HomeMy WebLinkAbout11-13-1995 Minutes MINUTES MAYOR AND COMMON COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO JOINT ADJOURNED REGULAR MEETING NOVEMBER 13, 1995 COUNCIL CHAMBERS This is the time and place set for a joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino from the regular meeting held at 8:00 a.m., Monday, November 6, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, November 6, 1995, and has on file in the Office of the City Clerk an affidavit of posting together with a copy of said order which was posted at 8:00 a.m., Tuesday, November 7, 1995, on the door of the place at which said meeting was held. The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor Minor at 4:04 p.m., in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman and Economic Development Agency Special Counsel Timothy Sabo; City Clerk Rachel Clark; Economic Development Agency Administrator Timothy Steinhaus. Absent: None. COMMUNITY DEVELOPMENT COMMISSION JOINT ADJOURNED REGULAR MEETING At 4:05 p.m., Chairman Minor called the joint adjourned regular meeting of the Community Development Commission and Mayor and Common Council to order in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. CITY ATTORNEY PENMAN EXCUSED At 4:05 p.m., City Attorney Penman left the Council meeting and was replaced by Senior Assistant City Attorney Barlow. ECONOMIC DEVELOPMENT AGENCY SPECIAL COUNSEL SABO EXCUSED At 5:27 p.m., Economic Development Agency Special Counsel Timothy Sabo left the Council meeting. ECONOMIC DEVELOPMENT AGENCY ADMINISTRATOR STEINHAUS EXCUSED At 5:27 p.m., Economic Development Agency Administrator Timothy Steinhaus left the Council meeting and was replaced by City Administrator Shauna Clark. APPROVE IN CONCEPT - BASE LINE AREA BUSINESS ASSOCIATION REQUEST - AFFIX STANDARDIZED STREET BANNERS - DIRECT CITY ATTORNEY TO PREPARE STANDARD FORM LICENSE AGREEMENT - ENCROACHMENT WITHIN STREET RIGHT-OF-WAY - CONTINUED FROM NOVEMBER 6, 1995 (1) This is the date and time continued to consider a request from the Base Line Area Business Associat ion to affix standardized street banners within the Base Line business area. Council Member Curlin submitted a Staff Report dated November 9, 1995, concerning the Base Line Area Business Association's request to affix standardized street banners within the Base Line business area. COUNCIL MEMBER At 5: 28 P . m. , meeting. HERNANDEZ EXCUSED Council Member Hernandez left the Council Council Member Curlin, speaking from the podium, explained the goals of the Base Line Area Business Association. Council Member Oberhelman made a motion, seconded by Council Member Negrete, and unanimously carried, that the request for the Base Line Area Business Association to affix standardized street banners to the street light standards within the Base Line business area be approved in concept; and that the City Attorney be directed to prepare a standard form license agreement to authorize encroachment of these private facilities within the street right- of-way, without the provision that the applicants pay the $500 administrative fee. 2 11/13/95 RECESS MEETING - CLOSED SESSION - REFERENCED LATER IN THE MEETING - SEE PAGE 4 (Sl) At 5:30 p.m., the Mayor and Common Council recessed to closed session for the following: Conference with legal counsel - existing litigation pursuant to Government Code Section 54956.9(a): Bonadiman-McCain. Inc.. et al vs. City of San Bernardino. et al - San Bernardino Superior Court Case No. SCV 25155. CLOSED SESSION At 5:30 p.m., Mayor Minor called the closed session to order in the conference room of the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Member Hernandez. Also present: Senior Assistant City Attorneys Morillo and Barlow and Ernie Wilson, Affirmative Action Officer. COUNCIL MEMBER POPE-LUDLAM EXCUSED At 5:32 p.m., Council Member Pope-Ludlam left the closed session. COUNCIL MEMBER At 5: 39 P . m. , closed session. POPE-LUDLAM RETURNED Council Member Pope-Ludlam returned to the CLOSED SESSION ADJOURNED At 5: 45 P . m., the closed session adj ourned to the joint adjourned regular meeting of the Mayor and Common Council and the Community Development Commission of the City of San Bernardino. RECONVENE MEETING At 5:46 p.m., the joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission reconvened in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Members Negrete, Curlin, Hernandez. 3 11/13/95 CLOSED SESSION ANNOUNCEMENT - REFERENCED EARLIER IN THE MEETING - SEE PAGE 3 (Sl) City Attorney Penman announced that the following action was taken in closed session: In the matter of Bonadiman-McCain, Inc., et al vs. City of San Bernardino, et al - San Bernardino Superior Court Case No. SCV 25155; the City reached a settlement agreement with the following terms: 1. That the contract will remain with Utah Pacific; 2. That the City will amend its Affirmative Action Policy to conform to the City of Los Angeles' "outreach program" approved by the court in Domar Electric; 3. And that the City will reimburse Bonadiman-McCain, Inc., for its attorney fees and costs in an amount not-to- exceed $3,000. The action was approved by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Devlin, Miller. Nays: Council Member Pope-Ludlam. Absent: Council Member Hernandez.
