The joint regular meeting of the Mayor and Common Council and Community
Development Commission of the City of San Bernardino was called to order by
Mayor/Chairman Valles at 1:30 p.m., Monday, October 18, 2004, in the Council
Chambers of City Hall, 300 North "D" Street, San Bernardino, California.

Closed Session Announcement
Assistant to the City Clerk Medina announced that during closed session the
following action was taken regarding the case of Manta Management
Corporation v. City of San Bernardino: Council Member/Commissioner
McCammack made a motion, seconded by Council Member/Commissioner
Longville, that the City file an appeal with the Fourth District Courts, with an
initial cap of $50,000 on attorney fees.
The motion carried by the following vote: Ayes: Council Members/
Commissioners Estrada, Longville, McGinnis, Kelley, Johnson, McCammack.
Nays: None. Absent: Council Member/Commissioner Derry.

Reading of Resolutions & Ordinances
Deputy City Clerk Hartzel read into the record the titles of all the resolutions and
ordinances on the regular agenda of the Mayor and Common Council/Community
Development Commission.
Invocation/Pledge of Allegiance
The invocation was given by Father Patricio Guillen of Librera del Pueblo, followed by
the pledge of allegiance, led by Marie Colella, a 12" grade student at Anderson School.
Moment of Silence
Mayor/Chairman Valles offered condolences to the family and requested a moment of
silence in memory of Roger Hardgrave, a longtime City employee who served the City
for 36 years, retiring from his position as Director of Public Works in December 1997.
2. Appointments
There were no Commission appointments.
3. Proclamations & Presentations
Mayor Valles presented a proclamation designating the month of October 2004
as Toastmasters Month in the City of San Bernardino to Michael Zlaket,
President of Nooners Toastmasters.
Deron Marquez, Chairman of the San Manuel Band of Mission Indians,
presented a check in the amount of $5,500,000 to Mayor Valles to finance
public improvement projects related to Tribal Project Impacts.
Council Member/Commissioner Longville presented a plaque to Dennis Baxter
of the Perris Hill Neighborhood Association and certificates of recognition to
other members of the organization, in recognition of their efforts to make the
Farmers Market a viable and successful venture.
Dawkins Hodges, Funding Chairman, and Christine Pritchard, Executive
Director, Rebuild San Bernardino County, the official long-term organization
formed to solve the homelessness caused by the 2003 California wildfires and
mudflows, made a PowerPoint presentation regarding the rebuilding taking
place in San Bernardino County and explained the role of their organization in
helping those individuals who would otherwise "fall through the cracks."
June Dint, Public Information Officer, Mayor's Office, read the names of the
following individuals who were presented a service pin award by Mayor/
Chairman Valles in recognition of their many years of dedicated service to the
City:

Waive Full Reading of Resolutions & Ordinances
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that full reading of the resolutions and
ordinances on the regular agenda of the Mayor and Common Council,
Community Development Commission, be waived.

7. Claims & Payroll
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the claims and payroll and the
authorization to issue warrants as listed on the memorandum dated October 12,
2004, from Barbara Pachon, Director of Finance, be approved.

8. Personnel Actions
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the personnel actions as submitted by the
Chief Examiner dated October 12, 2004, in accordance with Civil Service rules
and Personnel policies adopted by the Mayor and Common Council of the City
of San Bernardino, be approved and ratified.

9. ORD. MC-1189 - An ordinance of the City of San Bernardino amending
Sections 5.04.495 and 5.04.496, and adding Section 5.04.499 of the San
Bernardino Municipal Code regarding Transient Vendors. FINAL

Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that said ordinance be adopted.

10. RES. 2004-326 - Resolution of the Mayor and Common Council of the City

11. Review and take action regarding the need for continuing in effect the local

Member/Commissioner Johnson, that the Mayor and Common Council confirm
the need for continuing in effect the local emergency caused by the Old
Waterman Canyon Fire.

12. RES. 2004-327 - Resolution of the City of San Bernardino amending
Resolution No. 3985 entitled, in part, "A Resolution ... prohibiting parking
upon certain designated streets, alleys, or portions thereof..." to establish a
No Parking Any Time zone on the south side of Court Street between Allen
Street and 300 feet west of Allen Street.
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that said resolution be adopted.
Resolution No. 2004-327 was adopted by the following vote: Ayes: Council
Members/Commissioners Estrada, Longville, McGinnis, Kelley, Johnson,

13. Reject all bids for construction of ADA access ramps and sidewalk at
various locations - Phase VI - 2003/04 (SSO4-07) - Plan No. 10992A &
direct staff to revise the project and re -advertise
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the Mayor and Common Council reject all
bids for the construction of ADA access ramps and sidewalk at various
locations, Phase VI - 2003/04 (SSO4-07), per Plan No. 10992A, and direct staff
to revise the project and re -advertise.

14. Authorize Director of Development Services to execute Contract Change
Order No. One - contract with Nikola Corporation - sewer improvements
on Baseline Street (SW04-04); "I" Street (SW04-30); Wilson Street and 35'
Street (SW04-31) - Plan No. 10890
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the Mayor and Common Council
authorize the Director of Development Services to execute Contract Change
Order No. One in the amount of $92,752 to contract with Nikola Corporation
for sewer improvements on Baseline Street (SW04-04); "I" Street (SW04-30);
Wilson Street and 35' Street (SW04-31), per Plan No. 10890; and authorize the
Director of Finance to amend the FY 2004/05 budget by transferring $26,500
from Account No. 245-365-5504-7317 (SW04-04) to Account No. 245-365-
5504-7427 (SW04-30) and $24,600 from Account No. 245-365-5504-7317
(SW04-04) to Account No. 245-365-5504-7428 (SW04-31).
The motion carried by the following vote: Ayes: Council Members/
Commissioners Estrada, Longville, McGinnis, Kelley, Johnson, McCammack.

15. RES. 2004-328 - Resolution of the Mayor and Common Council of the City
of San Bernardino adopting a Standard Agreement to be used for gaining
the permission of parcel owners to enter their property for the purposes of
conducting prescribed and/or structural training burns.
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that said resolution be adopted.
Resolution No. 2004-328 was adopted by the following vote: Ayes: Council
Members/Commissioners Estrada, Longville, McGinnis, Kelley, Johnson,

16. RES. 2004-329 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the Purchasing Manager to issue an annual
purchase order to Galls/Inland Uniforms in the amount of $60,000 for
replacement of Class "B" uniforms.
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that said resolution be adopted.

Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the Mayor and Common Council
authorize the rejection of all bids received in response to Bid No. F-05-019 for
picnic shelters and gazebo; and authorize the Purchasing Manager to re -
advertise for bids.

Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the Mayor and Common Council set a
public hearing for 4:00 p.m. on Monday, November 1, 2004, relative to the
proposed expenditure plan for the awarded Local Law Enforcement Block Grant
(LLEBG) funding for Fiscal Year 2004/05.
The motion carried by the following vote: Ayes: Council Members/
Commissioners Estrada, Longville, McGinnis, Kelley, Johnson, McCammack.
Nays: None. Absent: Council Member/Commissioner Derry.
19. Set public hearing - 4 p.m., Monday, November 1, 2004 - proposed
expenditures of monies allocated from the FY 2004/05 Citizen's Option for
Public Safety (COPS)
Council Member/Commissioner Longville made a motion, seconded by Council
Member/Commissioner Johnson, that the Mayor and Common Council set a
public hearing for 4:00 p.m. on Monday, November 1, 2004, relative to the
proposed expenditure plan for the awarded Citizen's Option for Public Safety
(COPS) funding for Fiscal Year 2004/05.
The motion carried by the following vote: Ayes: Council Members/
Commissioners Estrada, Longville, McGinnis, Kelley, Johnson, McCammack.

of San Bernardino establishing a Disadvantaged Business Enterprise (DBE)
Program and DBE Goals for Federal Financial Assistance Projects.

Council Member/Commissioner Estrada, that said resolution be adopted.

21. RES. 2004-333 - Resolution of the Mayor and Common Council of the City
of San Bernardino authorizing the City of San Bernardino Fire Department
to enter into a billing services agreement with Advanced Data Processing,
Inc. (ADPI) for first responder, paramedic, and membership program fees.

City Attorney Penman advised that on page 8 of the agreement, paragraph 21
had been added, stating, "Any other language in this Agreement
notwithstanding, if the patient/payer is a resident of the City of San Bernardino
and does not have insurance coverage, CONTRACTOR shall not seek payment
from the patient/payer after the initial billing. Likewise, if patient/payer is a
resident of the City of San Bernardino and has Medicare or Medicaid coverage,
CONTRACTOR shall not seek payment from the patient/payer after the initial
billing. "
Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner McCammack, that said resolution be adopted.

22. Resolution of the Mayor and Common Council of the City of San
Bernardino approving the San Bernardino City Professional Firefighters
Welfare Benefit Plan authorizing payroll deductions by the City of San
Bernardino for participating members. (Continued from September 20,
2004)

City Attorney Penman advised that staff had sent a letter to the firefighters'
attorney suggesting additional language; and once staff has received a response
from the attorney stating that the additional language is approved, they will then
request an IRS opinion letter to make sure that the City will be on safe grounds
collecting this payroll deduction for the firefighters. He stated that it will
probably be several months before this item is ready and suggested a 60-90 day
continuance.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Kelley, that the matter be continued 90 days, to
the second regular Council/Commission meeting in January 2005.

23. Ordinances relative to inactive Boards and Commissions
Ordinance of the City of San Bernardino repealing Chapters 2.47 (Central
City Advisory Board), 2.44 (Cemetery Commission), 2.41 (Main Street
Advisory Board), 2.27 (Commission for Disabled Persons), and 2.24
(Central City Parking Place Commission) of the San Bernardino Municipal
Code, and amending Section 2.42.020 of the San Bernardino Municipal
Code by adding Paragraph "I" relating to meetings of the Community
Television Commission. (Continued from October 4, 2004) (23A)
Ordinance of the City of San Bernardino repealing Chapters 2.47 (Central
City Advisory Board), 2.44 (Cemetery Commission), 2.41 (Main Street
Advisory Board), and 2.27 (Commission for Disabled Persons) of the San
Bernardino Municipal Code, and amending Section 2.42.020 of the San
Bernardino Municipal Code by adding Paragraph "I" relating to meetings
of the Community Television Commission. FIRST READING (23B)
It was noted that the only change in the second ordinance was that the Central
City Parking Place Commission would continue to exist due to some upcoming
issues regarding downtown parking.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Longville, that said ordinance 23A be tabled.

Commercial General, to RS, Residential Suburban, for seven parcels
located on the north side of King Street, between the alley that is east of
Mt. Vernon Avenue and Giovanola Avenue, south of 2"" Street.

Council Member/Commissioner McGinnis made a motion, seconded by Council
Member/Commissioner Estrada, that the hearing be closed; and that said
resolution be adopted.
The motion carried and Resolution No. 2004-334 was adopted by the following
vote: Ayes: Council Members/Commissioners Estrada, Longville, McGinnis,
Kelley, Johnson, McCammack. Nays: None. Absent: Council Member/
Commissioner Derry.
29. Public Comments
Frank Stallworth of Senator Nell Soto's office requested that the Mayor and
Council consider adopting a local resolution opposing Proposition 68 and read a
sample resolution of opposition covering all pertinent information into the
record.
Mayor Valles noted that it could not be considered this date because it had not
been agendized, but noted that Mr. Stallworth's position would be listened to by
many constituents.
James Penman, 221 East Marshall Boulevard, San Bernardino, CA, speaking
from the public podium, urged a "Yes" vote on local Measure "G"—a measure
that would change the City Charter to include hiring a City Manager to manage
the day-to-day operations of the City.
Sam Locke, urged people to attend the Community Summit at the Radisson
Hotel and Convention Center on Saturday, October 30, from 8 a.m. to 2 p.m.
Tracylyn Sharrit, 3238 Roberds Avenue, San Bernardino, CA, spoke
regarding the activities of the Neighborhood Cluster Association Youth Group,
their plans to "adopt" children from the Loma Linda Children's Hospital during
the holidays, and the need for community help and support for this project.
Susana Atanasova, representing the DMV Neighborhood Cluster Association,
spoke regarding the proposed plans of the Board of Education to raze the Smart
and Final Plaza and construct a new and separate school immediately adjacent to
Lincoln School and the devastating effect this action would have on local
residents.
