ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller; City Attorney Penman; city Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Pope-LUdlam. Also scroggin, Office. present: Deputy city Administrative Operations Attorney Simmons, Margaret Supervisor, City Attorney's READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Cordova read the titles of all the resolutions and ordinances on the regular, supplemental and Community Development Commission agendas while the Council was in closed session. COUNCIL MEMBER At 8:07 a.m., closed session. Absent: None. INVOCATION The invocation was given by Phil Arvizo, Executive Assistant to the Council. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Oberhelman. ANNOUNCEMENT - COUNCIL MEMBER CURLIN (2) Council Member Curlin extended Christmas greetings, wished everyone a Happy New Year and explained his position relative to the proposed Council salary increase. ANNOUNCEMENT - COUNCIL MEMBER HERNANDEZ (2A) Council Member Hernandez stated that because sufficient notice could not be given to conduct the Personnel Committee meeting, an informal meeting was held to approve the six paramedic positions which were continued from the Mayor and Council meeting of December 6, 1993. He stated that he would be giving the tape of the informal meeting to Mayor Minor, and explained his position on the proposal for a city operated emergency-medical transport service. ANNOUNCEMENT - COUNCIL MEMBER OBERHELMAN (2B) Council Member Oberhelman commended the San Bernardino Police Officers Association for its role in sponsoring Cops for Kids held on Sunday, December 12, 1993, at the Radisson Hotel. ANNOUNCEMENT - COUNCIL MEMBER DEVLIN (2C) Council Member Devlin expressed his appreciation to the San Bernardino Police Officers Association for its role in sponsoring cops for Kids held on Sunday, December 12, 1993, at the Radisson Hotel. PUBLIC COMMENTS - ROGER DUMAS (3) Roger Dumas, 498 West Court Street, stated his intent to generate an initiative of a new world government. San Bernardino, CA, for the establishment PUBLIC COMMENTS - GARY KIRBY 4 (3A) 12/20/93 Gary Kirby, 1505 Yardley, San Bernardino, CA, requested that a description of the item be given when a public hearing is held, that the agenda be posted in a glass container, and for health reasons, that the public be allowed to have refreshments within the Council Chambers. PUBLIC COMMENTS - JEFF WRIGHT (3B) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to the withholding of the tape of the informal meeting held to discuss the hiring of six paramedic firefighters. PUBLIC COMMENTS - JERRY ESPARZA (3C) Jerry Esparza, First Ward Fire Commissioner, 7842 Golondrina Drive, San Bernardino, CA, requested that copies of all complaints regarding courtesy Ambulance be forwarded to him for review. APPOINTMENT - ARMANDO J. GONZALES - HUMAN RELATIONS COMMISSION - COUNCIL MEMBER HERNANDEZ (S-5) In a memorandum dated December 16, 1993, Mayor Minor recommended that Armando J. Gonzales, 956 W. Congress Street, San Bernardino, CA, be appointed to the Human Relations Commission, as requested by Council Member Hernandez. Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the recommendation to appoint Armando J. Gonzales to the Human Relations Commission per Council Member Hernandez' request, be approved. SERVICE PIN AWARD CEREMONY (4) J. Lorraine Velarde, Executive Assistant to the Mayor, read the names of each employee receiving service pin awards. Each employee received a service pin from Mayor Minor in gratitude of his/her many years of dedicated service to the city. COUNCIL MEMBER CURLIN EXCUSED At 10:01 a.m., Council Member Curlin left the Council meeting. COUNCIL MINUTES (6) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the minutes of the following meetings of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: November 1, 1993; November 15, 1993. 5 12/20/93 REPLACE INTRUSION ALARM DELMANN CENTER - SIXTH WARD PARK EXTENSION FUNDS - $886 HEIGHTS COMMUNITY FUND - APPROVAL OF (8) In a memorandum dated December 3, 1993, Annie Ramos, Director of Parks, Recreation & Community Services, requested funding to replace the intrusion alarm which is not operating properly at the Delmann Heights Community Center. Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that $886 from the sixth Ward Park Extension Fund for the replacement of the intrusion alarm at Delmann Heights Community center, be approved. CHANGE ORDER #1 - MATICH CORPORATION - ADDITIONAL 3' ROCK ASPHALT GRINDINGS & GEOGRID SUBGRADE STABILIZATION BETWEEN CLUSTER AVENUE & VALLEY STREET- REHABILITATION OF PAVEMENT - ARROWHEAD AVENUE - MILL STREET TO THIRD STREET - $15,500 INCREASE (11) In a memorandum dated December 9, 1993, Roger Hardgrave, Director of Public Works/City Engineer, stated that the underlying soil was found to be unsuitable as a subgrade for placement of the new asphalt concrete. Normal practice would be to remove the unsuitable material and impact backfill soil which meets the specifications. However, due to the shallowness of the utilities, this method was not practical. Therefore, staff requested that the Soils Engineer provide a recommendation to stabilize the unsuitable material. The Soils Engineer recommended that three-inch rock be spread over the unsuitable material and that the material be compacted with a steel-wheel vibratory roller. Asphalt chippings would then be applied to a depth of three inches and a geogrid fabric would be placed over the chippings. To avoid extensive delay claims by the Contractor, the contractor was directed to proceed with the extra work involved in stabilizing the unsuitable material. Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that change Order No. One to the contract with Matich Corporation for rehabilitation of Arrowhead Avenue, from Mill Street to Third Street, be approved; and authorize the contractor to place three-inch rock additional asphalt grindings and geogrid, as recommended by the Soils Engineer, to stabilize the subgrade between Cluster Avenue and Valley Street, at an estimated increase to the contract price of $15,500; from $626,413 to $641,913. RES. 93-455 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE FIRE CHIEF TO EXECUTE A CONTRACT WITH AM GENERAL CORPORATION FOR THE PURPOSE OF EVALUATING A FIREFIGHTING VEHICLE. (12) 6 12/20/93 council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said resolution be adopted. Resolution No. 93-455 was adopted by the fOllowing vote: Ayes: Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: Council Member Curlin. CLAIMS AND PAYROLL (13) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the claims and payroll and authorization to issue warrants as listed on the memorandum dated December 6, 1993, from the Director of Finance, be approved. RES. 93-456 - RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING COSTS OF ABATEMENTS AND IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF THE ABATEMENT OF PUBLIC NUISANCES (BUILDING ABATEMENTS). (16) ~_.. Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said resolution be adopted; and that the following addresses be deleted from Exhibit "A" of said resolution: 1742 W. 28th Street and 1745 Lugo Avenue. The motion carried and Resolution No. 93-456 was adopted by the following vote: Ayes: Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: Council Member Curlin. RES. 93-457 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE SUBMISSION OF AN APPLICATION TO THE OFFICE OF EMERGENCY SERVICES FOR THE PURPOSE OF OBTAINING CERTAIN FEDERAL FINANCIAL ASSISTANCE IN CONJUNCTION WITH THE DECLARED STATE OF EMERGENCY ISSUED FOR THE COUNTY OF SAN BERNARDINO AS A RESULT OF FIRE STORMS IN OCTOBER AND NOVEMBER, 1993. (18) RES. 93-458 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING AND DIRECTING THE EXECUTION OF TWO AGREEMENTS BETWEEN THE HEADSTART/STATE PRESCHOOL DEPARTMENT OF HUMAN RESOURCES AGENCY FOR SAN BERNARDINO COUNTY AND THE PARKS, RECREATION AND COMMUNITY SERVICES DEPARTMENT OF THE CITY OF SAN BERNARDINO RELATING TO THE HEADSTART PROGRAM AT THE DELMANN HEIGHTS COMMUNITY CENTER AND REPEALING RESOLUTION. NO. 93-404. (19) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said resolutions be adopted. 7 12/20/93 Resolution Nos. 93-457 and 93-458 were adopted by the following vote: Ayes: Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: Council Member Curlin. WAIVE FURTHER READING OF RESOLUTIONS & ORDINANCES (5) COUNCIL MEMBER POPE-LUDLAM EXCUSED At 10:02 a.m., Council Member Pope-Ludlam left the Council meeting. Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to waiving the reading of the resolutions and ordinances, and requested that item numbers be placed on the voting board. Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that further reading of all resolutions and ordinances on the regular, supplemental and Community Development Commission agendas, be waived. COUNCIL MEMBER CURLIN RETURNED At 10:03 a.m., Council Member Curlin returned to the Council meeting and took his place at the council table. INITIATE - DEVELOPMENT CODE AMENDMENT - TIME EXTENSION - CONDITIONAL USE PERMITS, DEVELOPMENT PERMITS & VARIANCES (7) In a memorandum dated December 8, 1993, Mayor Minor stated that on September 13, 1993, the Governor of California approved Senate Bill 428 which extends the expiration date of tentative tract and parcel maps that had not expired on the effective date of the legislation. Mayor Minor recommended that conditional use permits and development permits also be extended, and that consideration also be given to approved projects. Consequently, it is recommended that Planning staff be directed to prepare an amendment to the Development Code to allow an automatic one-time, two-year extension of time on previously approved conditional use permits, development permits and variances retroactive to include those projects that were valid as of September 13, 1993. Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed concern relative to the two-year extension of time. City Administrator Shauna Clark explained that the two-year extension of time only relates to approved projects. 8 12/20/93 council Member Negrete made a motion, seconded by Council Member Devlin, and unanimously carried, that Planning staff be directed to prepare a Development Code Amendment to grant an automatic one-time, two-year extension of time for valid conditional use permits, development permits and variances. CHANGE ORDER #2 MENTONE TURF SUPPLY RENOVATE DETERIORATED LANDSCAPE MATERIAL - SOUTHWEST CORNER OF PINE AND BELMONT - LANDSCAPE MAINTENANCE - ASSESSMENT DISTRICT NO. 976 - $7,400 INCREASE (9) In a memorandum dated November 29, 1993, Roger Hardgrave, Director of Public Works/City Engineer, stated that in 1986 one of the conditions of approval for Tract No. 11844 was that the parkways along pine and Belmont Avenues be landscaped. Due to the remnant parcel created by the Bailey Creek Flood Control Channel, additional landscaping was installed at the southwest corner of pine and Belmont Avenues. Over the last seven years, the condition of the installed ground cover has deteriorated, and it was deemed necessary to replace about 8,000 square feet of ground cover. The contractor quoted a price of $7,400, and staff has determined that the price is fair and reasonable. Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to the costs associated with the renovation of the deteriorated landscape material. Council Member Devlin made a motion, seconded by Council Member Miller, and unanimously carried, that Change Order No. Two to the contract with Mentone Turf Supply for the maintenance of landscaping in Assessment District No. 976, in accordance with Plan No. 7034-B, be approved; and authorize the contractor to renovate the deteriorated landscaping material located at the southwest corner of pine and Belmont Avenues, at an increase in the contract price of $7,400, from $48,619 to $56,019. CHANGE ORDER #1 MENTONE TURF SUPPLY CONDUIT & WIRING KENDALL DRIVE MAINTENANCE - ASSESSMENT DISTRICT NO. 959 - INCREASE RELOCATE LANDSCAPE $5,831.24 (10) In a memorandum dated November 30, 1993, Roger Hardgrave, Director of Public Works/City Engineer, stated that in order to enhance the marketability of their properties, Block Brothers installed landscaping and an automatic irrigation system within the Kendall Drive parkway adjacent to their properties. A parcel was subsequently sold to the developer of a senior citizen apartment complex, and the site plans directed that a fence be installed along the front property line to enhance security. During excavation for the foundation for this fence, it was discovered that the conduit for the automatic irrigation controller wires had been installed beyond the street right-of- 9 12/20/93 way line. The conduit had to be relocated since it was in direct conflict with the foundation for the fence. In order to avoid work delays on the fence and loss of plant material, the landscape maintenance contractor relocated about 600 feet of the condui t wi thin the parkway area, which necessitated pulling in approximately 3,100 feet of new control wire. The total cost for the extra work is $5,831.24. Roger Hardgrave, Director of Public Works/City Engineer, answered questions regarding the placement of the conduit. Discussion ensued regarding the possibility of recovering the payment to Mentone Turf Supply if approval of said change order is granted. Council Member Curlin made a motion that the bill be approved minus the amount which is still in dispute. The motion failed for lack of a second. COUNCIL MEMBER POPE-LUDLAM RETURNED At 10:11 a.m., Council Member Pope-Ludlam returned to the Council meeting and took her place at the council table. A discussion was held relative to funding recovery procedures and change order policies. MAYOR MINOR EXCUSED At 10:15 a.m., Mayor Minor declared a conflict of interest because he lives within the assessment district and removed himself from the council table. council Member Miller assumed the duties of Mayor Pro Tempore. CITY ATTORNEY PENMAN EXCUSED At 10:16 a.m., city Attorney Penman left the Council meeting and was replaced by Senior Assistant City Attorney Barlow. Discussion continued regarding the possibility of recovering the payment to Mentone Turf Supply. Council Member Pope-Ludlam made a motion, seconded by Council Member Negrete, that contract Change Order No. One to the contract with Mentone Turf Supply for the maintenance of landscaping in Assessment District No. 959, in accordance with Plan No. 6363-B, be approved; and authorize the contractor to relocate conduit and wiring on Kendall Drive, at an increase in the contract price of $5,831.24, from $69,015 to $74,846.24. (Note: The vote was taken after discussion.) Jeff Wright, P. O. Box 2341, San Bernardino, clarification as to whether Mentone Turf Supply was contractor or a wire and conduit contractor. PERSONNEL ACTIONS (14) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the personnel actions submitted by the Chief Examiner dated December 9, 1993, and December 16, 1993, in accordance with civil Service Rules and Regulations and Personnel Policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. MAYOR MINOR RETURNED At 10:20 a.m., Mayor Minor returned to the Council meeting and took his place at the council table. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH GREAT WESTERN SAVINGS FOR SERVICES AS ADMINISTRATOR OF THE CITY I S DEFERRED COMPENSATION PLAN. (FUll-Time Employees) (Continued to later in the meeting.) (See Pages 21 & 22) (15) RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH GREAT WESTERN SAVINGS FOR SERVICES AS ADMINISTRATOR OF THE CITY'S PST DEFERRED COMPENSATION PLAN. (Part-Time, Seasonal & Temporary Employees) (Continued to later in the meeting.) (See Page 22) (17) Council Member Oberhelman made a motion that said resolutions be continued to the next Council meeting in order to review the other investment options that were explored by the Deferred Compensation Committee that may be available to both classes of employees. The motion failed for lack of a second. City Administrator Shauna Clark requested that said resolutions be continued to later in the meeting in order to obtain the answers to Council Member Oberhelman's inquiry. She explained that the city is currently without a contract, and she would like to see the matter resolved. Council Member Hernandez made a motion, seconded by Council Member Pope-Ludlam, and unanimously carried, that said resolutions be continued to later in the meeting. 11 12/20/93 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING FEES FOR PROCESSING APPLICATIONS FOR REAPPORTIONMENT OF ASSESSMENTS RELATIVE TO ASSESSMENT DISTRICT BONDS PURSUANT TO SECTION 8740 ET SEQ OF THE CALIFORNIA STREETS AND HIGHWAYS CODE. (20) Concern was expressed relative to the total estimated value of the contract and whether or not a request for proposals should be issued. City Administrator Shauna Clark answered questions regarding the current bond administrator. Roger Hardgrave, Director of Public Works/City Engineer, stated that it would be difficult to assess a total value because the fees would only apply to those bonded assessment districts which now equate to five or six within the city, and explained that the value is also dependent upon development. Council Member Curlin made a motion, seconded by Council Member Negrete, and unanimously carried, that adoption of the resolution be continued to the meeting of January 10, 1994, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California; and that a hearing be held on January 10, 1994 at 10:00 a.m. to consider the establishment of a fee for processing applications for apportionment of assessments under the provisions of the 1913-15 Act. ORD. MC-890 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING 19.20.030 OF THE SAN BERNARDINO MUNICIPAL CODE (TITLE 19 - DEVELOPMENT CODE) TO ADD STATE MANDATED TRANSPORTATION CONTROL MEASURES AS SUBSECTION 26 AND RENUMBERING EXISTING SUBSECTIONS 26 AND 27 AS SUBSECTIONS 27 AND 28 RESPECTIVELY. Final (21) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said ordinance be adopted. Ordinance No. MC-890 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. ORD. MC-891 AN ORDINANCE OF THE CITY OF SAN BERNARDINO TO AMEND SECTIONS 19.36.070 AND 19.44.070 OF THE SAN BERNARDINO MUNICIPAL CODE (DEVELOPMENT CODE) TO EXTEND THE INITIAL TERM OF CONDITIONAL USE PERMITS AND DEVELOPMENT PERMITS FROM ONE YEAR TO TWO YEARS. In a memorandum dated December 7, 1993, Roger Hardgrave, Director of Public Works/City Engineer, stated that a petition was received from property owners requesting the formation of an assessment district for the construction of a sewer main in the Quail Canyon area. The assessment would include the construction of sewers and appurtenant facilities, administrative costs and the cost for the acquisition of easements. It is proposed that the upfront construction costs be paid from the sewer construction fund which would then be reimbursed through assessments over a per iod of ten years. The total cost of construction and incidental expenses is estimated at $130,584, 18 12/20/93 with each parcel assessed equally. The first year's assessment is estimated to be $4,352.80 for each of the six parcels, which includes interest on the unpaid balance. The assessments would then decrease each year as the balance is reduced. Mr. O'Connor has won countless grammy awards and has been the Country Music Association's "Musician of the Year" for the past three years. He has composed a concerto for violin and orchestra which would receive its West Coast debut with the Inland Empire symphony. The performance would be produced locally by Bob Harvey, a well- known media personality, Country Connection, which is in over 80 markets across the country. RES. 93-465 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, MAKING FINDINGS AND DETERMINATIONS AS TO THE BENEFIT OF CERTAIN PUBLIC IMPROVEMENTS FOR THE STATE COLLEGE REDEVELOPMENT PROJECT AREA. (R-6A) Council Member Oberhelman made a motion, seconded by Council Member Pope-Ludlam, that said resolution be adopted. Resolution No. 93-465 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Devlin, Pope- Ludlam, Miller. Nays: None. Abstain: Council Member Hernandez. Absent: None. COMMUNITY DEVELOPMENT COMMISSION - REGULAR MEETING At this time, the Mayor and Common Council, acting as the Community Development Commission, took action on Community Development Commission items. Council AMENDMENT ORDINANCE MOBILE HOME PARK RENT STABILIZATION (RS-l) 25 12/20/93 In a memorandum dated December 17, 1993, Timothy Steinhaus, Agency Administrator, Economic Development Agency, stated that in a memorandum dated December 16, 1993, Council Member Hernandez requested that the Mayor and Council direct the City Attorney's Office to prepare an amendment to the Mobile Home Park Rent Stabilization ordinance to require mobile home parks to inform the Mobile Home Board within twenty-four (24) hours of any new rental agreements signed by the park. council Member Oberhelman made a motion, seconded by Council Member Hernandez, and unanimously carried, that the Mayor and Common Council direct the City Attorney's Office to prepare an amendment to the Mobile Home Park Rent Stabilization ordinance which requires mobile home parks to inform the Mobile Home Board within twenty-four (24) hours of any new rental agreement signed by the park; and that the matter be brought back to the meeting of January 10, 1994, in the Council Chambers of city Hall, 300 North "D" Street, San Bernardino, California.
