ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, curlin, Hernandez, Oberhelman; City Attorney Penman; City Clerk Rachel Clark; city Administrator Shauna Clark. READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Cordova read the titles of all the resolutions and ordinances on the regular, supplemental and community Development Commission agendas while the Council was in closed session. POPE-LUDLAM ARRIVED Council Member Pope-Ludlam arrived at the DEPUTY CITY ATTORNEY SIMMONS EXCUSED At 8:23 a.m., Deputy city Attorney Simmons left the closed session. COUNCIL MEMBER MILLER ARRIVED At 8:31 a.m., Council Member Miller arrived at the closed session. Absent: None. *Fifth Ward Office Vacant ANNOUNCEMENT - LEO AMENDT - MOMENT OF SILENCE - MAYOR MINOR (2) Mayor Minor requested a moment of silence to honor former Council Member Leo Amendt who passed away. INVOCATION The invocation was given by Chaplain David Randolph, San Bernardino Community Hospital. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Pope- Ludlam. ANNOUNCEMENT - CITY CLERK RACHEL CLARK (2A) city Clerk Rachel Clark announced the following 5th Ward Special Election deadlines: 1) August 16, 1993 last day to register to vote for the September 14, 1993 Election; 2) August 16, 1993 first day absentee ballots can be issued; and 3) september 7, 1993 last day to apply for an absentee ballot. PUBLIC COMMENTS - SHAWN ULESKE (3) Shawn Uleske, President, Edgehill Village Homeowners Association, 1480 W. Edgehill Road, #1, San Bernardino, CA, expressed opposition to the restoration of a greenbelt behind the garages of the Edgehill Village Condominium Complex because it would be a financial hardship to the 276 homeowners. Mr. Uleske provided City Clerk Rachel Clark with a petition containing 200 signatures requesting that the Edgehill village Condominium Complex be allowed to perform weed abatement as necessary, and if the Fire Marshall insists on the greenbelt, that the city help pay the costs to restore the area and the irrigation system. PUBLIC COMMENTS - ROBERT NEVES (3A) Robert Neves, Barrier Free Environmental ConSUlting, 3771 Aspen Drive, San Bernardino, expressed concern relative to public access for the handicapped at the perris Hill Park water slide, and requested that action be taken to rectify any non-compliance with the Americans with Disabilities Act (ADA). 4 8/16/93 PUBLIC COMMENTS - DEBORAH ROBERTSON (3B) Deborah Robertson, 1400 W. Edgehill Road, San Bernardino, CA, expressed opposition to the requirement being imposed to install and maintain a greenbelt area behind the garages at Edgehill Village condominium complex, requested the City's financial assistance and stated that the residents be allowed to perform weed abatement as necessary. PUBLIC COMMENTS - KEITH RENO (3C) Keith Reno, 1400 W. Edgehill Road, expressed opposition to the greenbelt Edgehill Village Condominium complex. #38, San Bernardino, CA, behind the garages at PUBLIC COMMENTS - JEFF WRIGHT (3D) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to the demolition of the Platt Building and approval of the CalMat mining project. PUBLIC COMMENTS - JOYCE STEELE (3E) Joyce Steele, 1440 W. Edgehill Road, #46, San Bernardino, CA, expressed opposition to the greenbelt behind the garages at Edgehill Village Condominium complex, and requested the City I s financial assistance for the replacement of the greenbelt and irrigation system. PUBLIC COMMENTS - ROBERT LIST (3F) Robert List, 1480 W. Edgehill Road, #17, San Bernardino, CA, expressed opposition to the greenbelt behind the garages at Edgehill Village Condominium complex, and requested the City's financial assistance for the replacement of the greenbelt and irrigation system. ANNOUNCEMENT - MAYOR MINOR (2B) Mayor Minor requested that City Administrator Shauna Clark meet with Fire Chief Wright to resolve the issues relative to the Edgehill village Condominium Complex. APPOINTMENTS COMMUNITY TELEVISION COMMISSION- LIBRARY BOARD - COMMUNITY DEVELOPMENT CITIZEN ADVISORY COMMISSION - CIVIL SERVICE BOARD - MAYOR MINOR (4) In memoranda dated July 12, August 3, and August 5, 1993 respectively, Mayor Minor recommended the appointments of John R. Lowe to the Community Television Commission, Karen A. Feld to the Library Board, Carolyn B. Freeman to the Community Development citizen Advisory Commission and Elijah Singletary to the civil Service Board. Council Member Oberhelman made a motion, seconded by Council Member Miller, and unanimously carried, that the appointments of John R. Lowe to the Community Television commission, Karen A. Feld to the Library Board, Carolyn B. Freeman to the Community Development citizen Advisory Commission and Elijah Singletary to the civil Service Board, be approved. APPOINTMENT - POLICE COMMISSION - CAROL THRASHER (4A) In a recommended Commission, memorandum dated August 6, 1993, Mayor the appointment of Carol Thrasher to the per Council Member Curlin's request. Minor Police Council Member Oberhelman made a motion, seconded by Council Member Miller, and unanimously carried, that the appointment of Carol Thrasher to the Police Commission, be approved. PROCLAMATION AUGUST 1993 NATIONAL JOB TRAINING PARTNERSHIP ACT (JTPA) ALUMNI MONTH (4B) J. Lorraine Velarde, Executive Assistant to the Mayor, read a proclamation declaring the month of August 1993, as National Job Training Partnership Act (JTPA) Alumni Month, in recognition of the San Bernardino Employment & Training Agency's dedicated service in providing employment to members of the community. 6 8/16/93 George Fujiwara, Executive Director, San Bernardino Employment & Training Agency; Jim Schneider, Chairman, and Deborah Hagar, Vice-Chair, Private Industry Council; accepted the proclamation and presented certificates of appreciation to: Tammy calderon, JTPA Alumni Humberto Marxelly, JTPA Alumni Liane Maziarz, JTPA Alumni Barbara Ramirez, JTPA Alumni Taco Bell, store #3150, Outstanding Employer Health Care Innovations, Outstanding Program Operator Canam Metal Products, Outstanding Employer PROCLAMATION AUGUST 28-SEPTEMBER OPTIMIST CLUB OF SAN BERNARDINO SAFETY CAMPAIGN 12, 1993 NOON OPTIMIST BICYCLE (4C) J. Lorraine velarde, Executive Assistant to the Mayor, read a proclamation declaring August 28 through September 12, 1993 as the San Bernardino optimist Safety Campaign, in recognition of a new school year and advocating bicycle safety. Patty Gonzales, San Bernardino Optimist Club, accepted the proclamation and thanked the City and staff for their support. Bob Wilson, Safety Coordinator, San Bernardino Police Department, explained his duties in respect to traffic safety and issuance of the Safety Grant. SERVICE PIN AWARD CEREMONY (40) J. Lorraine Velarde, Executive Assistant to the Mayor, read the names of each employee receiving service pin awards. Each employee received a service pin from their respective department heads in gratitude years of dedicated service to the City. Mayor Minor and of his/her many COUNCIL MINUTES (6) Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the minutes of the following meeting of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: June 7, 1993. CHANGE ORDER NO. ONE MILL STREET STORM DRAIN- PENNSYLVANIA AVENUE TO RANCHO AVENUE CONTRACT INCREASE - $6,221.10 - C. P. CONSTRUCTION COMPANY, INC. (7) 7 8/16/93 In a memorandum dated August 2, 1993, Roger Hardgrave, Director of Public Works/City Engineer, stated that after C. P. Construction Company, Inc., began laying pipe, it became evident that a sewer lateral was required to serve the commercial complex on the northeast corner of Mill street and Rancho Avenue. The City of Colton had no record of the sewer lateral and could not provide assistance in locating the lateral. Consequently, the contractor did some exploratory borings, but was unsuccessful. While excavating the trench for the 42-inch storm drain, the lateral was uncovered and found to be in conflict with the design profile of the storm drain. The contractor was forced to suspend the pipe-laying operation in order to allow for the profile of the storm drain to be revised. A claim has been submitted by the contractor in the amount of $6,221.10 as compensation for the eight (8) hours lost for the redesign of the profile. The claim was reviewed by staff and is found to be fair and reasonable. Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that Change Order No. One to the contract with C. P. Construction Company, Inc., for installation of a storm drain in Mill street, from Pennsylvania Avenue to Rancho Avenue, in accordance with Plan No. 8820, be approved; to authorize an increase of $6,221.10 in the contract price, from $139,100.40 to $145,321.50, to compensate the contractor of a delay due to conflict with a sewer lateral. CLAIMS AND PAYROLL (9) Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the claims and payroll, and the authorization to issue warrants as listed on the memorandum dated August 10, 1993 from the Director of Finance, be approved. PERSONNEL ACTIONS (10) Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the personnel actions submitted by the Chief Examiner dated August 5, 1993, in accordance with civil Service Rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. JOINT POWERS FINANCING AUTHORITY - REGULAR MEETING (11) Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the regular meeting of the Joint Powers Financing Authority be adjourned to September 20, 1993. 8 8/16/93 RES. 93-312 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO RELATING TO THE JOINT USE OF THE MILL COMMUNITY CENTER FOR THE PERIOD BEGINNING JANUARY 1, 1992 AND ENDING DECEMBER 31, 1992, AND REPEALING RESOLUTION 93-147. (15) RES. 93-313 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO RELATING TO THE JOINT USE OF THE MILL COMMUNITY CENTER FOR THE PERIOD OF FIFTEEN (15) YEARS COMMENCING JANUARY 1, 1993 AND ENDING DECEMBER 31, 2008, AND REPEALING RESOLUTION 93-148. (16) RES. 93-314 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 3985 ENTITLED, IN PART, "A RESOLUTION... PROHIBITING PARKING UPON CERTAIN DESIGNATED STREETS OR PORTIONS THEREOF..., II TO REMOVE THE NO PARKING ZONE ON SIERRA WAY, BETWEEN THIRTIETH STREET AND THIRTY-FOURTH STREET, BETWEEN THE HOURS OF SEVEN A.M. AND NINE A.M., APPLICABLE TO THE WEST SIDE ONLY, AND BETWEEN THE HOURS OF FOUR P.M. AND SIX P.M., APPLICABLE TO THE EAST SIDE ONLY. (18) Council Member Hernandez made a motion, seconded by Council Member Oberhelman, that said resolutions be adopted. Absent: None. *Fifth Ward Office Vacant WAIVE FURTHER READING OF RESOLUTIONS & ORDINANCES (5) Jeff wright, P. O. Box 2341, San Bernardino, CA, requested that the titles of resolutions and ordinances be read; and read a letter from Larry T. McMann wherein he expressed support for the reading of titles of resolutions and ordinances. Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that further reading of all resolutions and ordinances on the regular, supplemental and community Development Commission agendas, be waived. MAIN & RESIDENTIAL TRAFFIC ARTERIES - RECONSTRUCTION & RESURFACING - AUTHORIZATION TO PROCEED (8) 9 8/16/93 In a memorandum dated August 3, 1993, Manuel P. Moreno, Jr., Director of Public Services, stated that a list of major arteries and residential streets and proposed alternates had been developed, and authorization is requested to proceed with cold planing work and resurfacing. The estimated cost is $1,000,000. Jeff Wright, P. O. Box 2341, San Bernardino, CA, requested clarification as to the use of funds. Robert Neves, 3771 Aspen Drive, San Bernardino, CA, requested consideration of a recent court decision involving street and road repaving and resurfacing and the effect of the Americans with Disabilities Act relative to corner-curb cuts and ramps. Roger Hardgrave, Director of Public Works/City Engineer, answered questions relative to installation of handicapped ramps throughout the city. Mayor Minor requested that the city Attorney review the installation of corner curb cuts and ramps relative to street and road repaving and resurfacing. council Member Oberhelman made a motion, seconded by Council Member Pope-Ludlam, and unanimously carried, that the Purchasing Agent be authorized to advertise for bids for cold planing work on the streets included in the Staff Report dated August 3, 1993, for major arteries and residential streets; and that the Director of Public Services be authorized to proceed with the resurfacing of the streets indicated in the staff Report following the completion of the contract work. RES. 93-315 A RESOLUTION OF BERNARDINO COMMUNITY FACILITIES ESTABLISHING ANNUAL SPECIAL TAX 1993/94. THE CITY OF SAN DISTRICT NO. 1 FOR FISCAL YEAR (12) Roger answered District. Discussion ensued relative to Community Facilities District No. 1. (13) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to the resolution not being advertised, and requested that items such as this be placed for discussion on the agenda. Absent: None. *Fifth Ward Office Vacant RES. 93-318 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT BY AND BETWEEN THE COUNTY OF SAN BERNARDINO AND THE PUBLIC SERVICES DEPARTMENT OF THE CITY OF SAN BERNARDINO TO OPERATE A HOUSEHOLD HAZARDOUS WASTE COLLECTION CENTER. (17) -, 11 8/16/93 Jeff Wright, P. O. Box 2341, San Bernardino, CA, stated that he had information regarding hazardous waste and requested a contact for dissemination of said information. Helen Kopczynski, 8150 Cable Canyon Road, San Bernardino, CA, requested clarification as to whether said resolution relates to Emcon Associates. Council Member Hernandez made a motion, seconded by Council Member Oberhelman, that said resolution be adopted; and that the sum of $130,650.40 be transferred from Account No. 172-412-53160 (Tipping Fees) to Account No. 127-411-53150 (PrOfessional & Contractual Services) for the purpose of continuing the existing Household Hazardous Waste Collection Center Program. The motion carried and Resolution No. 93-318 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Pope-Ludlam, Miller. Nays: None. Absent: None. *Fifth Ward Office Vacant RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 93-205 ENTITLED IN PART TO READ "RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SAN BERNARDINO FOR THE ANNEXATION OF THE TERRITORY LOCATED SOUTHWESTERLY OF CAJON BOULEVARD AND SOUTHEASTERLY OF DEVORE ROAD" BY AMENDING EXHIBIT "A" AND EXHIBIT "C". (19) city Administrator Shauna Clark requested that said resolution be continued to amend the legal description. Council Member Hernandez made a motion, seconded by Council Member Miller, and unanimously carried, that said resolution be continued to September 7, 1993, in the Council Chambers of city Hall, 300 North "0" street, San Bernardino, California. SAN BERNARDINO COMMUNITY AGAINST DRUGS - WAYS COMMITTEE DENIAL OF FUNDS $44,500 SIMPSON, PRESIDENT/CHIEF EXECUTIVE OFFICER. & MEANS JERILYN (24) In a memorandum dated August 3, 1993, Mayor Minor requested that Jerilyn Simpson be allowed to address the Council regarding the Ways & Means committee's denial of funds in the amount of $44,500 for the San Bernardino community Against Drugs, as noted in Ms. Simpson's letter dated July 29, 1993. Jeri Simpson, President/chief Executive Officer, San Bernardino community Against Drugs, 234 North Arrowhead Avenue, San Bernardino, CA, appealed to the Council for the approval of funds in the amount of $44,500, and provided a synopsis of the program. 12 8/16/93 council Member Hernandez made a motion, seconded by Council Member Pope-Ludlam, that Jeri Simpson be allowed to exceed the three minute public-speaking limitation. (Note: There was no vote taken at this time.) The following individuals urged continued funding of San Bernardino Community Against Drugs: Kevin Wright, Youth Project Coordinator, San Bernardino Community Against Drugs (SBCAD), 234 North Arrowhead Avenue, San Bernardino, California. Harold carr, Executive Director, Home of Neighborly Services, 839 N. Mt. Vernon Avenue, San Bernardino, CA, stated that the Home of Neighborly Services was given a grant by the city in the amount of $305,000, and proposed that $48,000 of the grant be allocated to San Bernardino Community Against Drugs. 14 8/16/93 Discussion ensued relative to the possible allocation of funds. It was noted that only $20,000 in Community Development Block Grant (CDBG) funds can be allocated toward social programs. Approval of $20,000 in CDBG funds was granted on August 2, 1993 for San Bernardino Community Against Drugs. A discussion ensued relative to the continuance of said item to 2:00 p.m., to allow for a determination of the possible allocation of funds. Discussion was held relative to the action taken by the Ways & Means Committee. It was noted that the Ways & Means Committee did not question the success of San Bernardino Community Against Drugs. The Committee requested that the organization resubmit an adjusted budget, and the Committee made a decision based on the organization's lack of response. Jeri Simpson explained that since 1985, San Bernardino Community Against Drugs had been receiving a yearly allocation of $44,500 without any increases. She stated that the organization feels that reductions could not be recommended in their budget. City Administrator Shauna Clark explained the fiscal restraints the City is now facing. She stated that since 1986, San Bernardino Community Against Drugs received $40,000 annually from the general fund until 1992 when it was apparent that the general fund could longer fund the organization. In 1992, the Economic Development Agency provided $20,000 in Community Development Block Grant (CDBG) funds and $44,000 in Collaterized Mortgage Obligation (CMO) funds to the organization. The Supreme Court is tasked wi th deciding whether adjudicatory hearings should be held on this matter. Consequently, it is recommended that the City file an Amicus Letter asking that the court hear the matter. SET PUBLIC HEARING SERVICE CHARGE WATER DEPARTMENT - SEPTEMBER 7, 1993 INCREASE SEWER- WITHIN & OUTSIDE SAN BERNARDINO- (26) In a memorandum dated July 29, 1993, Bernard Kersey, General Manager, Water Department, provided a synopsis of the rationale for a proposed sewer-service increase. On June 22, 1993 the Board of Water Commissioners conducted an extensive review of the 1993/94 Sewer Fund budget and the proposed increases to the sewer-service charge, and unanimously voted that a public hearing be conducted.
