The City Clerk has caused to be posted the Order of Adjournment of said Meeting held on Monday, April 21, 1986, at 9:30 a.m., in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Wilcox at 10:00 a.m., Monday, April 28, 1986, in the Redevelopment Agency Conference Room of City Hall, 300 North "D" Street, San Bernardino, California. COMMUNITY DEVELOPMENT COMMISSION/REDEVELOPMENT AGENCY - ADJOURNED REGULAR MEETING The Adjourned Regular Meeting of the Communi ty Development Commission/Redevelopment Agency was called to order by Chairman Wilcox in the Redevelopment Agency Con- ference Room of City Hall, 300 North "D" Street, San Ber- nardino, California. ROLL CALL Roll Call was taken by the City Clerk with the fol- lowing being present: Chairman Wilcox; Council Members Estrada, Hernandez, Marks, Frazier; City Attorney Prince, City Clerk Clark, Deputy City Administrator Schweitzer. Absent: Council Members Reilly, Quiel, Strickler; Re- development Counsel Briggs. REVIEW OF STATE LAW REGARDING TWENTY-PERCENT (20%) SET ASIDE - TIMOTHY SABO, BOND COUNSEL Tim Sabo, Bond Counsel, gave a review of State law regarding the twenty-percent (20%) set aside of tax increment revenues. COUNCIL MEMBERS QUIEL AND STRICKLER, AND REDEVELOPMENT COUNSEL BRIGGS ARRIVED At 10:10 a.m., Council Members Quiel and Strickler, and Redevelopment Counsel Briggs arrived at the meeting. Tim Sabo, Bond Counsel, provided information regar- ding Post 1977 projects, Health and Safety Code Section 33334.2, concerning findings to reduce or eliminate the twenty-percent (20%) set aside, the establishment of a low and moderate Income Housing Fund, calculation of the twenty-percent (20%) set aside figure based upon what gross figure, and the use of the twenty-percent (20%) set aside; i.e., type of projects and uses to satisfy require- ments. He also spoke concerning Pre 1977 projects (A.B. 265), regarding indebtedness incurred prior to January 1, 1986, a statement of existing projects, programs and activities, a statement of existing indebtedness, notice of public hearing prior to September 1, 1986, the effect on the twenty-percent (20%) set aside and existing obli- gations and projects, programs and activities for ten (10) years and the fact that the set aside requirement com- mences in the 1985/86 fiscal year. Pre 1977 Projects (A.B. 690) were also reported by Tim Sabo, Bond Counsel, concerning limitations to be amended into pre - October 1, 1976, redevelopment plans to add financing limitations, Meadowbrook - Central City special merger legislation, the twenty-percent (20%) set aside requirement and a legislative history of both items of merger legislation. CHAIRMAN WILCOX AND CITY CLERK CLARK EXCUSED Chairman Wilcox and City Clerk Clark left the meeting. Council Member Strickler conducted the meeting as Vice Chairman. DEPUTY CITY CLERK SOUTH ARRIVED Deputy City Clerk South arrived at the meeting. DEFINITION OF CALCULATIONS OF HOUSING NEEDS - DR. JOSEPH JANCYZK-EVANS, HOUSING FEASIBILITY CONSULTANT Dr. Jancyzk-Evans, Housing Feasibility Consultant, provided a summary of households in need, and reported concerning the socio-economic characteristics of the households in need, San Bernardino City housing needs - 1980, San Bernardino City's housing supply, San Bernardino City housing needs - 1985, characteristics of households in need, conclusions and "fair share" consideration. Ken Henderson, Manager of the Community Development Division of the Redevelopment Agency, introduced a letter from the State Department of Housing & Community Develop- ment, Legal Services Department, regarding the use of funds for administrative expenses. He stated that he did not believe the funds could be used for administrative expenses. Tim Sabo, Redevelopment Bond Counsel, read Section 33334.D of the Health and Safety Code and answered ques- tions regarding restricted use of the twenty-percent (20%) set aside. Dr. Joseph Jancyzk-Evans, Housing Feasibility Con- sultant, answered questions regarding the model or type of person the City should be attempting to attract with this program. Discussion was held regarding existing, outstanding loan and grant accounts for rehabilitation money. Glenda Saul, Director of the Redevelopment Agency, spoke regarding the need for aggressive marketing and staff requirements in order to have a $1,000,000 rehabili- tation program. Discussion was held concerning direction to staff to give a firm recommendation of needs concerning the factors identified in the meeting, a program scenario, and then give a projection of what percentage will be needed, uti- lizing the definition of need as that set by the Census Bureau, which is 30% of the income to be set aside for housing. TRANSPORTATION COMMITTEE MEETING REPORT - CHAIRMAN MARKS Council Member Marks, Chairman of the Transportation Committee, stated that the Transportation Committee has been meeting regarding the proposed Transit Terminal and parking structure, interfacing with Glenda Saul and the Chamber of Commerce. 2 4/28/86 SALE OF PROPERTY - COURT STREET AND "E" STREETS Staff was requested to put the sale of the property on Court Street on temporary hold while the City works on a development scenario for Board review and then to re- quest proposals. Discussion was held regarding whether or not to post a sign on the property identifying it as available by the Redevelopment Agency, and allowing developers to then make a development proposal or to have the Redevelopment Agency look at some definite objectives for the property before it is marketed. Glenda Saul, Director of the Redevelopment Agency, stated that some definite objectives for the Court Street property could be presented in two weeks at the Council Meeting. Discussion was held regarding putting the question of handling of the Court Street property on the Council's May 5, 1986, Agenda to see what the full Council would like to do. Council Member Marks stated that a full Council would be present at this meeting at 1:00 p.m. REVIEW OF OTHER TWENTY-PERCENT (20%) SET ASIDE PROGRAMS - JOHN R. TRAUTH, HOUSING CONSULTANT John R. Trauth, Housing Consultant, provided examples of the twenty-percent (20%) set aside program in a mobile home park in Chula Vista, deferred loans in San Jose, infill housing construction in Santa Ana, payment of developer fees in Corona, demolition and site preparation costs in Ontario and loans to developers in Sacramento. RECESS MEET I NG At 12: 13 p.m., the meeting recessed until 1:00 p.m. in the Redevelopment Agency Conference Room, City Hall, 300 North "D" Street, San Bernardino, California. RECONVENE MEETING At 1:05 p.m., the Adjourned Regular Meeting of the Redevelopment Agency reconvened in the Redevelopment Agency Conference Room, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken with the following being present: Chairman Wilcox, Council Members Estrada, Hernandez, Marks, Quiel, Frazier, Strickler; City Attorney prince, Redevelopment Counsel Briggs, City Clerk Clark, Deputy City Administrator Schweitzer. Absent: Council Member Reilly. RECESS MEETING - CLOSED SESSION At 1:05 p.m., the Council decided to recess under authority of Government Code Section 54956.9(a), to confer with its attorney regarding pending litigation which has been initiated formally and to which the City is a party. CLOSED SESSION At 1:05 p.m., Chairman Wilcox called the Closed Ses- sion to order in the Redevelopment Agency Conference Room, City Hall, 300 North "D" Street, San Bernardino, Cali- fornia to discuss pending litigation concerning the City of San Bernardino vs. San Manuel Band of Mission Indians. 3 4/28/86 ROLL CALL Roll Call was taken with the following being present: Chairman Wilcox; Council Members Estrada, Hernandez, Marks, Quiel, Frazier, Strickler; City Attorney prince, Redevelopment Counsel Briggs, City Clerk Clark, Deputy City Administrator Schweitzer. RECONVENE MEETING At 1:30 p.m., the Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino reconvened in the Redevelopment Agency Board Room, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken by the City Clerk with the fol- lowing being present: Mayor Wilcox; Council Members Estrada, Hernandez, Marks, Quiel, Frazier, Strickler; City Attorney prince, Redevelopment Counsel Briggs, City Clerk Clark, Deputy City Administrator Schweitzer.
