Absent: Council Members Negrete, Pope-Ludlam. Also present: Fred Wilson, Assistant City Administrator; Senior Assistant City Attorney Morillo, Deputy City Attorney Roth, Deputy City Attorney Rhemrev, and Margaret Scroggin, Administrative Operations Supervisor, City Attorney's Office. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 8:08 a.m., Council Member Pope-Ludlam arrived at the closed session. ASSISTANT CITY ADMINISTRATOR WILSON EXCUSED At 8:17 a.m., Assistant City Administrator Fred Wilson left the closed session. READING OF RESOLUTIONS & ORDINANCES Deputy City Clerk Vale read the titles of all the resolutions and ordinances on the Mayor and Common Council, Community Development Commission and San Bernardino Joint Powers Financing Authority regular and supplemental agendas while the Council was in closed session. COUNCIL MEMBER NEGRETE ARRIVED At 8:20 a.m., Council Member Negrete arrived at the closed session. ADJOURN CLOSED SESSION At 8: 34 a. m., the closed session adj ourned to the regular meeting of the Mayor and Common Council. RECONVENE MEETING At 9:01 a.m., Mayor Pro Tem Oberhelman reconvened the regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. APPOINTMENT STANLEY MCINTYRE COMMISSION - COUNCIL MEMBER NEGRETE HUMAN RELATIONS (83) Mayor Minor submitted a Staff Report dated June 14, 1995, recommending the appointment of Stanley McIntyre, 332 W. 18th St., San Bernardino, CA, to the Human Relations Commission, as requested by Council Member Negrete. Council Member Hernandez made a motion, seconded by Council Member Devlin, and unanimously carried, that the appointment of Stanley McIntyre to the Human Relations Commission, as requested by Council Member Negrete, be approved. PRESENTATION TACHlKAWA JAPAN SISTER CITY STUDENTS - AMBASSADOR OF GOODWILL CERTIFICATES EXCHANGE (2) Jean Anderson, Executive Director, Cultural and International Affairs, Mayor's Office, introduced the following high school students who are participating as exchange students in the Sister Cities Program, representing the City of San Bernardino as Ambassadors of Goodwill, and will be leaving on June 23, 1995, to Tachikawa, Japan: Jade Atmore, Pacific High School; Shannon Boyce, San Bernardino High School; Kurt Reichardt, San Bernardino High School; Stacy Sakaguychi, San Gorgonio High School; and Steven Tsuda, San Gorgonio High School. Each student received an Ambassador of Goodwill Certificate. PRESENTATION - COMMENDATION - ALAN PAYNE, JEFF LEWIS & ROBERT PHILLIPS (2A) J. Lorraine Velarde, Executive Assistant to the Mayor, read a commendation to Fire Department employees Alan Payne, Jeff Lewis, and Robert Phillips for their recent efforts to prevent an attempted suicide. ANNOUNCEMENT - COUNCIL MEMBER DEVLIN (3A) Council Member Devlin expressed sympathy to the family of Danny Moreno on his passing and to Mayor Minor and his family on the death of his mother. ANNOUNCEMENT - COUNCIL MEMBER POPE-LUDLAM (3B) Council Member Pope-Ludlam expl:essed sympathy to Danny Moreno's family upon his recent death. ANNOUNCEMENT - COUNCIL MEMBER MILLER (3c) Council Member Miller expressed sympathy to the family of Danny Moreno on his passing and to Mayor Minor and his family on the death of his mother. ANNOUNCEMENT - COUNCIL MEMBER OBERHELMAN (3D) Council Member Oberhelman congratulated recent graduates of local educational institutions on their academic success. PUBLIC COMMENTS - JOHN TUCKER (4) John Tucker, San Bernardino Public Employees Association, 433 N. Sierra Way, San Bernardino, CA, representing the middle management employees, expressed concern relative to the Fiscal Year 1995/96 budget and recommended that all planned expenditures for meetings and conferences, subscriptions, and vehicle replacement be canceled in light of the City's budget situation. 4 6/19/95 PUBLIC COMMENTS - CATHERINE MEISTER (4A) Catherine Meister, Chairperson, Baseline Area Business Association, expressed concern regarding the lack of progress on the planned beautification of the area bounded by Baseline Street, the 1-215 Freeway and Waterman Avenue. PUBLIC COMMENTS - KEN DURR (4B) Ken Durr, member Baseline Area Business Association, voiced concern regarding the lack of progress on the planned beautification of the area bounded by Baseline Street, the 1-215 Freeway and Waterman Avenue. PUBLIC COMMENTS - BARBARA SKY (4c) Barbara Sky, 6464 Palm Avenue, San Bernardino, CA, member of the Baseline Area Business Association, urged the Mayor and Council to proceed with the planned beautification of the area bounded by Baseline Street, the 1-215 Freeway and Waterman Avenue, through the installation of trees and street lights. PUBLIC COMMENTS - JEFF WRIGHT (4D) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed concern regarding the City's treatment of homeless individuals attempting to gather recyclable materials in the City. PUBLIC COMMENTS - TERRY MOLL (4E) Terry Moll, 6705 N. Steven Way, San Bernardino, CA, expressed concern regarding the lack of decorum in recent Mayor and Common Council meetings and City elections. PUBLIC COMMENTS - RUBEN LOPEZ (4F) Ruben Lopez, 631 West expressed concern regarding financial assistance provided Steward. 16th Street, San Bernardino, CA, recent Economic Development Agency to Roger's Bindery and developer Alan PUBLIC COMMENTS - KEITH THOMPSON (4G) Keith Thompson, 2130 Sunrise, San Bernardino, CA, expressed concern regarding the lack of progress in the revitalization of the Arden/Guthrie area and submitted to City Clerk Rachel Clark documentation regarding his position on this matter. PUBLIC COMMENTS - STEPHEN SUTHERLAND (4H) Stephen Sutherland, 426 member Baseline Area Business W. Baseline, Association, San Bernardino, CA, urged the Mayor and 5 6/19/95 Council to proceed with the planned beautification of the area bounded by Baseline Street, the 1-215 Freeway and Waterman Avenue, through the installation of trees and street lights. POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (5) Council Member Miller made a motion, seconded by Council Member Curlin, and unanimously carried, that full reading of the resolutions and ordinances on the regular and supplemental agenda of the Mayor and Common Council, be waived. COUNCIL MINUTES (6) Council Member Miller made a motion, seconded by Council Member Negrete, and unanimously carried, that the minutes of the following meetings of the Mayor and Common Council of the City of San Bernardino be approved as submitted in typewritten form: April 17, 1995, May 22, 1995. COUNCIL MEMBER MILLER EXCUSED At 9:53 a.m., Council Member Miller left the Council meeting. RES. 95-188 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING A FIRST AMENDMENT TO THE AGREEMENT WITH LOS PADRINOS, INC., A NON-PROFIT ORGANIZATION, TO IMPLEMENT A COMPREHENSIVE CITYWIDE GRAFFITI REMOVAL PROGRAM, BY EXTENDING THE TERM OF THE AGREEMENT FOR A ONE YEAR PERIOD. (7) Council Member Hernandez made a motion, seconded by Council Member Negrete, that said resolution be adopted. Resolution Ayes: Council Devlin. Nays: Miller. No. 95-188 was Members Negrete, None. Absent: adopted by the following vote: Curlin, Hernandez, Oberhelman, Council Members Pope-Ludlam, 6 6/19/95 RES. 95-189 - RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED VEHICLES) ON SAID PROPERTIES. (8) Council Member Hernandez made a motion, seconded by Council Member Devlin, that said resolution be adopted. Resolution Ayes: Council Devlin. Nays: Miller. No. 95-189 was adopted by the following vote: Members Negrete, Curlin, Hernandez, Oberhelman, None. Absent: Council Members Pope-Ludlam, COUNCIL MEMBERS POPE-LUDLAM & MILLER RETURNED At 9:54 a.m., Council Members Pope-Ludlam and Miller returned to the Council meeting and took their places at the council table. RES. 95-190 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND MONTGOMERY KONE RELATING TO THE SERVICE OF ELEVATORS AND ESCALATORS IN CITY BUILDINGS. (9) Council Member Devlin made a mction, seconded by Council Member Hernandez, that said resolution be adopted. Resolution No. 95-190 was adopted by the following vote: Ayes: Council Members Negrete, Curl in, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. RES. 95-191 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 89-483 ENTITLED IN PART "RESOLUTION... AUTHORIZING THE FILING OF AN APPLICATION FOR THE ACQUISITION OF FEDERAL SURPLUS PROPERTY FROM THE CALIFORNIA STATE AGENCY..."; AND REPLACING MARSHALL W. JULIAN WITH SHAUNA CLARK, CITY ADMINISTRATOR, TO ACQUIRE FEDERAL SURPLUS PROPERTY. (10) Council Member Hernandez made a motion, seconded by Council Member Devlin, that said resolution be adopted. RES. 95-192 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE STATE OF CALIFORNIA, DEPARTMENT OF MENTAL HEALTH FOR THE PROVISION OF REFUSE DISPOSAL SERVICES TO PATTON STATE HOSPITAL. (11) 7 6/19/95 Council Member Hernandez made a motion, seconded by Council Member Devlin, that said resolution be adopted. Resolution No. 95-192 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. CLAIMS & PAYROLL (12) Council Member Hernandez made a motion, seconded by Council Member Negrete, and unanimously carried, that the claims and payroll and authorization to issue warrants as listed on the memorandum dated June 5, 1995, from the Director of Finance, be approved. PERSONNEL ACTIONS (13) Council Member Hernandez made a motion, seconded by Council Member Miller, and unanimously carried, that the personnel actions submitted by the Chief Examiner dated June 8, 1995, in accordance with Civil Service Rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified, except for Personnel Action Item Nos. 1 - 10 and 36, which are to be discussed during the next Fiscal Year 1995/96 budget hearing. (Note: Subsequently, a budget hearing was scheduled for Monday, June 26, 1995.) ORD. MC-945 - AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 12.98 TO THE SAN BERNARDINO MUNICIPAL CODE AND ADDING SUBSECTION 9 TO SECTION 9.90.010.A RELATING TO CAMPING ON PUBLIC STREET AND PARKS. Final (14) Jeff Wright, P. O. Box 2341, San Bernardino, CA, spoke in opposition to the proposed ordinance because of its negative impact on homeless individuals. Council Member Devlin made a motion, seconded by Council Member Negrete, that said ordinance be adopted. Ordinance No. MC-945 was adopted by the following vote: Council Members Negrete, Curlin, Hernandez, Oberhelman, Pope-Ludlam, Miller. Nays: None. Absent: None. Ayes: Devlin, RESOLUTION OF THE CITY OF SAN BERNARDINO CONFIRMING THE 1995-96 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 994 FOR CITY-WIDE STREET LIGHTING, STREET SWEEPING, TRAFFIC SIGNAL MAINTENANCE AND GRAFFITI REMOVAL. (15) Council Member Hernandez made a motion, seconded by Council Member Devlin, that said resolution be adopted. 8 6/19/95 Discussion ensued regarding how the funds generated from Assessment District No. 994 had been spent over the past year. Council Member Curlin made a substitute motion, seconded by Council Member Negrete, and unanimously carried, that the matter be continued to July 10, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. BERNARDINO ASSESSMENT NORTH "H" (29) Council Member Devlin made a motion, seconded by Council Member Curlin, that said resolutions be adopted. (Item Nos. 16 - 29. ) Resolution Nos. 95-193, 95-194, 95-195, 95-196, 95-197, 95- 198 , 95 -19 9 , 95 - 2 0 0, 95 - 2 01 , 95 - 2 0 2 , 95 - 203 , 95 - 2 04, 95 - 2 0 5 , and 95-206 were adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. Absent: None. PUBLIC HEARING - IMPOSE LIENS ON PROPERTY - UNCOLLECTED BUSINESS REGISTRATION FEES (35) This is the time and place set for a public hearing to consider imposing liens on real property in the City of San Bernardino for uncollected business registration fees for the rental of single family dwelling units. Rachel Clark, City Clerk, submitted a Staff Report dated June 1, 1995, requesting authorization to impose liens on real property for uncollected business registration fees. 10 6/19/95 City Clerk Rachel Clark submitted a memorandum dated June 19 1995, requesting that the following properties be removed fro~ Exhibit A of the resolution: 1908 and 1918 S. Business Center Dr., San Bernardino. Mayor Pro Tem Oberhelman opened t~e hearing. Mr. Jean Gazzolo, 2039 W. Elm opposition to the placing of liens on at 239, 231, 229, and 225 S. "E" St., Ave., Anaheim, CA, the four properties San Bernardino. voiced he owns RES. 95-207 - RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR UNCOLLECTED BUSINESS REGISTRATION FEES. (35) Council Member Hernandez made a motion, seconded by Council Member Negrete, that the hearing be closed; that said resolution be adopted as amended to delete the following addresses from Exhibit A: 1908 and 1918 S. Business Center Dr.,; and that the matter of placing a lien on the four properties owned by Mr. Jean Gazzolo located at 225, 229, 231 and 239 S. "E" St., San Bernardino, be continued to July 10, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The motion carried, and Resolution No. 95-207 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Miller. Nays: Council Member Pope- Ludlam. RECONVENE MEETING At 10:34 a.m., Mayor Pro Tern Oberhelman reconvened the regular meeting of the Mayor and Common COl:TIcil of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
