HomeMy WebLinkAbout09-11-1995 Minutes MINUTES MAYOR AND COMMON COUNCIL AND THE COMMUNITY DEVELOPMENT COMMISSION CITY OF SAN BERNARDINO JOINT ADJOURNED REGULAR MEETING SEPTEMBER 11, 1995 COUNCIL CHAMBERS This is the time and place set for a joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino from the regular meeting held at 8:00 a.m., Tuesday, September 5, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the order of adjournment of said meeting held on Tuesday, September 5, 1995, and has on file in the Office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 1:00 p,m., Wednesday, September 6, 1995, on the door of the place at which said meeting was held. The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor Minor at 4:07 p.m., in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor, Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam; City Attorney Penman, City Clerk Rachel Clark, City Administrator Shauna Clark. Absent: Council Member Miller. ANNOUNCEMENT - CITY ATTORNEY PENMAN City Attorney Penman announced that at the regular meeting of the Mayor and Common Council held on Tuesday, September 5, 1995, the Mayor and Common Council, acting as the Community Development Commission, had considered the following case and decided to dismiss the case against Mr. Aguilar and to pay Mr. Aguilar $150,000 on his cross complaint. Economic Development Aaency vs. Georae Aauilar and cross complaint - San Bernardino Superior Court Case No. 274061. 1 9/11/95 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION AND SUBMITTING TO THE ELECTORS A MEASURE TO ALLOW CARD CLUBS WITHIN THE CITY OF SAN BERNARDINO, (Continued from September 5, 1995) (1) City Clerk Rachel Clark read the title of the resolution into the record. Council Member Negrete made a motion, seconded by Council Member Pope-Ludlam, that full reading of the resolution be waived; and that said resolution be adopted. (Note: There was no vote taken. ) Discussion ensued regarding whether any particular party or organization had been designated to operate the card club if the voters were to approve allowing card clubs; the costs associated with holding a special election and the impact it would have on the City's budget; whether the matter could be handled by polling voters when they come to vote during the upcoming election rather than holding a special election; and the contents and conditions contained in an agreement between the Economic Development Agency and Rounding Third, a California Limited Liability Company, relative to a gaming casino. City Clerk Rachel Clark stated that a special election would cost approximately $110,000-115,000. In order to minimize expenses, Mrs. Clark proposed conducting an all mail ballot election. Lynn LeRoy, Tribal Chairperson, San Manuel Band of Mission Indians (San Manuel), 5797 Victoria Avenue, Highland, CA, spoke in opposition to the special election, and stated that if there is a special election relative to a gaming casino, San Manuel would like to see someone designated to manage the gaming operation before it goes on the ballot. Discussion followed relative to whether the San Manuel Band of Mission Indians would be interested in operating a gaming room if the opportunity was available. Ken Ramirez, Vice Chairperson, San Manuel Band of Mission Indians, 5797 Victoria Avenue, Highland, CA, indicated that San Manuel is interested only if another gaming casino is coming to San Bernardino; however, they would not want to lose what they have at the reservation. John Kirley, 1170 N. Arrowhead Avenue, San Bernardino, CA, spoke in support of a special election which would allow the voters to decide whether card clubs should be allowed within the City of San Bernardino. 2 9/11/95 Council questioned whether a prospective operator could help to defray the costs of a special election, City Attorney Penman stated he had not researched the matter, but believed there was a provision which prohibited private individuals from paying for public elections. Jerome Levine, Attorney for the San Manuel Band of Mission Indians, stated that the agreement between the Economic Development Agency and Rounding Third, a California Limited Liability Company, contained a number of specifications unfavorable to San Manuel, and noted that San Manuel has been unable to obtain any information concerning Rounding Third and parties interested in operating the gaming casino. Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, stated that a feasibility study should be conducted before any additional gambling is allowed in the city. Council Member Negrete made a substitute motion, seconded by Council Member Curlin, and unanimously carried, that the matter be continued to September 18, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
