MAYOR AND COMMON COUNCIL
OF THE CITY OF SAN BERNARDINO
SPECIAL MEETING
9:00 A.M. - THURSDAY, NOVEMBER 7, 1991
COUNCIL CHAMBERS
NOTICE IS HEREBY GIVEN that the Mayor and Common Council of
the City of San Bernardino has called a Special Meeting of the
Mayor and Common Council for 9:00 a.m., Thursday, November 7,
1991, in the Council Chambers of City Hall, 300 North "D" Street,
San Bernardino, California.
The purpose for which this meeting has been called is to
waive and adopt the following resolution:
Resolution of the Mayor and Common Council of the City
of San Bernardino supporting the taking into trust by
the Federal Government of certain property for the
benefit of the San Manuel Band of Mission Indians.
The Special Meeting of the Mayor and Common Council of the
City of San Bernardino was called to order by Mayor Holcomb at
9:05 a.m., Thursday, November 7, 1991, in the Council Chambers of
City Hall, 300 North "D" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Krasney with the following
being present: Mayor Holcomb; Council Members Estrada, Reilly,
Hernandez, Maudsley; City Attorney Penman, City Clerk Krasney,
City Administrator Clark. Absent: Council Members Minor, Pope-
Ludlam, Miller.
INVOCATION
The invocation was given by Phil Arvizo, Executive Assistant
to the Council.
PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Council Member Maudsley.
RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO SUPPORTING THE TAKING INTO TRUST BY
THE FEDERAL GOVERNMENT OF CERTAIN PROPERTY FOR THE
BENEFIT OF THE SAN MANUEL BAND OF MISSION INDIANS.

Discussion ensued regarding the San Manuel Band of Mission
Indians' request to acquire property to expand its gambling
facilities to a new site described as the Club Development on
Waterman Avenue in the City of San Bernardino.

The Council expressed concern regarding environmental issues
affecting the proposed expansion of the current facility and the
potential operation of off-track betting at the proposed new
site.
The Council discussed the potential for competition between
the San Manuel Band of Mission Indians and the National Orange
Show if the off-track betting operation was allowed. It was
pointed out that the City could possibly realize a reduction in
sales tax revenues generated by this activity.
A discussion was held regarding the City allowing another
gambling facility within its jurisdiction. It was pointed out
that the City has no authority over the operation of the current
Bingo parlor as it is located on the Indian Reservation.
City Attorney Penman discussed some of the legal issues
which would have to be resolved before the San Manuel Band of
Mission Indians would be allowed to expand its facilities.
Mayor Holcomb proposed that the Economic Development Agency
be authorized to acquire the services of Cal State University for
the preparation of an environmental and cost benefit analysis
study of the positive and negative impact this project would have
on the community.

Ken Ramirez, representing the San Manuel Band of Mission
Indians, responded to allegations of potential criminal activity
occurring at the proposed new site. Mr. Ramirez stressed that
in the event the City allows the expansion to the proposed new
site, every attempt would be made to maintain their integrity and
good faith with the City.
City Attorney Penman presented a copy of the agreement
between the City and the San Manuel Band of Mission Indians which
was signed in 1986. He pointed out that although the Indians did
not have to pay the City any money for the operation of the Bingo
Parlor, they chose to do so anyway. City Attorney Penman
presented a check in the amount of $150,000.00 from the San
Manuel Band of Mission Indians to the City. The check was
accepted by City Administrator Shauna Clark on behalf of the
City.

City Attorney Penman answered questions regarding exceptions
to the law which passed in 1988 prohibiting the acquisition of
land for gaming purposes. He stated that the Secretary of
Interior and the City of San Bernardino would have to make
certain findings declaring that the proposed gaming project would
not have an adverse effect on the City.
Council Member Maudsley made a motion, seconded by Council
Member Reilly, that the Economic Development Agency be
authorized to acquire the services of Cal State University for
the preparation of an environmental, cost benefit analysis and
social impact study on the positive and negative effects of
gambling in the community; and that said resolution be continued
to November 18, 1991, in the Council Chambers of City Hall, 300
North "D" Street, San Bernardino, California.

ANNOUNCEMENT- ROMANIAN VISITORS
Mayor Holcomb introduced guests from Bucharest, Romania who
are here studying the United States Constitution and form of
government: Ivan Constantine Virgil, Assistant Chief Prosecutor;
Major Oancea Gheorghe, Military Senior Prosecutor. Attorney
Florentino Garza accompanied the Romanian guests.

At 10:06 a.m., Council Member Estrada made a motion,
seconded by Council Member Reilly, and unanimously carried, that
the meeting be adjourned to 8:30 a.m., Monday, November 18, 1991,
in the Council Chambers of City Hall, 300 North "D" Street, San
Bernardino, California.
