HomeMy WebLinkAbout08-10-1994 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO EMERGENCY MEETING AUGUST 10, 1994 COUNCIL CHAMBERS The Mayor and Common Council of the City of San Bernardino have called an emergency meeting of the Mayor and Common Council for 3:00 p.m., Wednesday, August 10, 1994, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The purpose for which this meeting was called was to discuss and take possible action relative to the job action by the San Bernardino Police Officers' Association, pursuant to Government Code Section 54956.5 (a). Between 10:00 a.m. and 10:30 a.m., the City Clerk, by telephone, notified the following individuals: Mayor Minor, Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller, City Attorney Penman, City Administrator Clark, The Sun - Richard Brooks, Precinct Reporter - Don Townsend, El Chicano - Bill Harrison, Inland Empire Hispanic News - Eddie Martinez and Channel Three - Frank Keller. Courtesy calls were also placed to all local radio stations. The emergency meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Minor at 3:06 p.m., Wednesday, August 10, 1994, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Curlin. JOB ACTION - SAN BERNARDINO POLICE OFFICERS' ASSOCIATION (SBPOA) - DISCUSS & TAKE POSSIBLE ACTION (1) Mayor Minor stated that as of this date, August 10, 1994, the Police Department was confronted with a job action followed by a verbal declaration of impasse by the Police Officers' Association from the bargaining session which took place on August 9, 1994. Mayor Minor read from a prepared statement listing the following chronology of events: In February 1992, the Mayor and Council the San Bernardino Police Officers' significantly enhanced police benefits. imposed a contract on Association, which 1 8-10-94 Between February 1992 and August 1994, only 10 negotiation sessions were held. Significant lapses in time took place during the sessions; however, they were all at the request of the San Bernardino Police Officers' Association. After the fifth negotiation session in July 1993, the San Bernardino Police Officers' Association and the City were close to an agreement; however, the contract was not immediately approved. Consequently, prior to a meeting held by the Mayor and Council, the attorney for the San Bernardino Police Officers' Association took the position that the City had a final contract. The San Bernardino Police Officers' Association returned to the bargaining table and changed their position, and stated that a contract did not exist. Negotiations broke down Council authorized further additional sessions were held somewhat; increases in 1993. however, the Mayor and for benefits. Three The ninth bargaining session was held on March 1, 1994. At that session, significant benefit increases were offered. Nonetheless, an agreement could not be reached. During the fiscal year 1994/95 budget review, the Mayor and Council allocated additional funds for an increase in the benefits which were previously offered, and authorized the City team to extend additional increases to the benefits offered to the San Bernardino Police Officers' Association. In July 1994, the Personnel Department received notice of a change in the San Bernardino Police Officers' Association bargaining team, and requested another negotiation session. On August 9, 1994, the new bargaining team met with the City team. The City informed the San Bernardino Police Officers' Association (SBPOA) that the Mayor and Council had authorized an increase to the benefits since the March 1st meeting, and requested specific counter-proposals from the SBPOA. Without submitting a counter-proposal, the new SBPOA team declared an impasse after only two hours at the bargaining table. Mayor Minor concluded his remarks by stating that it should be noted that the San Bernardino Police Officers' Association abandoned a significant amount of money which was offered solely for benefits. Automatic increases are provided through Charter Section 186; and it is anticipated that SBPOA members will receive salary increases ranging from 4.08 to 5.4 percent within the month of August 1994. Daniel Robbins, Police Chief, provided a synopsis of the action taken to ensure the safety of the public and police personnel as a result of the job action taken by the San Bernardino 2 8-10-94 Police Officers' Association; and answered questions regarding the intent of the San Bernardino Police Officers' Association. Council Member pope-Ludlam made a motion, seconded by Council Member Hernandez, and unanimously carried, that pursuant to Section 3(c) of the Police Safety Employees Memorandum of Understanding, the Mayor and Council do hereby require the presentation of a certificate from a practicing physician or the County Health Officer stating that an officer off on sick leave was actually sick and is able to return to work. The minutes provide a list of the persons who were notified or whom the City Clerk attempted to notify; the roll call vote; and the action taken at said meeting. The minutes will be presented at the September 6, 1994 meeting of the Mayor and Common Council for their approval; however, in compliance with G.C. section 54956.5, the minutes are being posted for a minimum of 10 days beginning this date.
