HomeMy WebLinkAbout07-11-1994 Minutes MINUTES MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO SPECIAL MEETING JULY 11, 1994 COUNCIL CHAMBERS NOTICE IS HEREBY GIVEN that the Mayor and Common Council of the City of San Bernardino have called a special meeting of the Mayor and Common Council for 4:30 p.m., Monday, July 11, 1994, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The purpose for which this meeting has been called is to conduct a closed session on the following: 1. Pursuant to Government Code Section 54956.9(a): (A) Conference with legal counsel - existing litigation: (1) Juanita Scott. Beniamin Gonzales. Warren Cocke. and Honorable Evlyn Wilcox vs. Common Council of the City of San Bernardino - San Bernardino Superior Court Case No. SCV13711. The special meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Minor at 4:30 p.m., Monday, July 11, 1994, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller; City Attorney Penman, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Pope-Ludlam. ANNOUNCEMENT - CITY ATTORNEY PENMAN City Attorney Penman announced that Attorney Joseph Simitian and representatives from Kay and Stevens, 490 California Avenue, Suite #400, Palo Alto, CA, hired to investigate the sexual harassment allegations within the City Attorney's Office, are scheduled to be in the City for three days. City Attorney Penman stated that four employees of the City Attorney's Office were contacted by the attorneys; however, the employees declined to meet with the attorneys unless the City retains legal counsel for the employees; and, two other employees in the City Attorney's Office have refused to meet with the attorneys. He indicated that the Council would need to call another special meeting to ascertain whether legal counsel should be retained in this 1 7/11/94 matter. COUNCIL MEMBER POPE-LUDLAM ARRIVED Council Member Pope-Ludlam arrived at the Council meeting and took her place at the council table. RECESS MEETING - CLOSED SESSION At 4:32 p.m., the Mayor and Common Council recessed following: (1) to closed session for the 1. CLOSED SESSION At 4:32 p.m., Mayor Minor called the closed session to order in the conference room of the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: City Attorney Penman. Also present: Tim Sabo, Sabo and Green, special counsel, 6320 Canoga Avenue, Suite #400, Woodland Hills, CA. ADJOURN CLOSED SESSION At 4:54 p.m., the closed session adjourned to the special meeting of the Mayor and Common Council of the City of San Bernardino. RECONVENE MEETING At 4:56 p.m., Mayor Minor reconvened the special meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 2 7/11/94 ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: None. CLOSED SESSION ACTION (1.A.!) Juanita Scott. Beniamin Gonzales. Warren Cocke. and Honorable Evlyn Wilcox vs. Common Council of the City of San Bernardino - San Bernardino Superior Court Case No. SCV13711. Mayor Minor announced that in closed session, the Council approved the seeking of a Writ of Mandate from the Court of Appeals. The action was approved by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Pope-Ludlam. Nays: Council Members Oberhelman, Devlin, Miller. Absent: None. ADJOURNMENT (2) At 4:57 p.m., the meeting was adjourned. The next regular meeting is scheduled to be held at 8:00 a.m., Monday, July 18, 1994, in the Council Chambers of City Hall, 300 North "DD Street, San Bernardino, California.
