A quorum not being present, the City Clerk has caused to be posted the order of adjournment of said meeting held on Tuesday, January 17, 1995, and has on file in the Office of the City Clerk an affidavit of said posting which was posted on Wednesday, January 18, 1995, on the door of the place at which said meeting was held. The adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Minor at 8:03 a.m., Monday, January 23, 1995, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by City Clerk Rachel Clark with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin; City Attorney Penman; City Clerk Rachel Clark; City Administrator Shauna Clark. Absent: Council Members Pope-Ludlam, Miller. RECESS MEETING - CLOSED SESSION (1 & Sl) At 8:03 a.m., the Mayor and Common Council recessed to closed session for the following: 1. RECONVENE MEETING At 9:00 a.m., Mayor Minor reconvened the adjourned regular meeting of the Mayor and Common Council of the City of San Bernardino in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll call was taken by Deputy City Clerk Vale with the following being present: Mayor Minor; Council Members Negrete, Curlin, Hernandez, Oberhelman, Devlin, Pope-Ludlam, Miller; City Attorney Penman; Deputy City Clerk Vale; City Administrator Shauna Clark. Absent: None. INVOCATION The invocation was given by Phil Arvizo, Executive Assistant to the Council. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Council Member Devlin. APPOINTMENT - RICHARD "DICK" KONKLER - BOARD OF POLICE COMMISSIONERS (2) Mayor Minor submitted a Staff Report dated January 10, 1995, concerning the appointment of Richard "Dick" Konkler to the Board of Police Commissioners. 3 1-23-95 Council Member Hernandez made a motion, seconded by Council Member Oberhelman, and unanimously carried, that the appointment of Richard "Dick" Konkler to the Police Commission, as requested by Mayor Minor, be approved. COMMENDATION - BEST LOCAL PRODUCTION & PROFILE AWARD - EASTER SEAL SOCIETY OF THE INLAND COUNTIES - KCSB CHANNEL THREE - TELECOMMUNICATIONS DIVISION (2A) Brian Bost, Inland Director, Easter Seal Society of the Inland Counties, 241 E. 9th Street, San Bernardino, CA, presented an award to Frank Keller, CATV Manager, Telecommunications Division, for his staff's assistance in the production of a promotional video to be utilized by the Easter Seal Society. The video received the best local production and profile award. Frank Keller, CATV Manager, accepted the award and acknowledged the following members of his staff: Mansie Booker, Video Production Coordinator; production Technicians Mike Flattery and Richard Wolf; and CATV production Programming Assistants Michelle Carter and Jim Villegas. ANNOUNCEMENT - COUNCIL MEMBER HERNANDEZ (3) Council Member Hernandez expressed appreciation to the voters in the Third Ward who did not participate in the recent recall efforts. ANNOUNCEMENT - COUNCIL MEMBER OBERHELMAN (3A) Council Member Oberhelman commended the Telecommunications staff, KCSB Channel Three, for their efforts in the production of the Easter Seal Society video. ANNOUNCEMENT - CITY ATTORNEY PENMAN (3B) City Attorney Penman stated that the Brown Act prohibits discussion on items not on the agenda; however, permits brief statements on public comments. It was requested that the matter be addressed in writing. PUBLIC COMMENTS - RODERICK SHACKELFORD (4) Roderick Shackelford, 1471 S. Arrowhead, San Bernardino, CA, requested that the City present a resolution of commendation to Guy Bluford, first African American in space, who is scheduled to speak before the students of San Bernardino Valley College at 11:00 a.m., February 15, 1995. PUBLIC COMMENTS - RUBEN LOPEZ (4A) Ruben Lopez, 631 W. 16th Street, San Bernardino, CA, expressed discontent towards the actions displayed by the legislative body in respect to the legal advisors and conduct of the meetings of the Community Development Commission. PUBLIC COMMENTS - BOB MONGIELLO (4B) Bob Mongiello, 1804 State Street, San Bernardino, CA, expressed disapproval regarding the actions taken by the Code Enforcement Division of the Planning & Building Services Department for the abatement of public nuisances. 5 1-23-95 PUBLIC COMMENTS - JOAN MONGIELLO (4e) Joan Mongiello, 1804 State Street, San Bernardino, CA, reiterated the concerns expressed by Bob Mongiello and requested an investigation into the qualifications of the current Code Enforcement Supervisor. PUBLIC COMMENTS - KAREN TORRES (4D) Karen Torres, Chairperson, Committee to Recall Edward Negrete, 631 North "L" Street, San Bernardino, CA, expressed concern regarding the illegal voter abuse which is exhibited during City elections and requested assistance from the City to ensure a fair election is conducted for the upcoming First Ward recall election. PUBLIC COMMENTS - EUNICE THOMPSON (4E) Eunice Thompson, 2116 Sunrise Lane, San Bernardino, CA, voiced opposition towards the actions taken by the legislative body to meet the needs of the residents within the Arden/Guthrie area. It was requested that the matter be placed on the agenda of the next Housing Committee meeting. PUBLIC COMMENTS - LORI LIPE (4F) Lori Lipe, Owner of City Cleaners, 607 W. Baseline, San Bernardino, CA, presented a letter to the Mayor and Council from the Baseline Area Business Association dated January 20, 1995; and requested that the legislative body assist in cultivating the efforts of the Baseline Area Business Association for beautification of the Baseline corridor. PUBLIC COMMENTS - CATHERINE MEISTER (4G) Catherine Meister, Chairperson, Baseline Area Business Association, 771 W. Baseline, San Bernardino, CA, expressed concern regarding the recent allocation of funds for street lights for the Baseline corridor, in that funds would not be applied for the beautification of such. PUBLIC COMMENTS - BRIAN PLANT (4H) Brian Plant, 498 W. Court Street, San Bernardino, CA, expressed discontent regarding the actions taken by the legislative body in the conduct of the Mayor and Council meetings. CITY ATTORNEY PENMAN EXCUSED At 9:47 a.m., City Attorney Penman left the Council meeting and was replaced by Deputy City Attorney Roth. 6 1-23-95 PUBLIC COMMENTS - COUNCIL MEMBER CURLIN (4I) Council Member Curlin (speaking from the podium) expressed support for the beautification of the Baseline corridor. PUBLIC COMMENTS - ROBERT CASTANEDA (4J) Robert Castaneda, 1425 W. 9th Street, San Bernardino, CA, voiced concern regarding the illegally registered voters within the City and requested assistance from the Mayor and Council to ensure the proper registration of voters. PUBLIC COMMENTS - ROBERT REGO (4K) Robert Rego, Treasurer, We The People, 853 Lynwood, San Bernardino, CA, requested assistance from the Mayor and Council to ensure an honest First Ward recall election and requested a set of procedures which would be adhered to for the recall election. PUBLIC COMMENTS - TERRY MOLL (4L) Terry Moll, 6705 N. Steven Way, San Bernardino, CA, expressed discontent regarding the tactics used to discourage voters from participating in the recent Third Ward recall efforts. DEPUTY CITY CLERK VALE EXCUSED At 10:02 a.m., Deputy City Clerk Vale left the Council meeting and was replaced by City Clerk Rachel Clark. PUBLIC COMMENTS - JEFF WRIGHT (4M) Jeff Wright, P. O. Box 2341, San Bernardino, CA, voiced opposition to members of the Mayor and Council speaking during the public comments portion of the agenda, which in turn limits the time allotted for the public. PUBLIC COMMENTS - STEPHEN SUTHERLAND (4N) Stephen Sutherland, Co-Chairman, Baseline Area Business Association, 426 W. Baseline, San Bernardino, CA, presented a letter to the Mayor and Council dated January 13, 1995; and requested that the Mayor and Council set up a meeting with the Baseline Area Business Association to discuss beautification of the Baseline corridor. PUBLIC COMMENTS - JOHN STEVENS (40) John Stevens, 4097 Pershing Avenue, expressed concern regarding the radioactive former Norton Air Force Base. WAIVE FULL READING OF RESOLUTIONS & ORDINANCES (5) Council Member Negrete made a motion, seconded by Council Member Oberhelman, and unanimously carried, that full reading of the resolutions and ordinances on the adjourned regular and supplemental agenda be waived. RES. 95-17 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A SECOND AMENDMENT TO AGREEMENT WITH THE SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT FOR COMPUTER EXAMINATION SCORING SERVICES FOR AN ADDITIONAL ONE YEAR PERIOD. (6) Council Member Oberhelman made a motion, seconded by Council Member Negrete, that said resolution be adopted. RES. 95-18 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE BLACK CULTURE FOUNDATION RELATING TO FINANCIAL ASSISTANCE FROM THE CIVIC AND PROMOTION FUND FOR FISCAL YEAR 1994/95. (7) Jeff Wright, P. O. Box 2341, that a procedure be developed to funds to all ethnic groups. San Bernardino, CA, requested ensure a fair distribution of Council Member Oberhelman made a motion, seconded by Council Member Negrete, that $31,069 be transferred from the Civic and Promotion Fund to the respective departmental accounts to offset costs associated with the event, as noted in the Staff Report from 8 1-23-95 Fred Wilson, Assistant City Administrator, dated January 12, 1995; and that said resolution be adopted. The motion carried and Resolution No. 95-18 was adopted by the following vote: Ayes: Council Members Negrete, Curlin, Oberhelman, Devlin, Pope-Ludlam, Miller. Nays: None. RES. 95-l9 - RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF ABATEMENT OF PUBLIC NUISANCES (ABANDONED VEHICLES) ON SAID PROPERTIES. (8) Jeff Wright, P. O. Box 2341, San Bernardino, CA, expressed opposition to the placement of liens for the abatement of abandoned vehicles. Council Member Oberhelman made a motion, seconded by Council Member Negrete, that said resolution be adopted. Resolution Council Members Miller. RES. 95-20 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 6413 ENTITLED IN PART, "A RESOLUTION. . . ESTABLISHING A BASIC COMPENSATION PLAN. . . , " BY UPDATING INFORMATION CODIFYING PRIOR COUNCIL ACTION. (9) Council Member Oberhelman requested that he be provided with a report of the actual dollar value for the implementation of the management and confidential salary survey for each position. COUNCIL MEMBER HERNANDEZ RETURNED At 10:19 a.m., Council Member Hernandez returned to the Council meeting and took his place at the council table. A discussion was held regarding the format of the report requested by Council Member Oberhelman. Council Member Negrete made a motion, seconded by Council Member Oberhelman, that said resolution be adopted. Ayes: Devlin, 9 1-23-95 RESOLUTION OF THE CITY OF SAN BERNARDINO IMPLEMENTING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN BERNARDINO AND EMPLOYEES IN THE POLICE SAFETY EMPLOYEES' BARGAINING UNIT OF THE CITY OF SAN BERNARDINO REPRESENTED BY SAN BERNARDINO POLICE OFFICERS' ASSOCIATION (SBPOA). Council Nays: RES. 95-21 - RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A PURCHASE ORDER TO ROTOLO CHEVROLET FOR THE FURNISHING AND DELIVERY OF FOUR (4; EACH, 3/4 TON PICK-UP TRUCKS, TO BE UTILIZED BY THE VARIOUS DEPARTMENTS OF THE CITY OF SAN BERNARDINO IN ACCORDANCE WITH BID SPECIFICATION F-95-13. RES. 95-22 - RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A PURCHASE ORDER TO CHARLES THOMAS COMPANY FOR THE FURNISHING AND DELIVERY OF A FUEL MANAGEMENT SYSTEM TO BE UTILIZED BY THE PUBLIC SERVICES DEPARTMENT OF THE CITY OF SAN BERNARDINO IN ACCORDANCE WITH BID SPECIFICATION F-95-11. CLAIMS AND PAYROLL (13) Council Member Oberhelman made a motion, seconded by Council Member Curlin, that the claims and payroll and authorization to issue warrants as listed on the memorandum dated January 11, 1995, from the Director of Finance, be approved. 10 1~23-95 Jeff Wright, P. PERSONNEL ACTIONS (14) Council Member Oberhelman made a motion, seconded by Council Member Hernandez, that the personnel actions submitted by the Chief Examiner dated January 12, 1995, in accordance with civil Service Rules and Personnel policies adopted by the Mayor and Common Council of the City of San Bernardino, be approved and ratified. INSTALL LEFT TURN PHASES - WATERMAN AVENUE @ GILBERT STREET PLAN NO. 9150 APPROVE PLANS & AUTHORIZE ADVERTISEMENT FOR BIDS - INCREASE ALLOCATION OF FUNDS (15) Roger Hardgrave, Director of Public Works/City Engineer, submitted a Staff Report dated January 4, 1995, concerning the approval of plans and authorization to advertise for bids for installation of left turn phases on Waterman Avenue at Gilbert Street. Council Member Hernandez made a motion, seconded by Council Member Miller, and unanimously carried, that the allocation for Waterman Avenue/Gilbert Street left turn phases, under Account No. 242-362-57393, be increased by $6,000, from $40,000 to $46,000; that Plan No. 9150, for installation of left turn phases on Waterman Avenue at Gilbert Street, be approved; and that the Director of Public Works/City Engineer be authorized to advertise for bids. 11 1-23-95 COUNCIL MEMBER CURLIN RETURNED At 10:33 a.m., Council Member Curlin returned to the Council meeting and took his place at the council table. PUBLIC HEARING - UNCOLLECTED BUSINESS REGISTRATION FEES - IMPOSE LIENS ON PROPERTY WITHIN THE CITY (16) This is the time and place set consider imposing liens for uncollected on property located within the City. for a public hearing to business registration fees Rachel Clark, City Clerk, submitted a Staff Report dated January 4, 1995, and a memorandum dated January 20, 1995, concerning the placement of liens for uncollected business registration fees. City Clerk Rachel Clark explained that the fees have all been collected and recommended that the matter be tabled. RESOLUTION OF THE CITY OF SAN BERNARDINO IMPOSING LIENS ON CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR UNCOLLECTED BUSINESS REGISTRATION FEES. (16) Council Member Hernandez made a motion, Member Oberhelman, and unanimously carried, tabled. seconded by Council that the matter be APPEAL - BOARD OF BUILDING COMMISSIONERS DECISION - 2600 BLOCK OF WEST RIALTO AVENUE - ASSESSOR PARCEL NOS. 0142- 062-06 & 0142-062-08 - WEED ABATEMENT - LUTHER FAIR - CONTINUED FROM JANUARY 9, 1995 (17) This is the time and place continued to consider the Board of Building Commissioners' decision relative to the abatement of weeds on the 2600 block of West Rialto Avenue. Pat Malloy, Director of Public Services, submitted a Staff Report dated January 3, 1995, concerning the abatement of weeds on the 2600 block of West Rialto Avenue. Mayor Minor opened the hearing. Luther Fair, 2505 Foothill Boulevard, San Bernardino, CA, expressed opposition to the costs associated with the weed abatement; however, agreed to pay the following costs: $180 for discing and $70 for staff time, for a total of $250. Discussion ensued regarding the actions taken to address the costs associated with the weed abatement. 12 1-23-95 Pat Malloy, Director of Public Services, provided a synopsis of the meeting held with Mr. Fair and answered questions regarding payment to the contractor. COUNCIL MEMBER POPE-LUDLAM RETURNED At 10 :47 a.m., Council Member Pope-Ludlam returned to the Council meeting and took her place at the council table. Jeff Wright, P. O. Box 2341, San Bernardino, CA, voiced opposition to the appeal process. Health and Safety Code Section 11369 requires that the police notify the INS if someone is arrested for certain drug offenses and is also suspected of being an illegal alien. Attorney General Lungren also stated that arrests should not be conducted for misdemeanors; however, could be made for felonies.
