
further reading of the resolution be waived and said reso-
lution be adopted.
Resolution No. 86-285 was adopted by the following
vote: Ayes: Council Members Estrada, Reilly, Marks,
Strickler. Noes: None. Absent: Council Members
Hernandez, Quiel, Frazier.
Council Member Marks made a motion, seconded by Council
Member Strickler and unanimously carried, to direct the
planning Staff to initiate an overlay zone ordinance.
ADJOURNMENT
AT 2:45 p.m., Council Member Estrada made a motion,
seconded by Council Member Reilly and unanimously carried,
that the meeting be adjourned to 9:00 a.m., Monday, July
21, 1986, in the Council Chambers of City Hall, 300 North
"0" Street, San Bernardino, California.
