ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller; City Attorney Penman, City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Pope-Ludlam. RECESS MEETING - CLOSED SESSION - MEETING - SEE PAGE 3 At 8:00 a.m., the Mayor session for the following: REFERENCED LATER IN THE (1) and Common Council recessed to closed Pursuant to Government Code Sections. A. CLOSED SESSION At 8:01 a.m., Mayor Minor called t.he closed session to order in the conference room of the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 1 12/18/95 ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller, City Attorney Penman, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Pope-Ludlam. Also present: Margaret Scroggin, Administrative Operations Supervisor, City Attorney's Office, and Assistant City Administrator Wilson. READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Cordova read the titles of all the resolutions and ordinances on the regular and supplemental agendas of the Mayor and Common Council and the regular and supplemental agendas of the Community Development Commission/San Bernardino Joint Powers Financing Authority and Mayor and Common Council while the Council was in closed session. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 8: 12 a.m., Council Member Pope-Ludlam arrived at the closed session. ASSISTANT CITY ADMINISTRATOR WILSON EXCUSED At 8:51 a.m., Assistant City Administrator Wilson left the closed session. ASSISTANT CITY ADMINISTRATOR WILSON AND CHIEF OF POLICE CANDIDATE DEAN ARRIVED At 8:59 a.m., Assistant City Administrator Wilson and Chief of Police Candidate Lee Dean arrived at the closed session. CITY CLERK RACHEL CLARK EXCUSED At 9:01 a.m., City Clerk Rachel Clark left the closed session. CITY CLERK RACHEL CLARK RETURNED At 9:05 a.m., City Clerk Rachel Clark returned to the closed session. ADJOURN CLOSED SESSION At 10:08 a.m., the closed session adjourned to the regular meeting of the Mayor and Common Council of the City of San Bernardino. RECONVENE MEETING At 10:10 a.m., Mayor Minor reconvened the regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 2 12/18/95 ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, City Attorney Penman; City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Miller. INVOCATION The invocation was given by Phil Arvizo, Executive Assistant to the Council. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Curlin. APPROVE EMPLOYMENT CONTRACT - APPOINTMENT OF CHIEF OF POLICE LEE DEAN EFFECTIVE JANUARY 15, 1996 REFERENCED EARLIER IN THE MEETING - SEE PAGE 1 ~) NOTE: A Staff Report was not submitted; however, the employment agreement is part of the backup material. The following individuals expressed concern regarding police treatment of minority citizens and/or the recruitment process: Morsell Johnson, National Association for the Advancement of Colored People (NAACP), 1505 W. Highland Avenue, Suite 11, San Bernardino, California. Danny Tillman, California. 1808 Genevieve Street, San Bernardino, Jeff Wright, P. O. Box 2341, San Bernardino, California. Mayor Minor explained the actions taken by the five-member panel who reviewed the applicants for Chief of Police and stated the performance goals established for the new Chief of Police. Council Member Oberhelman made a motion, seconded by Council Member Devlin, that the appointment of Lee Dean, Chief of Police, be approved. A discussion ensued concerning the goals Department, the hiring process for the Chief of health and safety issues facing the City. of the Police Police and the Mayor Minor acknowledged Assistant Chief of Police Harp for the fine job he has done as Acting Chief of Police and recognized his professionalism as exhibited by his willingness to ensure a smooth transition for the new Chief of Police. COUNCIL MEMBER MILLER RETURNED At 10:14 a.m., Council Member Miller returned to the Council 3 12/18/95 meeting and took her place at the council table. The motion carried by the following vote: Ayes: Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Nays: Council Member Pope-Ludlam. Absent: None. Council Miller. Lee Dean, Chief of Police, speaking from the podium, stated that he believes San Bernardino is going through a revitalization process and indicated that he will earn the faith of its citizens. Council Member Oberhelman made a motion, seconded by Council Member Devlin, that the employment contract with Lee Dean, Chief of Police, be approved. City Attorney Penman explained that the points of the contract were negotiated by the Mayor and Assistant City Administrator Fred Wilson and read the provisions of the employment contract. It was noted that the newly appointed Chief of Police has agreed to live within the City, howeve>', it is not a condition of employment. Jeff Wright, P. O. Box 2341, San Bernardino, CA, inquired about the severance pay and expressed concern regarding the appointment of a new Mayor and the effect it would have on the appointment of the Chief of Police. Morsell Johnson, National Association for the Advancement of Colored People (NAACP), 1505 W. Highland Avenue, Suite 11, San Bernardino, CA, stated that he is pleased that the new Chief of Police has made a commitment for the recruitment of minorities and asked that the Chief of Police work with the NAACP. The motion carried by the following vote: Ayes: Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Nays: Council Member Pope-Ludlam. Absent: None. Council Miller. EMPLOYEE RECOGNITION AWARDS - THIRD QUARTER 1995 (2) Les Fogassy, Chairman, Employee Recognition Award Selection Committee, submitted a memorandum dated December 11, 1995, relative to the 1995 Third Quarter Employee Recognition Award recipients: Management/ Confidential Mid-Management Safety General Frank Mankin Police Michael Eckley Phil Drury Betty Deal Police Fire Parks, Recreation & Community Services 4 12/18/95 Mayor Minor presented certificates of recognition to the . individuals noted above. KEEP AMERICA BEAUTIFUL AWARD - REDUCE, REUSE, RECYCLE (GOVERNMENT) CATEGORY - KEEP AMERICA BEAUTIFUL, INC. PUBLIC SERVICES DEPARTMENT (2A) Jim Howell, Acting Director of Public Services, and Lynn Merrill, Recycling Coordinator, presented the Mayor with the Keep America Beautiful Award bestowed to the City by Keep America Beautiful, Inc., for its used-oil education program in the Reduce, Reuse, Recycle (Government) category. Mayor Minor accepted the award and presented certificates of recognition to Lynn Merrill, Recycling Coordinator, and Interns Jimmy Kendall and Linda Ceballos, for their efforts in preparing the application and directing the program. COPS FOR KIDS AT CHRISTMAS SAN BERNARDINO POLICE OFFICERS ASSOCIATION (SBPOA) - FOSTER CARE ORGANIZATION - FIFTH ANNUAL CHRISTMAS PROGRAM (2B) Barbara Pfennighausen, Administrative Assistant, San Bernardino Police Officers Association, 568 N. Mt. View Avenue, San Bernardino, CA, presented a plaque to the Mayor in sincere appreciation of the City's contributions to their special children. Mayor Minor accepted the award. COMMENDATION POLICE SERGEANT ADMINISTRATION OF THE NEW POLICE STEVEN KLETTENBERG FACILITY CONSTRUCTION (2C) J. Lorraine Velarde, Executive Assistant to the Mayor, read a resolution commending Police Sergeant Steven Klettenberg for his efforts in the administration of the new police facility construction. Sergeant Klettenberg accepted his commendation. COMMENDATION - MR. & MRS. DWORSCHAK - WALLY'S CYCLE WORLD - COUNCIL MEMBER CURLIN (2D) Council Member commending Mr. & Mrs. Line, San Bernardino, Line corridor. Curlin read and presented a resolution Dworschak of Wally's Cycle World, 473 W. Base CA, for their efforts in maintaining the Base Mr. & Mrs. Dworschak accepted their commendation. CITY ATTORNEY PENMAN EXCUSED At 11:10 a.m., City Attorney Penman left the Council meeting 5 12/18/95 and was replaced by Senior Assistant City Attorney Barlow. SERVICE PIN AWARDS (2E) J. RECONVENE MEETING At 11:20 a.m., Mayor Minor reconvened the regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller, Senior Assistant City Attorney Barlow and Economic Development Agency Special Counsel Timothy Sabo, City Clerk Rachel Clark; Economic Development Agency Administrator Timothy Steinhaus. COMMUNITY DEVELOPMENT COMMISSION/SAN BERNARDINO JOINT POWERS FINANCING AUTHORITY - JOINT REGULAR MEETING At 11:20 a.m., Chairman Minor called the joint regular meeting of the Community Development Commission/San Bernardino Joint Powers Financing Authority and Mayor and Common Council to order in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. 6 12/18/95 NOTE: The items reflected within the Community Development ,Commission portion of the minutes are those which require action by the Mayor and Common Council. Therefore, action taken relative to Items R1, R3, R4, R6, R7, R10, R11, R12, RS1 and RS2 will not be annotated. Minutes of actions taken on Community Development Commission items are distributed separately by the Economic Development Agency. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (R2) Council Member Oberhelman made a motion, seconded by Council Member Negrete, and unanimously carried, that full reading of the resolutions and ordinances on the regular agenda of the Community Development Commission/San Bernardino Joint Powers Financing Authority and Mayor and Common Council, be waived. RES. 95-421 - RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO BUILDING ENERGY CONSULTANTS FOR UPGRADE OF SPORTS LIGHTING AT RAY GUTIERREZ PARK. (R5) Council Member Oberhelman made a motion, seconded by Council Member Negrete, that said resolution be adopted. Resolution No. 95-421 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. RES. 95-422 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING EXHIBIT "I" TO RESOLUTION NO. 91-185, TO ADD ORANGE SHOW ROAD AND TWENTY-FIRST STREET. (R8) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said resolution be adopted. A discussion was held relative to the addition of 21st Street. Council Member Curlin made a substitute motion, seconded by Council Member Oberhelman, that said resolution be adopted as amended to extend the 21st Street 50/50 landscape project to Del Rosa Avenue. The substitute motion carried and Resolution No. 95-422 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Pope-Ludlam, Miller. Nays: None. Abstain: Council Member Devlin. Absent: None. RES. 95-423 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE ISSUANCE OF THAT CERTAIN MULTIFAMILY HOUSING REVENUE NOTE BY THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO UNDER SECTION 147(F) OF THE INTERNAL REVENUE CODE. (R9A) 7 12/18/95 RES. 95-424 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, APPROVING THE ISSUANCE OF THAT CERTAIN MULTIFAMILY HOUSING REVENUE NOTE BY THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO UNDER SECTION 147(F) OF THE INTERNAL REVENUE CODE. (R9B) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that said resolutions be adopted. RECONVENE MEETING At 2:02 p.m., Mayor Minor reconvened the regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Hernandez, Oberhelman, Devlin, Miller, Deputy City Attorney Empeno; City Clerk Rachel Clark; Planning & Building Services Director Boughey. DEVELOPMENT CODE AMENDMENT NO. 95-05 - CONDITIONAL USE PERMIT NO. 95-11 - TO ALLOW A NEW SERVICE STATION TO LOCATE ALONG A MAJOR OR SECONDARY ARTERIAL WITH A FREEWAY OFF-RAMP WITHIN THE FREEWAY CORRIDOR OVERLAY - SOUTHWEST CORNER OF VARSITY AVENUE & UNIVERSITY PARKWAY - UNOCAL - CONTINUED FROM DECEMBER 4, 1995 (33) This is the time and place continued to approve the findings of facts in support of the denial of Development Code Amendment No. 95-05 and Conditional Use Permit No. 95-11. Director Boughey provided a synopsis of the action taken relative to Development Code Amendment No. 95-05 and Conditional Use Permit No. 95-11. Stephen Jamieson, Attorney for UNOCAL, 426 Culver Boulevard, Playa Del Rey, CA, urged the Mayor and Council to deny the findings of facts in support of the denial and requested reconsideration of 8 12/18/95 the previous action taken. COUNCIL MEMBER CURLIN RETURNED At 2:06 p.m., Council Member Curlin returned to the Council meeting and took his place at the council table. Barry Hammond, Service Station Services, 3 Hutton Centre Drive, #711, Santa Ana, CA, requested that the findings of facts be rejected and that the matter be reconsidered and readvertised as a public hearing. Council Member Devlin made a motion, seconded by Council Member Miller, to deny the findings of facts, and that a public hearing be readvertised and conducted. Council Member Hernandez made a substitute motion, seconded by Council Member Miller, that the previous action taken at the Mayor and Council meeting of November 20, 1995, to deny Development Code Amendment No. 95-05 and Conditional Use Permit No. 95-11, be reconsidered. The substitute motion carried by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Devlin, Miller. Nays: Council Member Oberhelman. Absent: Council Member Pope-Ludlam. A discussion was held regarding the appropriate course of action relative to the reconsideration of the matter. It was noted that the matter would be readvertised and brought back as a public hearing on January 22, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. COUNCIL MEMBER At 2:14 p.m., Council meeting and POPE-LUDLAM RETURNED Council Member Pope-Ludlam returned took her place at the council table. to the PUBLIC HEARING - DEVELOPMENT CODE AMENDMENT NO. 94-07 - FENCE STANDARDS - CITY INITIATED (34) This is the time and place set to conduct a public hearing to consider changing the City-wide fence standards. Al Boughey, Director of Planning & Building Services, submitted a Staff Report dated November 22, 1995, concerning Development Code Amendment No. 94-07 to change the City-wide fence standards. Mayor Minor opened the hearing. Director Boughey provided a synopsis of the proposed Development Code Amendment No. 94-07. 9 12/18/95 The following individuals expressed support for the use of ,chain-link fencing for the front of residential properties: Jeff Wright, P. O. Box 2341, San Bernardino, California. william Goines, 2195 19th Street, San Bernardino, California, who also submitted a letter of support dated November 18, 1995. Carol Thrasher, 1757 N. Arrowhead Avenue, San Bernardino, California. Larry Quiel, 4040 La Hacienda, San Bernardino, California. A discussion was held concerning the current chain-link fence provisions and the need to address the citizens' concerns relative to security, cost and use of chain-link fencing within residential front yards. AN ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 19.20, SECTION 19.20.030(8), "FENCES, WALLS AND HEDGES" OF THE SAN BERNARDINO MUNICIPAL CODE (DEVELOPMENT CODE) PERTAINING TO SPECIFIED FENCING STANDARDS IN RESIDENTIAL DISTRICTS. First (34) Council Member Oberhelman made a motion, seconded by Council Member Miller, and unanimously carried, that the hearing be closed. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the matter be continued to January 22, 1996, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, CA, and that staff be directed to bring back the revisions to the ordinance to allow the use of chain-link fences within residential front yards at a height not-to-exceed four feet (4'), to include low-voltage fencing. PLANNING & BUILDING SERVICES DIRECTOR BOUGHEY EXCUSED At 2:51 p.m., Planning & Building Services Director Boughey left the Council meeting and was replaced by Assistant City Administrator Wilson. DEPUTY CITY ATTORNEY EMPENO EXCUSED At 2:51 p.m., Deputy City Attorney Empeno left the Council meeting and was replaced by City Attorney Penman. WAIVE FEES LUTHER KING AMERICA $1,660.38 POLICE PERSONNEL PARADE - JANUARY 13, 1996 - BOY MARTIN SCOUTS OF (27) Shauna Clark, City Administrator, submitted a Staff Report dated December 8, 1995, concerning a request from the Boy Scouts of America for a waiver of fees in the amount of $1,660.38 for Police personnel to assist with the Martin Luther King Parade on January 10 12/18/95 13, 1996. Council Member Miller made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the request for a waiver of fees in the amount of $1,660.38 for Police personnel to assist in the Boy Scouts of America Martin Luther King parade on January 13, 1996, be approved. WAIVE FEES $7,588.44 CITY SERVICES, PERSONNEL & EQUIPMENT MARTIN LUTHER KING CELEBRATION RALLY JANUARY 13, 1996 - GREATER RIVERSIDE AREA URBAN LEAGUE (28) Shauna Clark, City Administrator, submitted a Staff Report dated December 8, 1995, concerning a request from the Greater Riverside Area Urban League for a waiver of fees in the amount of $7,588.44 for various City services used to conduct the Martin Luther King Celebration Rally on January 13, 1996. The following individuals expressed support for the waiver of fees in connection with the Martin Luther King Celebration Rally: Jim King, Chairman of the Board, Greater Riverside Area Urban League, 2060 University Avenue, Room 106, Riverside, California. Brian Townsend. Jeff Wright, P. O. Box 2341, San Bernardino, California. John Coleman, Vice President, West Side Action Group. Concern was expressed regarding requesting a waiver of fees, the need costs associated with the event and the City. an outside organization for police personnel, the potential liability to the Council Member Pope-Ludlam made a motion, seconded by Council Member Miller, and unanimously carried, that the request of the Greater Riverside Area Urban League for a waiver of fees in the amount of $7,588.44 for City services/equipment to assist with the conduct of a Martin Luther King Celebration Rally on January 13, 1996, be approved, contingent upon proof of insurance. POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council PUBLIC HEARING APPEAL BOARD OF COMMISSIONERS' ORDER NO. 2865 - 1640 DATE PLACE REYNOLDS BUILDING - GREGORY (17) 11 12/18/95 This is the time and place set to conduct a public hearing ,relative to the Board of Building Commissioners' Order No. 2865 concerning the property located at 1640 Date Place. Al Boughey, Director of Planning & Building Services, submitted a Staff Report dated December 4, 1995, concerning an appeal of the Board of Building Commissioners' Order No. 2865. Laurie Hunt, Urban Environs, 133 E. Vine Street, Redlands, CA, submitted a letter dated December 14, 1995, wherein she withdrew the appeal. Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the matter be tabled. PUBLIC HEARING - CONFIRM ASSESSMENTS - ORDER IMPROVEMENTS - APPROVE ENGINEER'S REPORT - NEW PINE AVENUE ACQUISITION ASSESSMENT DISTRICT NO. 1015 (18) This is the time and place set to conduct a public hearing relative to the formation of New pine Avenue Acquisition Assessment District No. 1015. Roger submitted formation 1015. Hardgrave, Director of Public Works/Engineering, a Staff Report dated November 28, 1995, concerning the of New Pine Avenue Acquisition Assessment District No. Mayor Minor opened the hearing. Jeff Wright, P. O. Box 2341, San Bernardino, CA, questioned the legality of the formation of assessment districts. RES. 95-425 - RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE ASSESSMENT, ORDERING THE IMPROVEMENTS MADE, TOGETHER WITH APPURTENANCES, AND APPROVING THE ENGINEER'S "REPORT." (18A) RES. 95-426 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING ISSUANCE OF AND THE TERMS OF LIMITED OBLIGATION BONDS FOR ASSESSMENT DISTRICT NO. 1015. (18B) Council Member Oberhelman made a motion, seconded by Council Member Devlin, and unanimously carried, that the public hearing relative to the formation of the New Pine Avenue Acquisition Assessment District, to be known as Assessment District No. 1015, be closed.
