HomeMy WebLinkAbout06-02-1993 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADJOURNED REGULAR MEETING JUNE 2, 1993 COUNCIL CHAMBERS This is the time and place set for an adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino from the adjourned regular meeting held at 8:32 a.m., Monday, May 24, 1993, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, May 24, 1993, and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 2:35 p.m., Tuesday, May 25, 1993, on the door of the place at which said meeting was held. READING OF RESOLUTION & ORDINANCE City Clerk Rachel Clark read the title of the resolution and ordinance on the adjourned regular meeting agenda of the Mayor and Common Council. The adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Pro Tem Estrada at 9:02 a.m., Wednesday, June 2, 1993, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Pro Tem Estrada; Council Members Estrada, Reilly, Hernandez, Maudsley, Minor, Miller; City Clerk Rachel Clark. Absent: Mayor Holcomb; Council Member Pope- Ludlam; City Attorney Penman; city Administrator Shauna Clark. CLOSED SESSION (1) The Mayor and Common Council did not recess to closed session during this meeting. INVOCATION The invocation was given by Phil Arvizo, Executive Assistant to the Council. 1 6/2/93 PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Minor. CITY ATTORNEY PENMAN ARRIVED At 9:04 a.m., city Attorney Penman arrived at the Council meeting. ANNOUNCEMENT - COUNCIL MEMBER ESTRADA (5A) council Member Estrada thanked the City employees for their dedicated service and support. ANNOUNCEMENT - COUNCIL MEMBER HERNANDEZ (5B) Council Member Hernandez commended the outgoing council members for their dedicated service to the City. COUNCIL MEMBER At 9:05 a.m., Council meeting and POPE-LUDLAM ARRIVED Council Member pope-Ludlam took her place at the council arrived table. at the PUBLIC COMMENTS There were no public comments during the public comments section of this meeting. ORD. MC-874 AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 19.10 OF THE SAN BERNARDINO MUNICIPAL CODE (TITLE 19 - THE DEVELOPMENT CODE) TO ADD SECTION 19.10.030(5) TO ESTABLISH THE CALMAT CAJON CREEK SPECIFIC PLAN (SP, SPECIFIC PLAN - CALMAT CAJON CREEK PROJECT) LAND USE DESIGNATION/ZONE, PERMITTED USES, DEVELOPMENT STANDARDS AND DESIGN GUIDELINES. Final (2) Council Member Minor made a motion, seconded by Council Member Pope-Ludlam, that said ordinance be adopted. Gary Kirby, 1505 Yardley, San Bernardino, CA, expressed opposition to approving the CalMat ordinance at this meeting rather than at a regular Council meeting. Discussion ensued regarding the CalMat ordinance. The motion Members Reilly, Members Estrada, carried by the following vote: Ayes: Maudsley, Minor, Pope-Ludlam. Nays: Hernandez, Miller. Absent: None. Council Council Mayor Pro Tem Estrada vetoed the approval of the CalMat ordinance. 2 6/2/93 Discussion ensued relative to the adoption of the CalMat ordinance. Mayor Pro Tem Estrada withdrew her veto. PUBLIC HEARING DEVELOPMENT PHASED EXPANSION PROJECT CONTINUED FROM MAY 24, 1993 AGREEMENT NO 91-01- INLAND CENTER MALL- (3) This is the time and place continued for a public hearing to govern the development of a phased expansion project at Inland Center Mall. In a letter dated June 1, 1993, Mark Ostoich, Gresham, Varner, Savage, Nolan & Tilden, 600 North Arrowhead Avenue, Suite 300, San Bernardino, CA, representing the applicant, submitted a synopsis of the facts supporting the use of a Mitigated Negative Declaration for approval of the Inland Center Mall Development Agreement. In a letter dated June 2, 1993, Orval Papon, Vice President, Development; and Arun Parmar, General Manager, Inland Center Mall, on behalf of the General Growth Management, Inc., 15303 Ventura Boulevard, suite 1520, Sherman oaks, CA, submitted an overview of the project. In a letter dated June 2, 1993, Salvatore Catalano, Carousel Mall General Manager, 295 Carousel Mall, San Bernardino, CA, expressed opposition to the approval of the Mitigated Negative Declaration in connection with the approval of the pending Inland Center Mall Development Agreement without consideration of an environmental impact report. In a letter dated May 31, 1993, Marlene A. Fox, Esquire, 2031 Orchard Drive, suite 200, Santa Ana Heights, CA, representing the Carousel Mall Merchants Association, submitted a letter of opposition pertaining to Development Agreement No. 91- 01 governing the development of a phased expansion project at Inland Center Mall. Mayor Pro Tem Estrada opened the hearing. Discussion ensued regarding the late submittal of pertinent documents requiring consideration for the approval of Development Agreement No. 91-01 governing the development of a phased expansion project at Inland Center Mall. Concern was expressed that sufficient time would be needed to review all relevant documents. Discussion ensued relative to in connection with the proposed Center Mall. the potential for litigation expansion project at Inland 3 6/2/93 Discussion ensued regarding a proposed submittal of all relevant information for the Development Agreement No. 91-01. deadline approval for of Mark Ostoich, Esquire, representing Inland Center Mall, stated that the document he submitted is a summary of all evidence previously submitted, and would be willing to withdraw all evidence submitted to allow for the hearing of said resolution which adopts the mitigated declaration of environmental impact, adopts the Mitigation Monitoring/Reporting Program and authorizes the execution of Development Agreement No. 91-01 (Inland Center Mall Expansion). Discussion ensued relative to whether an environmental impact report was needed for the proposed mall expansion. Discussion ensued regarding the possibility of continuing the public hearing since the newly-elected Mayor and Council Members would be taking Office on June 7, 1993. It was the consensus of the Council that since the Council Members elect, namely First Ward Council Member-Elect Edward Negrete, Second Ward Council Member-Elect F. J. Curlin, M.D., and Fourth Ward Council Member-Elect David Oberhelman, were all present, that the City Clerk enter into the record the presence of the incoming Council Members at this meeting. RECESS MEETING At 9:59 a.m., Mayor Pro Tem Estrada declared a five-minute recess. RECONVENE MEETING At 10:10 a.m., the adjourned regular meeting of the Mayor and Common Council reconvened in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by city Clerk Rachel Clark with the following being present: Mayor Pro Tem Estrada; Council Members Estrada, Reilly, Hernandez, Maudsley, Minor, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark. Absent: Mayor Holcomb; city Administrator Shauna Clark. Also present: First Ward Council Member-Elect Edward Negrete, Second Ward Council Member-Elect F. J. Curlin, M.D., and Fourth Ward Council Member-Elect David Oberhelman. Mark Ostoich, Esquire, representing Inland Center Mall, provided an overview of said project and stated that the Inland Center Mall would agree to perform an environmental impact report. Mr. Ostoich requested that Planning & Building Services be directed to assist in the development of the environmental impact report. Marlene Fox, Esquire, representing Carousel Mall Merchants Association, requested an opportunity to assist in the development of the environmental impact report. Ms. Fox explained that the Carousel Mall Merchants Association position is that other issues need to be addressed as well as economic impact, and stated that she would be available to address any concerns and to provide input. Mark Ostoich, Esquire, stated that the Inland Center Mall would include the Carousel Mall Merchants Association in the development of the environmental impact report. RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING THE MITIGATION MONITORING/REPORTING PROGRAM AND AUTHORIZING THE EXECUTION OF DEVELOPMENT AGREEMENT NO. 91-01 (INLAND CENTER MALL EXPANSION). (Continued from May 24, 1993) (3) Council Member Reilly, made a motion, seconded by Council Member Hernandez, and unanimously carried, that the applicant be directed to prepare an environmental impact report; and that Planning & Building Services be directed to work with the applicant relevant to the environmental impact report. ADJOURNMENT (4) At 10:20 a.m., Mayor Pro Tem Estrada adjourned the meeting to Monday, June 7, 1993, at 9:00 a.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California.
